Yeah, security guards can detain you. Section 494 in the criminal code dictates so. Technically it would be considered citizens arrest. But.. tbh it’s tricky because until the suspect leaves store limits it’s not considered illegal until that point
I was told you don't start reading them their rights because you could be accused of acting as if you're an LEO. Like someone already said if you don't keep sight of them the entire time in some places that will invalidate your stop. I also wouldn't say you're under arrest I'd tell them they're being detained until an LEO shows up.
Let's see. This is a terrible example of a LP video. I will list what is wrong and showing lack of knowledge. 1. The guard lost continuity of the theft. 2. You have to make physical contact. 3. You have to tell them they are under arrest not "come with me" 4. A male guard left alone with a female. You would want even a female sales associate to be present. This is a poor representation of a situation and how the training is. This is why there is a spike in lawsuits of false arrests and liability.
