The 1 to 3 minutes of NO Audio being recorded AFTER police TURN ON their bodycam. They can’t do that due to Federalism, the 10th Amendment. Each state has the Constitutional Right to regulate their own transportation / traffic laws. It would have to be done on an individual state level.

Yep, of you get a dishonest cop that can always happen. The HGN test esspecially usually can't be seen in cameras, and a lot of the instructions are intemtially ambiguous (do you take nine steps and then turn or turn on the ninth step). Any motion of the arms on under balance test can be "perceived" as failing. So many bs ways to say someone failed. Honest cops who won't do this do exist, of course, but almost no cops exist who will stop the dishonest ones.
While on a traffic stop or answering any calls, body cams should not be ALLOWED to mute their body cams. If there is any confidential information, it cam be muted or censored later at the station. They only want to conspire off camera and get their stories straight so they can get their lies strainght. Qualified Immunity needs to end immediately so that officers have to stand up for what they have done.
Agreed, you would think a decent lawyer could get the whole charge thrown out the moment a body cam is muted or turned off. Because they have to have CONSENT to do a FST. They ask for a FST when they DO NOT HAVE probable cause. He ran through a stop sign. Ok. Can’t assume it’s because he’s impaired. So they ask for the FST and fail you. If you’re completely sober demand a breathalyzer.

Also, “Probable Cause” and “Reasonable Suspicion“ dictate two very different standards. Reasonable suspicion(what’s needed for a FST)constitutes the much easier standard to meet ie “He ran a stop sign”, and the one the police utilize the most, “I smell alcohol”. Alas, it doesn’t matter what level of “cause” that’s been established by the Police, as the accused ALWAYS possesses the right to deny a FST. With that being said, I would consult with an attorney from your state to understand EXACTLY your rights, and what you can and can’t do in this type of situation. You need to verbally & audibly invoke your constitutional rights. Your 4th, 5th & 6th. Not answering questions / incriminating yourself and not submitting to search & seizures is good, but, once you've asked them if you are being detained you should also ask for a / your lawyer. I was harassed by them especially when I was young.. they bullied me and harassed me.. I was also beaten up by them with their clubs and sticken in the head by them.. I ran for my life and they almost killed me. They broke into where my father was staying and my father drew his gun on them and they nearly shot my father while they had a standoff in his room as I begged for the beating to stop.. Fact is that you can be arrested for almost all traffic infractions. And if you don't break the law they can just make something up take you to jail, impound and do " inventory" your car. Even if you sue and win police suffer nothing. You may have rights but many times if you exercise those rights police can punish you by the process. So, do you have rights ? Not really.
Everyone should remember that you can be totally innocent and do everything right and the police can still arrest you and take you to jail for absolutely no reason.
@@BeReal918 not always true. Fun fact - just because charges are dropped doesn’t mean they automatically come off your record. It takes thousands of dollars and years to get your record expunged. Those charges can still be seen if someone does a background check.
@@karinaz8756 Oh yes, I am very aware. I've been arrested and charged with a crime that was later dismissed. It DID (like you said) show up on background checks until I paid a couple thousand dollars to my attorney to get it expunged. After I paid him, it took about 3 months (2 court appearances) and then another 2 months before it was _expunged_ from my record. He couldn't get my arrest removed from Google but on _official_ pre-employment background checks, I'm good to go!

Are you sure? In the UK if you refuse a breath test at the roadside you are arrested, taken to the station and breath ,blood /urine samples taken. I would presume that if you are suspected of a dui but refuse the sobriety test it is the officers duty to then arrest you and have the tests done at the station, I seriously doubt they are going to have you say I am not doing the sobriety test and they just say OK then you can carry on down the road and kill someone in the accident you are going to cause, no they will arrest you. He has a right to refuse all tests go to jail and still refuse all tests. If he is innocent like this man was (at least for DUI) he can sue the officers in court and have punitive and some time monetary relief for these officers violating his 4 th amendment and any others they may have violated.

I don’t have the balls to say “I don’t answer questions” repeatedly and then cite case law telling them unless they reasonably believe they need to search me for weapons, I do not need to get out of the car. We need plenty more videos like this so it can reenforce the public confidence in their own rights when dealing with officers like this.
If body cams are muted at any time during a stop should be enough proof that the officer didn't believe the stop was serious enough to any charges made

I wholeheartedly believe this because if they have to cover sensitive information that can be done in post, via a neutral or superseding authority. Saying hey, during this arrest, we encountered a person under deep cover, and we need to blur the part this person‘s face. They can all do that, after the fact, verses NOT having facts of matter on hand, and it can never be recovered again.
The agency I was with removed the mute feature. There is legitimate reasons to mute however it’s very Minimal and has been over used. Instead we would say Mute into the mic and if bodycam was public request IT would mute the sections. If they wanted to see what was said it would be with attorney at the agency and not get a copy. Unless the lawyer pushed the case that he needed it for whatever reason and requested the judge to force it unmuted. This is legit reason when dealing with gangs/narc. But again the mute was way over used.
Detained for running a stop sign. How many times did he tell them he doesn’t consent to any searches or seizures and was refusing to participate in or comply with any FSTs? And how many times did he tell them to write the ticket so he could be on his way? These cops conspired to violate his rights and then arrested and kidnapped him for A non-arrestable TRAFFIC offense! This is so infuriating! These cops should have to pay him civil damages out of their pensions.
Body cams shouldn't even give them the option to mute their mics when sensitive information can be redacted/censored at post processing. They were clearly conspiring, trying to get him on a bigger charge but he didn't play their game.
All traffic violations are arrestable offenses. The ticket they give you states that fact and your signature is your Bond so they don't have to take you to jail. Refuse to sign and off to jail you go. That does not apply in this case; they decided not go offer a ticket (because he was impaired) and took him to jail to protect the public.
They would have taken him to jail for suspicion of DUI anyway. So either way he was going to get screwed. He just chose the terms and didn’t let the police. Well done. I’d rather be arrested for running a stop sign than dui

Refusing to answer a question if he needed help getting out of the car was a good way to avoid a testimony from that officer later in court, that the arrested person asked for help to get out of the car and was stumbling and has had a lack of balance typical for a drunk person. Answer to absolutely ANY question may, and possibly will be used against you. Cops are doing this for a living and have more experience in catching people, than almost all of the citizens. Also, if the body cam would be "accidentally" muted, then there might be a video of you answering questions from the surveillance cams, no sound. And the judge most prob would believe a cop's word over yours. There's no possible good reason for answering any questions at all. It can't help you in any possible way, but may hurt you. And with crooked cops that are already retaliated for not playing their game? I'd say, just invoke the fifth one time, and keep being silent after that.

Not getting a DUI by being sober... it works MOST of the time. There was that one kid who blew .00 and STILL got arrested. And is now being sued by the cops because they're butthurt that he embarrassed them.
The only DUI arrest I had I blew the 0.00. I asked the officer what 0.00 meant. He got mad and told me to blow again. I blew a 0.00 again and I said, “Hey! Look at that! It says 0.00 again. He let me go after he fumed for a while. It was in Idaho. Maybe I was wobbly in my boots walking the line. But not enough to get jailed. I won’t submit to their tests ever again.
@jonathanbirch2022refusing the breathalyzer can be horrible advice depending on the state. In my state you automatically get a one year suspended license, fines, and other legal issues even if it is proven later that you were sober.

There shouldn't even be a mute function on any camera issued to law enforcement. It should be federal law that all officers must keep their bodycam on for the full duration of any detainment of any citizen.
Not so fun fact: Axon, the top provider of body cams to agencies, purposely ship their cams without the mute function enabled. A department administrator has to configure and then enable this function for each camera. The cameras are 100% traceable and you can still locate footage recordings and force the audio feed through even if muted, albeit manually. You have to ask yourself why a department would choose to enable this function as it only leads to more scrutiny and mistrust.
Even better, leave the button there but all it does is turn off the little light and continues to record video and audio. The numbers of conspiracy and other crimes it would catch would be astronomical in the first week.

The muting has to be unavailable to them. The station can mute a video with protected information of the suspect at the time of its release. No conversations an officer has can be protected during their public duties. Hopefully, one day, a court case can garner a ruling on this abuse of power.
There is NO legit reason for a police body cam to have a mute capability. Until they don’t, a muted body cam needs to amount to evidence tampering and trigger any charges to be dropped.

I was recently pulled over in rural Utah. The speed limit was 65, my cruise was set to 65, and was told I was pulled over for going 86! The officer who radared me was not the officer that pulled me over, as it was a sting operation. When my wife and I responded that we were not speeding, he immediately claimed he smelled alcohol and that we were in fact going 86 mph, claimed my big tires was why! I responded that I use a GPS that records my speed, and guess what happened next? Field sobriety test! I said you know I have proof of my speed and that he had made an error, and him pulling me over was not justified! He asked me to exit my vehicle so he could check that I was able to drive safely! I informed him that he had no probable cause to pull me over, as I was not speeding and that was an unlawful request! He then said, no shit "I don't smell alcohol now and you are free to go!
Just be careful with denial to exit your vehicle. (Pennsylvania v. Mimms) has ruled that police can order you out of the car for any reason or no reason at all.

As someone who once was a police officer, I can verify that this was a master class on how to avoid a bogus DUI. Everything in this video is accurate. I personally never submit to any field sobriety tests and I also don’t answer questions. I am respectful always… never confrontational. Frankly, there is a case to be made here that the arrest and ultimate incarceration, no matter how short, was a violation of your civil rights. It was retaliatory in my opinion for non-compliance of the FST’s which in most states are voluntary (please check your own state’s laws). Well done sir 👍🏻

My dad was on a department from 1963-1984, he passed in 2003. Even in the 90s before he died he was tired of the punk attitude, entrapment, unethical, rude, etc of officers. He had a few run-ins with some of them they would threaten to arrest him or whatever and then he would drop he was on a dept for 21 years and he knows the law. They would always start stammering and backing down. I would hang out with him and some of the guys he worked with and they would get into that topic and they were sickened / upset over how things were going in law enforcement. I'm kinda glad he didn't live long enough to see what has become of many LEOs

The officer had a pattern of removing everyone from "vehicles" immediately. That female cop was definitely surprised that he had been arrested for running a stop sign, but when the other cop explained that he didn’t wanna cooperate, and that was the real reason he was under arrest, she nodded, like she was going to keep that in the back of her mind next time, somebody didn’t want to cooperate during the traffic stop that she could just arrest them for the citation instead of giving him a citation and sending them on their way. Many traffic violations are misdemeanors. Misdemeanors are criminal offenses. A citation is issued issued in lieu of arrest and is your agreement that you will show up in court. However, you can be arrested for any crime.

You are a HERO for doing this. My rights where also violated many times when I was young and more recently in a motorcycle accident. I did not get off so easy. I had to pay an attorney to get all charges dropped. What did they do? There were no witnesses (except me) to the accident and no actual physical evidence of anything but a crashed motorcycle in the weeds beside the road. They fabricated evidence from already existing marks on the road (obviously created by a car and not a motorcycle) accused me drinking and charged me with several other offenses that would lead to large fines and loss of license.
Body Worn Cameras should not have a mute button on them! This defeats it's purpose as an infallible witness. They should also have a required location to be worn, and should never be covered by the officer!

The HGN test esspecially usually can't be seen in cameras, and a lot of the instructions are intemtially ambiguous (do you take nine steps and then turn or turn on the ninth step). Any motion of the arms on under balance test can be "perceived" as failing. So many bs ways to say someone failed.
Honest cops who won't do this do exist, of course, but almost no cops exist who will stop the dishonest ones.

While on a traffic stop or answering any calls, body cams should not be ALLOWED to mute their body cams. If there is any confidential information, it cam be muted or censored later at the station. They only want to conspire off camera and get their stories straight so they can get their lies strainght. Also, “Probable Cause” and “Reasonable Suspicion“ dictate two very different standards. Reasonable suspicion(what’s needed for a FST)constitutes the much easier standard to meet ie “He ran a stop sign”, and the one the police utilize the most, “I smell alcohol”.
Alas, it doesn’t matter what level of “cause” that’s been established by the Police, as the accused ALWAYS possesses the right to deny a FST.
With that being said, I would consult with an attorney from your state to understand EXACTLY your rights, and what you can and can’t do in this type of situation. It DID (like you said) show up on background checks until I paid a couple thousand dollars to my attorney to get it expunged. After I paid him, it took about 3 months (2 court appearances) and then another 2 months before it was _expunged_ from my record. He couldn't get my arrest removed from Google but on _official_ pre-employment background checks, I'm good to go!
For a traffic infraction, he should have just gotten a ticket but since the cops wanted to do more and he stood up for his rights not to answer questions since he was being detained.

Are you sure? In the UK if you refuse a breath test at the roadside you are arrested, taken to the station and breath ,blood /urine samples taken. I would presume that if you are suspected of a dui but refuse the sobriety test it is the officers duty to then arrest you and have the tests done at the station, I seriously doubt they are going to have you say I am not doing the sobriety test and they just say OK then you can carry on down the road and kill someone in the accident you are going to cause, no they will arrest you. He has a right to refuse all tests go to jail and still refuse all tests. If he is innocent like this man was (at least for DUI) he can sue the officers in court and have punitive and some time monetary relief for these officers violating his 4 th amendment and any others they may have violated.

Saying hey, during this arrest, we encountered a person under deep cover, and we need to blur the part this person‘s face. The agency I was with removed the mute feature. There is legitimate reasons to mute however it’s very
Minimal and has been over used. Instead we would say Mute into the mic and if bodycam was public request IT would mute the sections. If they wanted to see what was said it would be with attorney at the agency and not get a copy. Unless the lawyer pushed the case that he needed it for whatever reason and requested the judge to force it unmuted. This is legit reason when dealing with gangs/narc. But again the mute was way over used.

Detained for running a stop sign. How many times did he tell them he doesn’t consent to any searches or seizures and was refusing to participate in or comply with any FSTs? And how many times did he tell them to write the ticket so he could be on his way? These cops conspired to violate his rights and then arrested and kidnapped him for A non-arrestable TRAFFIC offense! This is so infuriating! These cops should have to pay him civil damages out of their pensions.
Body cams shouldn't even give them the option to mute their mics when sensitive information can be redacted/censored at post processing. They were clearly conspiring, trying to get him on a bigger charge but he didn't play their game.

All traffic violations are arrestable offenses. The ticket they give you states that fact and your signature is your Bond so they don't have to take you to jail. Refuse to sign and off to jail you go. That does not apply in this case; they decided not go offer a ticket (because he was impaired) and took him to jail to protect the public.

Refusing to answer a question if he needed help getting out of the car was a good way to avoid a testimony from that officer later in court, that the arrested person asked for help to get out of the car and was stumbling and has had a lack of balance typical for a drunk person.
Answer to absolutely ANY question may, and possibly will be used against you. Cops are doing this for a living and have more experience in catching people, than almost all of the citizens.
Also, if the body cam would be "accidentally" muted, then there might be a video of you answering questions from the surveillance cams, no sound. And the judge most prob would believe a cop's word over yours.
There's no possible good reason for answering any questions at all. It can't help you in any possible way, but may hurt you. And with crooked cops that are already retaliated for not playing their game? I'd say, just invoke the fifth one time, and keep being silent after that.

Not getting a DUI by being sober... it works MOST of the time. There was that one kid who blew .00 and STILL got arrested. And is now being sued by the cops because they're butthurt that he embarrassed them.
The only DUI arrest I had I blew the 0.00. I asked the officer what 0.00 meant. He got mad and told me to blow again. I blew a 0.00 again and I said, “Hey! Look at that! It says 0.00 again. He let me go after he fumed for a while. It was in Idaho. Maybe I was wobbly in my boots walking the line. But not enough to get jailed. I won’t submit to their tests ever again.

There shouldn't even be a mute function on any camera issued to law enforcement. It should be federal law that all officers must keep their bodycam on for the full duration of any detainment of any citizen.
Not so fun fact: Axon, the top provider of body cams to agencies, purposely ship their cams without the mute function enabled. A department administrator has to configure and then enable this function for each camera. The cameras are 100% traceable and you can still locate footage recordings and force the audio feed through even if muted, albeit manually. You have to ask yourself why a department would choose to enable this function as it only leads to more scrutiny and mistrust.
Even better, leave the button there but all it does is turn off the little light and continues to record video and audio. The numbers of conspiracy and other crimes it would catch would be astronomical in the first week.

The muting has to be unavailable to them. The station can mute a video with protected information of the suspect at the time of its release. No conversations an officer has can be protected during their public duties. Hopefully, one day, a court case can garner a ruling on this abuse of power.

I was recently pulled over in rural Utah. The speed limit was 65, my cruise was set to 65, and was told I was pulled over for going 86! The officer who radared me was not the officer that pulled me over, as it was a sting operation. When my wife and I responded that we were not speeding, he immediately claimed he smelled alcohol and that we were in fact going 86 mph, claimed my big tires was why! I responded that I use a GPS that records my speed, and guess what happened next? Field sobriety test! I said you know I have proof of my speed and that he had made an error, and him pulling me over was not justified! He asked me to exit my vehicle so he could check that I was able to drive safely! I informed him that he had no probable cause to pull me over, as I was not speeding and that was an unlawful request! He then said, no shit "I don't smell alcohol now and you are free to go!
Just be careful with denial to exit your vehicle. (Pennsylvania v. Mimms) has ruled that police can order you out of the car for any reason or no reason at all.

As someone who once was a police officer, I can verify that this was a master class on how to avoid a bogus DUI. Everything in this video is accurate. I personally never submit to any field sobriety tests and I also don’t answer questions. I am respectful always… never confrontational.
Frankly, there is a case to be made here that the arrest and ultimate incarceration, no matter how short, was a violation of your civil rights. It was retaliatory in my opinion for non-compliance of the FST’s which in most states are voluntary (please check your own state’s laws).

My granddad was a cop then deputy sheriff back in the 50s . before he died he said he was disgusted with the way cops are acting , being trained like thugs. He also told us never volunteer to take any test especially a lie detector test

I'm sorry for ur loss. But the ultimate problem is....if there were good cops there'd be no bad ones. They're a dirty gang and if any member gets out of line they're dealt with. Example: did any cop seeing this video make a complaint towards all the cops that muted their audio. Did the police chef do anything when reviewing the cops body cams and seeing/hearing them mute their cams. FTP

My dad was on a department from 1963-1984, he passed in 2003.
Even in the 90s before he died he was tired of the punk attitude, entrapment, unethical, rude, etc of officers. He had a few run-ins with some of them they would threaten to arrest him or whatever and then he would drop he was on a dept for 21 years and he knows the law. They would always start stammering and backing down.
I would hang out with him and some of the guys he worked with and they would get into that topic and they were sickened / upset over how things were going in law enforcement. I'm kinda glad he didn't live long enough to see what has become of many LEOs

The officer had a pattern of removing everyone from "vehicles" immediately. This officer safety BS cannot exist after the officer has approached, conversed, turned his back, ect...without any concerns or new circumstances.
They take him out of car but don't pat him down and then say take your hands out of your pockets? WTF are your afraid for your safety or not.
Actually Mimms requires reasonable suspicion that you are armed before the pat down is legal.

That female cop was definitely surprised that he had been arrested for running a stop sign, but when the other cop explained that he didn’t wanna cooperate, and that was the real reason he was under arrest, she nodded, like she was going to keep that in the back of her mind next time, somebody didn’t want to cooperate during the traffic stop that she could just arrest them for the citation instead of giving him a citation and sending them on their way. Ridiculous.
Many traffic violations are misdemeanors. Misdemeanors are criminal offenses. A citation is issued issued in lieu of arrest and is your agreement that you will show up in court. However, you can be arrested for any crime.

But you do not receive a warning/ticket for committing an outright crime, right? Not even if it is only a minor one. Well, not unless you happen to either be filthy rich or a politician anyway. Or, I suppose, a cop. Other than that, you get arrested. Not ticketed. Just my two cents.

Officers should not be able to turn off or mute body cams the entire time they are on duty. Everything they do while one duty should be up for a review by a civilian panel.

Kudos for being calm, cool, and collected, and for being forthright in owning up to the blown stop after going back to see it again in the light of day. They (city) might want to consider making the sign more visible. They might also want to consider having cops on duty who are not tyrannical.
Should have hired a lawyer, it looked like car parked too close to intersection and reduced visibility of sign.

You are a HERO for doing this. My rights where also violated many times when I was young and more recently in a motorcycle accident. I did not get off so easy. I had to pay an attorney to get all charges dropped.
What did they do? There were no witnesses (except me) to the accident and no actual physical evidence of anything but a crashed motorcycle in the weeds beside the road. They fabricated evidence from already existing marks on the road (obviously created by a car and not a motorcycle) accused me drinking and charged me with several other offenses that would lead to large fines and loss of license.
Keep the system making money.

Plus when he was at the station, he did say he was arrested before so maybe when the cops pulled him over, they knew he as been arrested and wanted him to do a FST so that they can take him for that. Instead of just taking him in for a traffic infraction.
