    Incredible episode. It sounds like Gary was, unfortunately, the fall guy because he was the easiest to get unofficially extradited to the U.S. by booking him on a flight where he had to go through U.S. immigration. I bet that was planned. Max Louarn not being able to leave France must be a real pain for him. We often see Russian hackers go on holiday outside of Russia only to be caught and extradited to the U.S. I wonder how long he'll have to wait until it's safe for him to travel!

What a great console... iirc the first 32 bit one before the PS1 (?), way ahead of its time and badly marketed by Sega, further sealing their downfall.

    Dude, don't forget about the PS2's backwards compatibility. That was the best feature in a console ever and greatly contribute to it dominating the market.

      I wonder if this also affected the Gameboy. Nintendo consoles also gained it starting from the Wii (with GameCube compatibility, but you needed a GameCube controller because the Wii controller was totally different)

      It definitely did hell the DS was compatible with everything going all the way back to the gameboy color, that wasn't just throw in there for shits and giggles.
      Despite the wii controller being completely different the pointing/gyro function of the wiimote did a damn fine job at emulating the second stick, granted you weren't already used/habituated to the gamecube controller.

      @@yarharyar Nintendo handhelds were compatible 1 generation back. The gameboy color was compatible with the gameboy. The gameboy advance was compatible with both the gameboy and color, because they were basically the same, but the GBA had all new circuits and had a separate GBC circuit for the compatibility mode. The DS ditched the GBC compatibility circuit so it only had GBA and DS compatibility.

    of Team Xecuter the only negative thing i've to say is they broke the pirate code of ethics by selling the tool when free alternatives exist, they took advantage of people's craving for convenience and their ignorance of how to use atmosphere. Other than that I really don't have an issue with what they did. Gary did not belong in prison. Nintendo was the villian here.

      They put malware in their switch CFW to brick your switch if you tried to modify the binary.
      there CFW is close source, litterally got DRM in it, but is also built from GPL code.

      There's absolutely no such thing as "taking advantage of" people's cravings for convenience. If people want convenience, you provide it, they pay for it, willingly. It works with everything. People can make their lunch at home for significant savings, yet CHOOSE to buy it instead. If they prefer to part with their money vs doing something for themselves, it would be foolish not to capitalize on that opportunity.

      @@YerBrwnDogAteMyRabit I opt for inconvenience, education and savings too but my point was simply pirates operate by a set of ethics there's a code even among the internet warez community to not profit off of the activity unless absolutely needed to continue the work. Garys device enables pirates, whether that was his actual intention or noot is- debatable.
      Yeah, there's honor among even thieves. We operate by a set of rules and expectatons. A lot of pirates were upset with Gary for it. myself? I was like well maybe but does that mea he belongs in prison? I don't think so.

    About the GPL - it's actually locking the software down that went against the spirit of the license. Charging is fine - the license writers intentionally allowed it.

      Team executor was basically a for profit organization that sold a custom firmware, the thing is the premium version of the cfw explicitly has the feature to load game backups. Like you specifically had to pay to get that
      Also some other shitty things like the thing had code to brick your switch if you tried to modify the firmware at all

    I sub to love the Humble Bundle, but let's be honest, the devs selling their games in those bundles aren't making very much and that's the last place they tend to sell their games, especially on the Humble monthly choice. I agree it's the best place for someone broke to pick up a bunch of games though.
    On top of all of that IGN owns them and the amount of $$ they actually give to charities has been investigated and I guess there were serious inconsistencies.

      i don't agree with TX policy in the charging part, but i had no say in that matter, and even tho its been proven parts of SXOS were from open-source projects, they also were had a few firsts before open-source did, so it was not all built from other projects, alot of the open-source was sadly needed to be added to be compatible with various popular homebrew apps,. but again i had nothing to do with the overall development of these devices, sadly just the management of the web servers / forums and posting their PR's.

    I don't think that I fully understand the thrust of this video.
    Consider: At about 52:30, the presenter begins telling us that XECUTER started placing anti-piracy measures in their product.
    Is this not the same practice that the first 50 minutes complained about when Nintendo and other companies did the same? Is the video saying that adding anti-piracy measures to video gaming hardware was NOT OK when Nintendo did it, but when XECUTER did the same thing it WAS OK?
    The comparison seems exact, but perhaps I missed something important in the video. Someone, PLEASE tell me where I missed the proper explanation!

    It is actually not agaginst the spirit of the gpl to charge for FOSS. Many Projects like SLE(SUSE Linux Enterprise) charge for licences.
    People where also mad at Red Hat because they made their source code less available. Nobody had a problem with RHEL licences costing money. After all Red Hat customers also pay for services like tech support.

    Haven't liked Nintendo for decades over their hyper enforcements of any modding. They very protective of their IP. Legally rightfully so but it's just odd watching their competitors go about it different. Even things like streaming and youtube they move differently.

    Nintendo deserves to be boycotted for all of the awful things theyve done through the years. If not for this, then for how theyve been actively attacking retro ROM sites where people download classic roms for systems like the GBA, SNES etc. How do they expect regular people to obtain games for these systems? Buy overpriced cartridges on Amazon or Ebay for thousands of dollars on a single game? Then theres the fact that they never make any effort to make these older games available on newer systems. Alot of these classic games are lost to time and the only way to play them is through downloading them via roms, and they dont even want us to do that. Theyre not even losing any money when people download older roms because theyve stopped manufacturing these games *years* ago. The nintendo corporation is pure evil and they use their control of alot of beloved ips to bully anyone they think is threatening their bottom line. Pirate away 🎉✨

    I love you rhysider and am so greatful for all the great work you do, all the great research you do to provide complete breakdowns on topics you teach...but america is ghetto...we are not japan we are not the safe countrys of Europe... California is falling apart...for every market there is market research done. The walmarts, wholefoods, targets, etc...that are having to abandon ghettos because it is hurting their bottom line so bad they cant even suck up the losses anymore after years of losses. This cat on this episode knew he was taking a risk. He did his bit in prison and is a total G....but thats the risk you take. He knew the risks. He may be smart and a bad ass an gamed the system for years. But my boss always told me...dont climb a ladder you dont know how to get down. We all make our beds an we all have to lie in them. Hes not a hero... hes a gangster...a video game gangster...not some anarchist revolutionary. Without the lines of society to color outside of innovation suffers. But to have a family an a home and a healthy society we still need those lines. There are particpants on both sides of the cat and mouse game that are honorable and dishonorable...but you cant destroy society to live in a wasteland of psychotic freedom

    1. I don't know when you were in austria, so i can't judge anything for that date.
    but 2. i live in austria and they check my ticket sometimes, but also what's sad (which i personally experienced many times while traveling with the train, if for example: you go over the boarder and police comes into train to check for passports, policemen check people who's skin is black or who speak a foreign language more often

    Just listening to this on the podcast Jack, it wasnt the PS2 That killed the Dreamcast, there was an earthquake/volcano that trashed the factory producing the console. Also the graphics on the Dreamcast made the PS2 look trash (I had both), on top of which the Dreamcast memory cards were an amazing innovation and the platform was all in all a huge loss for the competitive nature of the console market. I never bought another console after it. Phantasy star online which was the first true MMO game didn't release on PS2 until long after the death of the Dreamcast the console that birthed the concept.

    If you Assume your Customer is a Criminal then everyone is a Criminal until proven otherwise.
    You're right about the added cost of security & turn styles.
    But then when most people ARE dishonest then you Must make that assumption. And lock all food/medicine behind glass to be unlocked upon purchase. In other words, everyone is treated as a Criminal.
    Civilization isn't Technology but the difference between the Animal kingdom (where ever twig snap might be instant death) or a Civil world where one could walk the streets at 2am without concern.
    Thus Tech is NOT Civilization.
    Is it Civilized? Or a Technological Barbarism?

    I just don't have anything, at least nothing newer then 10-15 years old, I no longer use windows, I've been having issues getting solar power for my house, because I don't believe in this lease model of buying stuff, I believe that if you buy something it's yours to mod as you wish, so I can't buy anything anymore, not till things I'm allowed to actually own are available...
    Which gets me really nervous over the patenting thing with genes and any human genetic material... How much of my body is Legally owned by corporations?

    I don’t agree with, but I understand Nintendo’s stance at the time, it was the 80’s right after the video game crash nearly killed the industry, and what killed the industry was a marketplace flooded with poor quality games. And they were taking a huge financial risk going overseas with the famicom. The licensing system was intended to curate Nintendo’s catalog but it went too far. That mindset became the default for game manufacturers after that

    I loved having my game genie! Used to subscribe to the gamer magazines too to get tips and tricks on how to use it better and little cheat codes and stuff to put on it. I loved it on my Nintendo 64 with GoldenEye activate things like Golden gun and things like that game genie wasn't awesome device and with friends when we all figured out codes we could get together and transfer them all so we could all have the same codes on all of our systems

    For the most part, Nintendo is an evil company. I'm actually glad I've never owned one of their systems and after hearing about the smash bros tournaments I never will. Screw Nintendo. They're a 1 trick pony anyway, all they have is Mario and that keeps getting rebooted a million different ways. They haven't really had an original idea in decades. The switch console was an absolute fluke by the R&D dept but other than that it just mario mario mario. They're a waste of time and energy to be honest

    I've heard parts of this story before but never an interview, it's even more interesting because I remember a lot of it. Getting to the crazy stuff now, thank you!
    Weird, I din't remember the PSmini. PS2 is my favorite console, still have my Gamecube too.
    Finally I get to hear the last third of this. I can't believe they treated you so poorly over practically nothing, it's not like you were trying to be a bad guy. This is so messed up! i'm so sorry all that happened, but props to France and Tanzania! Nintendo is such a mean company, shame on them! I agree with Jack, this was so wrong an unfair.

    I bought 2 copy's of Myst 3 exile at the game store at the day it was released, to give a co-worker who bragged about pirating software and music, He liked Myst at the time, and so did I, and thought it was important to support the creator. I talked to him about how we love the game, and should support what we like, Kinda making the first step to supporting the content creator, He had no concern.

    Oh man, "Warez in the 90s"... After C=64 and PC wares, I got a Multi-GameHunter to copy SNES and Genesis games onto 3.5 floppy and traded them around local bulletin board systems. Woah... Paradox (PDX) was a very well known warez group! And I forgot how much Warez couriers relied on calling cards to upload and download files by making long distance calls via modem. All that time uploading and downloading at 14.4k baud could have serious LD charges. :)

      When I got my Z/Dr. 64 to copy Nintendo 64 games onto 100mb Zip Disks, the lady at Blockbuster looked at me quizzically when I'd return the 3 games I'd rented that morning for 3 more I'd return that night, only to grab 3 more to return the following day. She either thought I was nuts or was up to no good, the latter clearly being the case.

    11:45 You make it sound like Garry is the white night in shining armor trying to open these things up. TX main goal is and was piracy and not to advance the scene in any meaningful way. otherwise they would have open sourced their code too. Speaking of open source: Atmosphere is still going strong after all these years, unchallenged by Nintendo because its legal. Modding your switch doesnt land you in jail. Working with a piracy ring that rips off their "customers" does. Nintendo is not perfect by any means and Garry is not the only one that was in TX or had relations with the guys. It is unfair (to him) that he basically had to take all the blame - BUT: with all the bullshit TX has done to the switch, the scene and every device before the switch, i am so glad that these guys are hunted down.

    The first program I made for a c64 was Jan or Feb of 1983... A hex editor. Not going into eproms and modified OSs here, but could do damn near anything even with the drive OSs... Fkn amazing. Worked great for packet radio too if you built the interface and modded the radios. DOT radios worked excellent. Damn. Wish I had the ballz to spill it all. Don't need and can't afford any financial issues at this point in life. Love listening to your episodes though. Fun times! Many deep stories.

    Hardly just a "mod"..... They pay-walled their software, and keyed it! Modding your switch it's self wont do anything to you, but making money off someone else's work and IP is kinda a bad move as it is. They kinda deserved what they got. and TeamExacute promoted Piracy, CFW and Homebrew is not about Pirating games... Just some peeps bring it there, and give the ones only using homebrew a bad rap!

    In the early days of PS1 modding you didn't even need a mod chip to play copied games on PS1. If you had an early enough model then you could 'disc swap' where you would put a legit game in, keep the CD tray open (trick the console into thinking it's closed by holding down the button, or put a cigerette filter there to hold it open), wait for the SONY security boot up, then quickly swap the legit copy for the CD copy you made on your PC of the game you just rented out, and play :)

    This is why I will never buy Nintendo's locked down Tegra Android Tablet. I will just buy a regular one that supports emulation and bit torrent, connect a Switch style controller or an Xbox one via bluetooth or USB-C, it's a much better experience and the tablet itself is useful for eBooks and offline video watching

    Well, just in case the guy who is the episode, his boat is reading this I am Canadian to and the teacher little trick. Also, for all the rest of Canadians out there. Open up your passport to the photo page go one page, pass that to the signature page . Now look down and read what it says: in foreign countries, seek out a Canadian embassy or consulate. If one cannot be found go to a British embassy or consulate, or ask for a British embassy or consulate member in Lou of the Canadian consulate. Why is this the case because we are commonwealth country. This could really save your ass. And this also works for anyone who is a citizen of a commonwealth country for example Australia, Canada New Zealand (I'm not really sure what's going on with you guys so I'm pretty sure still you're good but who knows) British Virgin Islands permit, falcon Highlands no I don't really agree with that one on the list gum sure goes on and on and on similar there's even places near Madagascar. The point is if you can't find a consulate in your country in my case and this guys case, which is Canada if you have the queen/king whenever the hell they get around to changing up the money that is on your money then I'll bet that money you can do what I just said open up but I think it's the third or fourth paid your passport to check know if they say they don't have either Canadian or British consulate they're lying and just refuse to go anywhere make a massive stink of it

    i don't mind piracy, but I HATE the ideological pirate who believes their theft is a service that benefits society and that they are the good guys with a god given right to have other peoples hard work for free.     RedHat charging money to support the use of Linux in business and making improvements is a good thing, not an example of "violating the spirit of open source licensing". It is a valuable service that improves the usefulness of linux for everybody: better software, more trained admins. The money charged allows people to support their families by teaching others about linux and improving open source software, which I don't think is as evil as you make it sound.

    Modifying hardware is not illegal. Modifying software is. It's a pretty clear distinction. In other words you can do whatever you want with the hardware, but if you touch the firmware in any way you run afoul of dozens of laws. You can put your own custom firmware, as long as it's not derivative, but you cannot modify the existing firmware.

      Yes, I started programming computers by age 10 for my own fun (Elon Musk started at that age as well), and by age 15 I had already started my business Oasis Pensive Abacutors, I went into business early mainly because my mother died just before I turned 15, so since I was already had some skills, and I had already finished high school (yes, very early as well, skipped a few grades), and was already taking courses in electronic design, and being the last kid of 3 for my father, my father was already retired by the time my mom died, so it was the most logical thing to do at the time, to start my business and support my father as well.

    I pirate a lot of various media and I have never pirated something over buying it I pirate stuff because buying isn't an option and I have bought media later only because I got to experience the media through piracy first which wouldn't have happened and I wouldn't have later bought the media otherwise
