Women can initiate divorce. Its called Khula. Women cant give Talaq, which is an Arabic term. Both are called divorce in our time.
I hate these horrid misrepresentation of this concept...
Talaq and Khula are both divorces, just comes with different process.
Dear sisters, some people are playing psychological mind games with you making you think you have no rights. Dont listen to them and focus on your character and Ibadah. Dont let classical scholars or the literalists get into your head. They will drive you far away from Islam.
Allah is the most just and merciful. Dont let distorted version of his rulings torment you.
Also the fact that when a man gives a divorce, it's revocable, up to 2x, but for a women, they can ask for khul, which is irrevocable. I think better to focus on that angle which to me explains the wisdom of why Allah SWT has made things the way that they are. Usually normal, faithful women try to save their marriages. They will do everything under the sun. They will turn it in their minds, cry about it, pray about it. When' she's made that decision, it's really done. I saw a quote that a women divorces mentally long before physically. I find that to be very true.
I agree. 💯
But why in khula a woman needs to give the mahar back?? Even if she was wronged?! Thanks
a khula is the female offering compensation to the husband so he can agree to dissolve the marriage.
If the women has legitimate grounds to request a divorce due to mistreatment, then the Islamic judge can dissolve the marriage without a khula
also its stated that if the husband is at fault it is undesirable for him to ask for compensation for the khula.
A lot of rulings in Islam are just that: Rulings made by scholars. A Muslim must always differentiate and dissect an opinion to be able to see which part of it is stated clearly in the Quran and which part is the opinion or interpretation of a scholar. Scholars make mistakes, are biased and also don't always have all the relevant information. Don't put scholars on a pedestal.
Generally speaking, the rulings for every aspect of our lives are extracted from the Qur’an and Sunnah. The rulings our scholars have made over the centuries were done after extensive research. As far as having access to books of hadith, our institutions have been such that they absolutely had access to all the relevant information. Very quickly we’ll realize its our own opinion vs the opinion of countless scholars who have had their rulings checked and verified by other scholars generation after generation.
Sure, scholars can make mistakes, but there are countless instances where if an individual scholar made a mistake, their contemporaries would correct/refute them.
Our tradition has survived to this day because of the work done by Islamic Scholarship. Allah ﷻ said this religion would survive till the Day of Judgement. It could be that it was and will be through Islamic scholarship.
@zafridi100 There are a lot of blinds spots and holes in your argument, @zafridi100. c.o.4054 is more accurate in their argument here.
Can you please give us some examples from this lot of rulings made by scholars that are not in accordance with the Qur'an?
