I-Team: Liens placed on more than 90K Georgia vehicles because of school zone speeding tickets

    ATLANTA - As more and more speed cameras go up in school zones, tens of thousands of Georgia vehicles have been blocked from renewing car tag registrations because of unpaid fines, the FOX 5 I-Team has learned.
    It can make for an unwelcome birthday surprise, and another headache caused by the controversial automated cameras which clock and photograph license plates of vehicles speeding in school zones. Under the 2018 state law that legalized the ticketing systems, anyone who fails to pay can't renew their vehicle registration until they settle up.

      Speed cameras work! I actually laugh when I see speeders slowing down ahead of speed cameras of which they have become aware. You know what is very easy? Don't speed! Don't break the law! Then crybabies won't have to whine about consequences.

      I'm not shocked at all that people who intentionally make the roads less safe by violating the rules of the road, and wish to be able to get away with it, also break criminal statutes by vandalizing public property. 🤣🤣🤣

      Seriously though, i think the problem with the cameras is that the speed limits are often set inappropriately low, and it doesn’t matter until its start getting enforced. If people believed that the limits were appropriate, and that they would never be set inappropriately low just to increase camera revenues, it might be different.
      Most people are simply unaware of all the deadly shenanigans that were played with red light cameras in the USA, so they have the reaction you do, but it’s a disgusting fact that lives were endangered and likely lost when intersections were re-engineered to increase violations. After that practice got documented and the lawsuits started, the companies and jurisdictions mostly stopped dangerous alterations and turned to stripe changes and right turn on red shenanigans to pad the budgets and bottom lines.

      I don't know about in the UK but when a few people violate a law its a problem with the person but when you can prove that the average highway speed in America is between 75-85 and yet still have speed limits of 65 or even as low as 45 on multi lane interstate highways combined with the fact that more than 50% of the population disregards this inappropriate signage you no longer have a crime but rather widespread acts of civil disobedience indicating a fundamental problem with the laws themselves and a need to change them. Now school zones are special cases but generally if speed limits are set so low as to CAUSE traffic problems its no wonder people disregard them. So basically in order to make people take speed limits seriously you need to make the speed limit reasonable and base it on average speeds of a road rather than arbitrary numbers. Optimally speed limits should use digital signage that can be adjusted based on road conditions to allow for increased speeds in clear weather with low traffic.

      @@mikeloeven Your theory is flawed because the rate of enforcement against speeding violations is so low, below 1%. People aren't "civilly disobeying" because they have a deeply held opinion, backed by data, that speed limits are too low and it is perfectly safe to speed.
      The people who "civilly disobey" do so because the probability that they'll be given a ticket for any instance of speeding is far below 1%, especially if they're not speeding at least 15mph above the posted limit. In Georgia, it is written into law that local police and county sheriff/deputies using radar cannot give a ticket for speeding less than 11mph above the limit. This is the same for these autonomous camera/radar signs in school zones. That built in buffer essentially encourages drivers to speed, and shocker, a significant % do. Taken a step further, Georgia law states that a driver will not receive points on their license for speeding less than 15mph above the limit, and even then, it's only 2 points for 15-18mph over; 3 points for 19-23mph over; 4 points for 24-33mph over; and 6 points for 33mph over; a driver can receive 15 points in a 24 month period.
      All of that to say, imagine applying such degrees of permissiveness to any number of other violations/crimes, and then suggesting that because more people are doing it (because the likelihood they face consequences is low), the law should be softened. It's just nonsense. I'd buy into your theory if the rate of enforcement was nearer to 100 than 0%, fines/license points/suspensions were given out, and a majority of drivers were still choosing to speed. THEN, you'd have a point. And I think you know this too, because you highlight school zones as a special case. Why is a school zone worthy of enforcement, but the rest of the roadways not? Kids walk on sidewalks and cross streets outside of school zones too. Not to mention adults... and wildlife. People need to drive the speed limit, and if they don't, they should face consequences. Thank goodness these cameras are making speeders cry.
      45k passed away due to crashes in 2022 in the USA; 13k of these were attributed to speeding. Literally millions of injuries from crashes, hundreds upon hundreds of thousands due to speeding. It is not victimless and we who do not drive like maniacs do NOT accept the additional rate of risk brought into the equation by those who refuse to follow the rules of the road.

      And they are entirely unconstitutional. You have the constitutional right to cross examine your accuser in court. Have yet to hear a case where you challenge the ticket and they bring the camera in and it answers questions on cross examination.

      Same thing in my state, they had a contract with a company that took pictures of people's license plates if they were 10 mph over in a construction zone. They had signs up that said "Speed Limit Photo Enforced" and people would slow down when they saw the enforcement vehicle. But starting this year, they no longer put the signs up but the enforcement vehicle is in work zones still. It was at that moment that I knew it wasn't about keeping workers safe, it was about money and only money.

      Amen! I get a ton of many of my neighbors' mail, and I fail to receive a lot of mail that I should receive, including many packages. I also frequently find important mail buried in huge newspaper-type advertisements that have been stuffed into my mailbox, etc. The USPS has become a completely unreliable (at best) government welfare program, yet the rest of the government still considers the USPS as some kind of guaranteed delivery? 😂😂😂

    In Buffalo, NY the mayor did this. A citizen researched state law and determined that none of the privately - owned cameras were calibrated, and other legal issues. Th entire program was scrapped and some people received refunds.

      @@Musicdudeyoutub In L.A., I received a parking ticket when I didn't violate any parking laws - they would chalk tires, then check for the chalk two hours later. I moved my car within two hours, but since there was chalk on the side of my tire, they ticketed me.
      A friend of mine was ticketed for parking legally, apparently because the meter maid didn't read the sign correctly. Both my friend and I are lawyers, so it's not like we didn't understand the rules.
      Challenging the illegal citations is such a pain in the butt that it's not even worth it.

      @@myblacklab7 One thing in Buffalo is they have alternating sides street parking, 6-6. So at 6:01, the parking guy comes around and has tickets for days. Problem is, the judge would probably throw it out but there's no recourse without going to the courthouse

    The more states and municipalities use automated enforcement this will get worse. Most of them are leased to the city and the fines are split. Try to get that straightened out. Should be banned permanently.

      It's a civil infraction, so no officer required. Hence the reason they made it a civil infraction.
      Of course, driving without a properly-renewed tag *IS* a criminal infraction and *WILL* land you in jail, and land your car in an impound lot. But politicians can't look that far down the road -- their view is blocked by all that money coming in from the camera company.

    I got a violation warning for “speeding on a work zone” in Philadelphia after getting on a busy freeway’s on ramp but I had not seen any highway work being done, no signs, no lights, no highway construction vehicles and absolutely no construction workers on the job nor walking around anywhere. It seams the equipment monitoring people’s speed was left there on it’s own, activated taking pictures of vehicles doing the normal legal speed limit as an active “work zone” issuing work zone violations to vehicles driving by, this is a serious violation, I’d never risk any highway workers life, I could tell work had been done though as I drove past the camera, It was on the far right off of the freeway almost out of sight. I got the warning in the mail, it stated since this is my first offense, it would be only a warning but a second offense would be a fine plus points off my DL. I wanted to call someone to find out what the story is and clear my name, but I had no proof, then a week later I got another letter from the city stating it had been dismissed, to disregard it and that my drivers license was cleared of any wrongdoing. I’m glad it worked out, someone did get to the bottom of it after all. I bought a front and back 4k dashcam for my SUV and already paid for itself, it got rear ended a few months later with 5k in damages, then some young punks took a sling shot to the back window at 2:30 am and ran off. Gotta luv Philly!!! Get a dash cam folks, you’ll be glad you did.

      In photo enforcement situations, points can't be applied to one's driver's license since only the vehicle (not the driver) is identified.

      @@GeemailMailboxxTwo years ago I got a BlackVue DR900X-2CH Plus dual channel dashcam with an active LTE module which gives me 24 hours remote surveillance.. It was a bit expensive but I figured I’d give it a shot, it’s been mainly solid so far but not without some minor connectivity issues. I’m happy with it, I have it connected through two sets of portable camera batteries I rotate so I don’t use the SUV’s main battery. The front 4k Picture is crisp and detailed, the lower resolution rear HD video is not far behind in quality. I recommend this setup if you don’t mind spending that much money, BlackVue has a newer dashcam version now. I installed the setup myself so I saved a bit of money with installation. Hope this helps.

      They recently added signs that show the camera enforcement times of 1 hour before and after the whole school day. Basically don't drive in GA between 7 AM and 4:30 PM.

      I know people who tried to fight theirs and lawyers told them it was not winnable.

    Ignoring all the issues with speed cameras being run by for profit private companies for a moment......
    Sending the citations by regular mail must be an intended part of the scheme, I receive other people's mail on a pretty regular basis, sometimes it's a few houses or blocks away, sometimes it's miles away. And the frequency of receiving other people's mail has increased significantly in the last five years or so.
    I usually hand deliver it to the correct address if close, or put it back in the box with a note, but how many people simply throw it away?
    A citation with any penalties or action required by the recipient should be delivered by registered/signature required mail only.

    In my town the cameras were writing tickets for cars that were not committing to violation and hundreds of people who had been getting tickets took the city to court for their failure to have them fixed and verify their fix but because of all the problems they caused they eventually cancelled the tickets and removed the cameras.

    We got 2 tickets a day a part in a school zone where the lights were not flashing because it was Summer and school was out…but they said there’s summer school…but summer hours aren’t at 7:10 am. Regular speed limit is 45 and the ticket said 46, school zone is 35. Had we known the zone was active in the summer time at 7am with the flashing lights, we would do 35 like we always do

    I live in GA, the people in Gwinnett County voted for this BS, fell for the "safety" crap. And if you read the bill, it is not just during school hours that it will take your picture. But any time you are speeding past a camera 10MPH or more over the limit.

      I got a ticket last March in front of Central Gwinnett High School. I was in the far righthand lane going into Downtown Lawrenceville and a car was broken down turning in the righthand lane. Everyone, including me, had to pull into the lefthand lane and speed up going around the vehicle in an effort to be safe and get past it. I was clocked at 35 in a 25 and my fine was $125. Once upon a time the cop who was in his car 100 feet away doing nothing would have been right on it and traffic would be diverted in the interest of public safety, but there is no need to do that when you can make money off people who aren't out to break traffic laws. Also, there is an elementary school on Cruse Road where the signs are obscured by overgrown trees. What a joke.

    They tried this in new york and it didn't work out. They had to take all those cameras down.Or shut them off. The cameras caused major congestion. People were getting a ticket for doing one mile over the limit. It's all about making money.

      These cameras allow people to speed 10mph before issuing a ticket. In fact, Georgia as a state doesn't even allow police officers to give a ticket for a speed less than 10mph above the speed limit if they're using radar to capture it. Georgia is overwhelmingly permissive of crappy drivers and this ONE story of school zone cameras has people thinking there is a grand conspiracy. We got rid of a car in September 2020, beginning 2021 it sold at auction, think December 2021 we got a school zone ticket in the mail for a school zone near Atlanta (we live near Savannah) for that car it had a temp paper plate on it. Eyewitness testimony is notably unreliable and often needs photo/video evidence to back it up as reliable. The only problem with these signs as they are is that some of them have been mis-programmed for the times/day they are to be active, and the manual reviewers aren't doing their job in ensuring the ticket is legitimate. The camera/radar is fine.

    I worked in a green waste disposal company, we took 100's of loads a week to the local landfill. The more we could pack into the truck the more money we made. The trouble was the trucks could hold twice their legal weight load. Once a week a Highway Patrol officer would sit in the weigh station doghouse with the weigh-master and wrote over weight tickets. Usually one or two trucks would get ticketed before the word got out. Then the officer got the idea that he could just come in and review weigh tickets for every truck that came in whether be was on the scene or not. For a couple of months we got beatup pretty bad before it was determined that he had to be in the weigh shack in order to write the ticket.

    I drive for Lyft here in Georgia and will not accept any rides that I know are in a school zone in either Rockdale or Gwinette counties......Gwinette is by far the worst abuser of these systems followed closely by Rockdale

      I find that absurd. Just read the sign. Even if school is not in session. Follow the school speed limit posted but go 5 mph under. Easy. I have friends that live near these school zones and if it states 25 mph when flashing, whether it is flashing or not, they do 20 mph while everyone else behind them are honking and pissed off. However, quite amazingly, my friends don't get tickets. Is going under the speed limit so difficult for you that you need to avoid those areas all together?

There's a myriad of other possibilities at play, here. And with 12 tickets, either she's a truly horrible driver who's off the road now, or something's funky with the cameras.

When they were first installed the county got $85 a ticket. They company operated them kept on upping the cost to the point were the county was paying $15 a ticket .

    Texas outlawed both photo speeding and red-light cameras, but we still have tollway cameras. I have a TxTag transponder, but I avoid tolls, even if it takes longer to go somewhere around Houston. Several months ago, I got a bill for blowing through a toll with plates still in a rubber band on them, as I always get US Army vanity plates from the official MyPlates website. I had to call the tollway office and the agent reviewed the photo to find that someone entered an incorrect digit into the billing system. Had I ignored the invoice, I'd have accrued additional penalties and I was subject to non-renewal and even arrest. Wouldn't that have been fun? "Sorry, sir, we don't have any information on the warrant. You will have to sort that out in court. Now, please put your hands behind your back. And, we will have to impound your vehicle, as your registration is suspended."

    If I were a Georgian with a Georgia-registered vehicle and I got one of these tickets, I wouldn't ignore it but would select to go to court.
    Once it is my turn to speak, I would politely ask "was there a peace officer physically present at the time of the infraction, who witnessed the infraction, and identified the vehicle as the one in violation and myself as the driver?"
    The "state's witness" will have to answer "No."
    Then you say, "No further questions."
    Then you walk out satisfied that justice, due process, and the United States Constitution prevailed.

    Of all the places to put speed cameras, school zones seem like the most appropriate. The question now is, is everything calibrated correctly, and there's just 90,000+ people whining about getting caught, or is there an actual issue with the system? It makes me wonder because they didn't report on anything being faulty with the system itself outside of the cluster that is delivering the tickets via non-certified mail and they also didn't actually discuss the illegality (or otherwise) of any of the examples given.

    Never about safety. If it were then why do the cameras go up where there has never been a cop stationed. Our small town (Jefferson, Ga) raised 1 million dollars the first year they were active. The fines overwhelmingly are written to teens and their parents. It only tickets during drop off and pickup so the majority of tickets go to students and parents dropping off and picking up. It’s not a crime it’s civil and the school received almost none of the fines and is unable to deny the cameras being installed because the city sees free money! It’s criminal that we are allowing our local police jurisdictions to delegate traffic enforcement to private company’s in other states. These “ticketing” companies are all owned by former policemen so it’s easy to come in and convince the local law to allow them to terrorize their citizens!

    I was the chief of police in a small South GA town last year. These things are 100% for profit. The chief of any police agency has the ability to dismiss the ticket but there is no incentive when 100% of the revenue goes to the police department that oversees the camera system. It is not a deterrent as people don't even know they are "speeding". They also leave the camera on 2 hrs before and 2 hours after school zone hours to also ticket people for extra revenue. I have no idea how this is legal as it can't be challenged. If you show up in court they will dismiss it instantly but by then you have lost an entire days wages which is more than the "ticket".

    These speed cameras are total BS and a complete conflict of interest! Plus, they've frequently been found to have issued erroneous tickets during non-school hours, etc. If municipalities want to catch speeders, let cops check the speeds and confront the suspected violator(s) when the speeding happens.       The illegitimate tickets absolutely need to stop; the sign programmers need to do their jobs correctly and the manual reviewers need to do their jobs correctly. I am sorry though, these speed cameras are proving precisely why they ARE needed. Police cannot possibly issue tickets to all instances of speeding, as it is so frequent and flagrant. If an officer witnesses 3 cars speeding, they can only pull one of them over at a time, which means there is an unconstitutional unequal treatment under the law of parties. The unlucky one who gets the ticket has a legit case that they are being treated unequal under the law as compared to the two lucky speeders who got away with it. Now extrapolate this across the whole ATL metro area and you are talking about thousands of constitutional violations per day. These camera/radars are necessary and simply need to be implemented in such a way that that tickets generated are accurate 99.999% of the time. The process is there, we just need to hold the human programmers and human reviewers accountable. The revenue doesn't have to be a part of it; get rid of the fines and put points on people's licenses.

    About 3 years ago 2021 I got one of the only traffic tickets I have ever had and it was from speeding in a school zone in Snellville Georgia. I work in Snellville and I was relatively new to the area since I'm not really familiar with Snellville, and I had no idea there was a school there, and the only speed limit sign that said school zone was obscured by a tree branch so I never noticed it, and they also had a small tiny sign hanging above the street that had a camera on it, and I got nabbed for going 48 mph in a 35 school zone. That was some BS because 45 mph was the speed limit before you get to that hidden 35 mph school zone sign. They now have the tree limb removed, but that was some BS that I got hit with a $80 fine that was mailed to me by surprise. I guess I got really lucky that I did get the notice in the mail which included a snapshot picture of my car when I violated the speed zone.

    In the UK, the cameras take two pictures, half a second apart. There are short lines painted on the road surface, which will show the distance covered in that half a second. That confirms the calibration of the camera. Tickets are issued only when the speed is above a threshold, so it will be obvious that a speeding offence has occurred, with no argument about small calibration discrepancies. The speed sensors are also calibrated regularly.
    You get a notice in the mail. (Same issues here about non-delivery) That notice requires declaration of the driver at the time, and failure to disclose is an offence. The notice also includes a link to view the pictures online, so the evidence is there, if a dispute is deemed necessary.
    All the cameras are operated by the local authorities, and the offences carry licence points.

    A federal judge in California ruled that all speed cameras in the state did not meet federal or state standards for speed enforcement. That ruling in 2018 has been appealed and while it’s on appeal the cities can still issue citations. The state has been slow walking the appeal because they know that they’ll lose. The case has gone to appeal, three judge panel and en banc appeal. Next would be the Supreme Court. The cities filed the appeal too late for consideration this term, so there won’t be an answer until June 2025. They’ve lost at every level so far.

    My city got rid of them due to violating our rights. If you are not the driver you should not get punished for someone else. Also, you get the ticket prior to due process. I'm so glad we got rid of them here. Nothing but a money making scam.

Or that guy that had to pay off someone else's tickets on a new truck he just got? And a citation allows you to go to court to fight it. This system does not. Hence a violation of due process.

In this case you can be punished for someone else's violation without the possibility of proving your innocence. This is indeed a violation of your red-blooded American right of due process.

These camera systems do not allow that and forces you to possibly be punished for someone else's crime. Total violation of due process.

    It is not always obvious when the speed cameras are recording. Some school zone cameras enforce the flashing and non flashing speed limits during the school day. I got a ticket at 12:30pm in South Fulton based on the regular speed limit. Most people are hyper-vigilant when school starts and ends and do not speed through the area. However, when school is in session during the day you don’t think about being in a school zone or the camera. They might as well let the lights flash all during the school day and enforce the speed instead of being deceptive.

    we used to have speed cameras in my city, but because of something to do with the law that i can't remember off the top of my head, the state supreme court said the cameras were legal but a police officer had to be present.

    my state outlawed traffic cameras loke some area had a redlight camera but due to how easily a license plate can be faked and they cant actually prove whos behind the wheel they had no other choice but to outlaw them some areas still have a red light camera set up but its not active

    The fact that none of the agencies involved can provide any proof of the ticket existing other than a computer saying that there is an active fine that was mailed out at some point, yet expect the people to pay the ticket fines, is outright criminal. If a cop writes you a ticket and he has you on speed radar and dash cam you can contest the ticket in court. Yet the city is saying that there is no way to contest an automated system ticket in court cause there is no evidence of the ticket and no person to contest, they just want you to shell out the money to them. This isn't about safety, this is clearly about profit.

      How does this deter you from speeding when:
      1) The signs and lights are so inconspicuous that you don't see them.
      2) You don't even know an infraction occurred until weeks later when you get the "ticket" in the mail.

    In Albany people were ticketed in school zones when the school zone speed limit wasn’t even in effect. My uncle was ticketed for driving thirty five in a school zone on a Saturday. The point is that the system is flawed because it tickets people when it shouldn’t be doing so.

    Look at the speeds on some of the tickets. 56 and 53 in a 25/35 zone by Mr. Jeremy Michael Brown at 1:55. This dude blazes through town in his Dodge without a care and cries about it being a "gimick" and a "snipet" despite two different times. His tickets don't say anything about school zones.

    I live in the state of Colorado. I don't think we have speed cameras for school zones but we do have red light cameras. I've had to deal with them personally and I've had to pay one but I did receive the uncertified mail and paid it at that rate which by the time they paid the process server and all the other fees. The city actually lost money on the ticket, but in the state of Colorado they cannot hold you accountable for the infraction unless they do one of three things either. Have a police officer come serve you with the ticket in person? Send it to you via certified mail to be able to confirm that you actually got the ticket or send a process server to serve you in person with it. And according to the lawyer, I talked to out of the tens of thousands a year that are issued in that particular City and the thousands of ones that go unpaid. There's literally a handful that they choose to process serve every year when they send it to us, they are legally required to offer us a court date to go and fight the ticket as well as they only have 90 days to serve you the ticket from the time that the infraction happened. Otherwise in the state of Colorado, the statute of limitations runs out and it is no longer a valid ticket and in the state of Colorado it is only a civil penalty. You just pay a fine and that is it. It does not show up on your motor vehicle record.

    If you cannot follow the rules of the road, such as driving the speed limit, you are admitting you deserve to have your driver's license suspended for life. It's super easy to drive the speed limit.

      @@dannydaw59 Firstly, the proportion of speeding tickets generated by a driver who's stolen the car, versus the tickets generated by the owner of the car, is tiny. Secondly, if one's car is stolen, one tends to know about it, and reports it stolen. Obviously, one is not responsible to pay a ticket that was generated on their vehicle when it was being driven by a car thief. It is written into the statute GA Code § 40-14-18 that if the car owner argues that they were not the driver of the vehicle, they may;
      A: Testifies under oath in open court or submits to the court a sworn notarized statement that he or she was not the operator of the vehicle at the time of the alleged violation;
      B: Presents to the court a certified copy of a police report showing that the vehicle had been reported to the police as stolen prior to the time of the alleged violation.
