    The only time I was flagged for a scanner at the airport the constable complimented my scanner and told me the tower frequency ( Icom R-5 ). The guy who reported on me gave me a dirty look.

    I don't see a problem. If it's out there. Then we will listen to it. Legality doesn't come into it. It's just people having fun listening to the selected scanner frequencys.

    In the USA any frequency transmitted is open for public consumption. When I was learning to fly, I bought a scanner and programmed all the air traffic channels on it to learn how to understand the lingo. I also use my other scanners to update me on traffic issues, crime and local emergencies.

      No. Mobile phones, encrypted traffic and I believe cordless phones and microphones are not allowed to be listened in on.

      @@NiceMuslimLady Both are encrypted and are subject to other laws concerning encrypted messages. Many police departments in the US now hide their transmissions by using trunking radios. They change frequency rapidly making it impossible to follow unless you have a properly programmed trunking radio with their codes. Still not illegal, just very difficult and expensive.

      @@parajerry Not all cordless phones are encrypted, at least not the older ones. Police departments are trying to hide their transmissions in other ways, such as actual encryption. I remember there was one before the encryption started and before trunk trackers that every transmission was on a different frequency...PLUS, the carrier wouldn't drop immediately after a transmission. It would continue and make four beeps to try to make it more difficult for scanners to follow, in addition to switching frequencies.

    Thanks to my "airband radio" (AOR8000 and discone) in the 90s, I became a cop for 14 years and now I'm an airline pilot. I thank the radio for both these careers! 👌🚔✈

    In the USA, laws like this are used for "selective enforcement". If the police want to search or arrest you, they have a legal reason by using a law nobody follows.

      I wonder if that practice could be challenged in court by citing the US Communications Act of 1934. It clearly states: "The Airwaves are part of the Public Domain". This is in the Study Manual for the US Novice Class Amateur Radio License.

    There was case here in Australia some years ago under the old wireless act. A person was charged with “intercepting” wireless communication. The court struck out the charge when the defendant showed that in no way had interception occurred, as the communication was successfully received. The must have accepted that the meaning of intercept in the act was to prevent reception. The new radiocommunications act was much better set out in that respect. I have several older scanners that are capable of air band reception and listening to radiocommunications is usually not illegal these days. I was surprised to see air comms on 134-136 mhz. Isn’t that supposed to be out of bounds to protect radio telescopes? Also in Australia, in older times, the analogue channel 5a had its vision carrier on 136.250 (sound 143.750). This meant using 2M in locations that had a 5a TV channel was likely to be problematic.

      Fortunately they changed it in Australia so it is not illegal to listen to unencrypted comms, it is only illegal to act on any information received.

    As an air traffic controller, my stand on this is we really don't mind anyone listening, or I don't anyway. I monitor my own frequency off duty, as well as Mil Airband. I've used my scanner outside in the street, in front of Police on several occasions and not a word was said despite it being active with simulated air combat at the time.

    I am a licenced Amateur Radio Operator here in Australia. My hand held dual band transceiver, & mobile dual band in the car have air band receive capability. I sometimes listen in, especially when one of the rescue helicopters is in the area.

    Great video Lewis. 30 years ago when I was going through the security at Jersey C.I. airport, I got stopped for having a scanner. All they did was ask me to power the radio on and off! ... I don't know why they asked me to do this. Anyway all was okay and they let me through. :)
    I think that discretion is needed when listening to a radio, in the same way you wouldn't watch a horror movie in public! :)
    Now going to put some AA's in my IC-R6 and have a listen! :)

      @@IanDarley but if you knew you had to turn on the device , it's not hard to stuff it with contraband or worse and still have the ability to turn it on. There's got to be another reason. Maybe to observe body language as you handle the device ?

      ICOM R-6 is great size, and with a Moldol stub antenna. Have owned the R-2, R-5 and R-6, great radios.

      Yeah that was a thing after the terrorist attacks and so on was updated with air travel travel frequently but never really had to deal with that portion but other parts yes even though I travel before a lot of electronics I never once in power anything on but everything was charged and or had batteries at just in case

    Hey, I'm currently training to be a general aviation pilot, the communications and air law exams are the first you have to pass to be allowed to solo fly, which is a requirement, so I have read through the communications theory book, and I'm certain nothing says its illegal to listen in, it does say its illegal to interfere, but that would be making malicious transmissions, not reception
    Also, the book says the best way to learn how to talk to air traffic control is to listen to air traffic control and pilot chatter on the radio, it doesn't say how, but nobody in their right mind would hire a plane at the going rate just to sit in it listening to the radio, and i think until you pass your communications exam, it would be deemed illegal to have a transmitting device without a licence, which leaves one option, a scanner
    So the theory book, in a round-about way tells you to buy a scanner and listen to air traffic control to practice, even write communications down as if YOU were the pilot being given the instructions, now if I'm not mistaken, transcripts are a form of recording?

    I was chatting with the pilots in the cockpit of our holiday flight and said i was licened ham, intested in the radios on board this plane they showed me the regular vhf ones for ground control or ATC, but also the separate bank of radios they used for long dustance comms on hf . I asked if i could photograph them so i could listen out on the frequencies, they said "sure go right ahead" so i did

    When in the UK, tread lightly as it seems everything is illegal. Here in th US, it is NOT against the law to use a scanner, except in two states that I have heard of, New Jersey and Kentucky, and that is only mobile if I remember right. Everywhere else is OK, as long as you don NOT chase any thing down after hearing it on a scanner, and as long as you don't use it while committing a crime. As a trucker in the US, I did have my Ham license, but in addition to the ham radio, I had a scanner in the truck. Never had a problem until I got to NJ POE where a NJ DOT officer came out to my truck and heard NJ state disp on my radio. He proceeded to try to "take" my radio, without asking if I had a license to operate the radio. This guy is no longer employed by NJ.
    The UK is requiring a license just to have an aerial on your house, if you do NOT have a license, you will have the antenna police knocking on your door to give you a fine and probably remove your antenna. I find this absurd. If it is being broadcast, people should be able to pick it up without issue from any entity!!

      I think you're conflating two things. In the UK, you're supposed to have a licence to watch broadcast TV. This ususally includes, but not always, an external antenna (which doesn't form part of the licence anyway). The other thing is that in some areas, most planning authorities like to throw their petty weight around and can make life difficult for hams that haven't applied for planning permission for an external antenna (which are often far larger than domestic TV antennas. If it gets up their nose, they can order the removal or reduction of the offending mast or pole.

      You can own any radio equipment you want in the UK, any type for any frequencies its the use that is sometimes licensed. In the US you can only buy and sell type approved radios with certain frequencies locked. Land of the free? 🎉😂

    I got stopped by the police at East Midlands a few months back. I was operating HF mobile but also keeping tabs on the tower on a handheld. The ops van came round checking the perimeter fence and they thought my red led head torch was a laser so called the cops on me. I explained to them I was on a HF contest and listening to the tower just be aware what was going on and they had no problems so long as I wasn't recording it. It's actually covered under interception but I think they know people listen and no one has ever been prosecuted for listening as far as I'm aware but passing that information on to a third party is a different matter. That said you did exactly that in this video and Noel Phillips runs an aviation channel and put atc communications in his videos all the time. If the police wanted to be arsey they could give you be a hard time but I very much doubt anything serious would happen even if it went to court

      @@nativetexan9776 it was at night and I needed light to see what I was doing. Using red light uses less power so my batteries last longer also it doesn't ruin your eyes ability to see in the dark so much. It's just enough light to see the text on the buttons on my radio and to see my log

    I've still got my Jupiteru 125 scanner which I bought in the 90's when I lived near Glasgow Airport. I can remember hearing the Speedbird Concorde callsign on a few occasions when BA put Concorde on the London Shuttle route, then running into the garden to watch her turning over my house at under 2000 ft on finals. I used to log anything unusual and one in particular a Japan Airlines flying the Polar route. The good old days!
    Living in Mid Wales now and you could fall asleep waiting for any comms! Will need to get myself over to Manchester viewing park. 747s were very common last time I was there!

    I have an air band j-pole on top of my garage here in Nashville TN USA and live right off the end of one of the runways at BNA. I pick up ground, tower, approach and departure clearly.
    I do not see any harm in listening. Just don’t transmit.

    Try this. If every you are brought before the dock, ask the judge by what right the government claims they own the air or the frequencies they travel through it? He will most likely spout a line of law and regulations they give the crown the right. Then ask him where is the paperwork for the the bill of sale when and where the air was purchased by the crown. No sense looking because there is no such paperwork. So if they can't prove ownership or well. This would be a interesting case for some legal students to hold a mock court to see how it would go.

    Things are a bit different on this side of the pond. I'm in Canada, have had my amateur radio license for almost a half century and live near the busiest airport in Canada. As far as I know, there are no restrictions on listening to anything, but you're not allowed to divulge what you hear, with the usual exceptions of broadcasts, amateur radio etc.. What's really dumb is a law south of the border, in the U.S.. There, scanners are not allowed to receive the 850 MHz cell phone band. This dates back to the days of analog cell phones, which were easy to intercept with a scanner. So, for privacy reasons, scanners were not allowed to receive that band. Due to proximity to the U.S. and shared markets, this also affected equipment coming into Canada. However, the reason for that law disappeared with digital phones, which are a lot harder to receive and especially with Voice over LTE, which is encrypted with IPSec. Regardless that law still exists and applies only to that one band, even though the cell phone service has expanded to several other bands. Also, analog cell phones became unusable many years ago, when analog service was discontinued.

    Discretion is the key, don't sit there with the radio blasting, use earphones. In today's climate why put yourself in the spotlight? Just as a footnote my local airfield plays the control tower audio over a pa system.

      My ICOM R-5 is shirt pocket size, doesn't attract unwanted attention. And use a stub antenna, such as a Moldol.

      Ay airshows or end of runway and airport, including military we tend to blast it out no issues, sat end of Farnborough with 6 scanner 2 weeks ago on both air and griubd fm even had the pm escorts on the event dmr net

    I didn't know it was illegal to listen to anything, what makes it illegal is if you act on it. Listening to the ATIS can be useful and as you say having a licence cannot possibly be illegal.

    I've been using the Radtel 490 and Wouxun UV9K for err *not* listening to airband quite a bit. Nice to hear lots going on especially between the tower&ground as well as being able to scan other frequencies too (I imagine). Thanks for clearing up the legalities LOL 🙄

    It's only illegal to transmit not to receive but this also depends on which country you are in . Australian Police frequencies are encrypted so they won't work and would be a bit of a waste of time an money, but ATC is allowed here .

    It strikes me that if there is a law prohibiting us listening to Air band traffic, it's virtually unenforceable. The arresting officer would have to catch you in the act, and have witnesses. Disseminating info gained is another matter.

    Here in America, if you have a legal receiver, we are legally allowed to listen to any transmission except for cellular telephone... which is the last thing I'd be interested in !

      I believe that only applies to the 850 MHz band and since analog phones are long gone, it's hard to intercept the calls. With VoLTE, the calls are also encrypted, so it would be d*mn near impossible to hear the conversation.

      What I meant is that the aproach is:
      If it's on the clear, it's ok for you to listen to. If it is scrambled (even with simple voice inversion) is off limits for the general public.
      That's a good simple rule.👍

    Back in the day it was illegal to record radio programs too if the broadcast contained copyrighted material (like recorded music), but I don't think anyone was ever prosecuted for it (unlike for filesharing).

      As far as recording onto audio tapes I don't think anyone was prosecuted.... But in the early 2000 when things stated to go digital I believe their were a number of prosecutions for using Napster!

    I have been interested in listening on scanners for many years to the point it got into amateur radio and I got my ham license. I started with a shortwave radio and found many interesting frequencies in my teens. My dad said that in the early days, you could even pick up the police on one end of the AM radio band. Now, I can't even listen to my own cities police as the have gone digital and soon to be followed by fire and ambulance. I am sure if you want to spend the money, you could by equipment to receive them.
    It has always been my belief (in the US of A) that the Federal Communication Act of 1934 gave free access to the airwaves as far as listening. If you put it in the air, you must expect folks will listen. That being said, it is illegal to use that information for profit or to break the law. In other words, if you use a scanner to avoid police while committing a crime, that would be illegal. If you use two way radio in committing a crime, I think that would escalate the crime to being a Federal offence.
    In the days of old, bars and taverns would use the satellite analog transmission of sports games as entertainment and to help bring in customers. Once again, if you put it in the air, folks will listen. But now it was being used for business and PROFIT and they were ordered to stop.
    And don't get me started on states that band car radar detectors.

      Many newer Yaesu models have airband receive. My FT-991 has, my FTM-10E has. Conversely my Yaesu/Vertex VXA-700 does transmit/receive on both airband and 2m.

    I can Rx Manchester Tower on UHF 455MHz from MCC on the UV5-R, which I was quite surprised at. I have a dedicated VHF Airband Scanner with the Diamond X50.

    It's laughable to tell people not to listen to plain speech transmitted over the air. It's practically the same thing as talking very loudly in a restaurant and threatening to arrest anybody who listens to your conversation.

    I just got one of those little Chinese radios with AM Airband on it and I can just about make out what I think are the plains.... Why can't I hear the tower? Or should I be able to hear it on another frequency? Like the upload and download frequency's? I'd love to know more about the radios and antennas they use.... And how many watts of power each use....

      Today there are few air band radios, mostly clunky scanners and a few widebands, such as the ICOM R-6. There is moderately priced radio with 66-174 mhz, though I wouldn't recommend it. I use an ICOM R-6 and several miscellaneous stub and ducky antennas.

      They used to sell cheap radios at Maplin that included airband and TV band IIRC. I nearly got one back in the day

      We sold them at airshows as well and broadcast via larger speakers, and out a freq list up on sales unit

    Found this quite interesting as I have wondered about some recent debate on legality of listening to airband and other wireless telegraphy. Many years ago, I remember having to learn various parts of the WT Act. Looking at the current act:
    48 Interception and disclosure of messages
    (1) A person commits an offence if, otherwise than under the authority of a
    designated person-
    (a) he uses wireless telegraphy apparatus with intent to obtain information
    as to the contents, sender or addressee of a message (whether sent by
    means of wireless telegraphy or not) of which neither he nor a person
    on whose behalf he is acting is an intended recipient, or
    (b) he discloses information as to the contents, sender or addressee of such
    a message.
    This corresponds to what I remember the previous revision said. The idea was that, if you accidentally heard transmissions that were not intended for you this was OK, so long as you did not divulge the contents. So, if you are using your scanner to listen for transmissions intended for you or for general reception and accidentally hear transmissions from ATC or aircraft. So long as you don’t divulge the contents to any unauthorised person, it would seem to comply with the Act?

    My understanding of the law is that you can only legally listen to a radio broadcast that is directed at you, a public broadcast for public reception or on a frequency that you hold a licence for. thus, any pilot with a valid RT licence is licenced to listen to civil airband. I carry my transciever in my car and was once questioned about it by a desperate Police officer. Hilariously, she went all the way down the route of telling me she was reporting me for listening to a radio broadcast I was not licensed to receive (she hadn't even asked the question, lol.) She wanted to confiscate the equipment! She was quite embarrassed, when, after she had made numerous notes and talked on her radio, I happened to pull out my flying bag, in order to give her all of the equipment she was trying to confiscate. Obviously, I put my licences - PPL / RT on the seat in front of her, whilst delving for the transciever charger. She was well pissed "why didn't you tell me" - "because you didn't ask! It's not my job to do your investigation", lol.

    Its a really country specific question, in Germany for instance the law simply states that you are not authorized to listen to any transmission that isn't meant for you - that covers it all really. If that is ever enforced however - that's a different question.

      It's pretty much exactly the same in the UK.
      That being said it's absolutely not enforced unless you act on any information received to the detriment of any of the intended recipients.
      Specifically with airband you can listen all you like, but if you hear any details of an emergency in progress inbound you should keep stum about it so as not to panic anyone else at the airport who may have family on the plane in question

    Very handy to know. I recently bought a Retevis RT 85 dual-bander and while it can pick up the FM broadcast band (which is useful), there's no airband (after watching this, I tried, but it's not there). So, off to Ali-x and I see the SenHaix 8600 is available for €53. That will be winging its way to me next.
    The performance of the SH8600 on your other vid is impressive, just wondering what the range might be with the Retevis. If either of them are good enough for mobile / portable use, I might not bother putting a proper mobile set on the bike.

    I have a GRE PSR-216 scanner, does anyone know where to get an AC adapter for it? I read in the manual that it has to be reversed polarity?

      If you need something like that since her negative and still sin are positive they make an inversion adapter cable indoor adapter but if you have the proper plug but wrong polarity and are good one soldering iron and can easily do this and heat shrink tubing and so on either do that or make a short extension that just reverses polarity have a few of these for specific applications with AC adapters where need be

    Thing is, how can they detect if someone is listening to airband or police using a scanner, if you have a scanner that is known not to transmit anything back and unless you are only listening via headphones and you never bring your scanner out in any public place, you don’t use outdoor antennas and you don’t talk about your use of such devices to anyone? It would have to be an especially paranoid local council landlord and local police that regularly carries out weekly property inspections and police searches on foot of tip-offs for “illegal activity” that would discover a scanner

    Licences are a commercial agreement and required for commercial practices. There's no Lawful requirement nor Lawful jurisdiction to stop any non commercial activity.

    As a GA pilot I find it ridiculous that airband should be illegal to listen to. These are such short, boring and repetitive exchanges that people should be payed to listen to airband, to compensate them for the inflicted boredom. In fact, they should be payed more than babysitters! Especially if they listen WHILE babysitting. Moreover, they should receive short cheering messages from the local tower encouraging them and providing then with weather updates for their ride back home… 😀😝

    I have a netset pro 44 that I brought from Tandy's many years ago, I use to be a medic for the st john ambulance and was able to monitor the st john frequencies whilst on duty so I know what was happening and If I was needed. a couple of other members had one too and we was given permission by the division superintendent to listen regardless of being on duty or not! The only transceivers was allowed was one the super had all the time and the ambulances!

      @@h4rry815 Hi PC-01 I m going back 35 years now and I can not remember, but no doubt they may have changed their frequencies to the 900Mhz encrypted tx/Rx (the same as the police)

    Realistic Pro 32 was my first scanner. Those 'Black Box' devices are great for listening onboard a plane as they are simply a tuned audio amplifier NOT a radio - just keep the volume down on your headset , or the flight attendant will hover around where you are sat 🥴

      Pretty much right not a radio since no local oscillator matter of fact things like that or toilet has been allowed on airlines because of this and some were even quoted as not interfering with aircraft systems because of this and other things which makes sense one reason why you're not allowed to have a radio receiver is it like an FM radio on board an aircraft is because the issue of the local oscillator or at least that's what I've been told

    does the senhaix have squelch on airband or does it just have static between transmissions? I got a radio on ebay about 15 years ago that picked up airband and it got thrown out - huge regret. If this does just have static between transmissions is there another affordable airband scanner you’d recommend?

    Lewis....any idea what the UV-83 is like on airband....seems to bee a new radio from Beofang and they list it as having am airband...but is it am.....seen no reviews on youtube yet.

    Here in the US you will not get on a Mil Base Airshow with a scanner....... unless you are a teenage girl wearing a tube top.

      Really that's crazy despite law in uk you can sit there a scan with it boasting out, no earpiece needed I even connect up to a larger speaker at airshows and airfields, use to sell scanners at the airshows as well where we put the freqs up on a board and played coms via 10 differant scanners, yes illegal, but blind eye turned

    The ambiguity is basically caused by people simplifying the wording of the Wireless Telegraphy Act, and presenting conclusions - even OFCOM do this themselves. Most of the sensible folklore comes, I think from the two types of transmission mentioned in the Act. Broadcasting, and non-Broadcasting. One with the intention of one-way communication to the masses, and the other two-way communications between specific parties. The other bit that generates the conclusions and comments is the section where it talks about licences being available, or not. My reading of this was that if you could apply for a licence for a band, then it was considered open. Even if you don't really qualify. You could apply for an aviation radio licence, so civilian airband is OK. You cannot apply for a licence for military airband - so my view would be that while we listen, we should not. Clearly it is not broadcacting, and you cannot get a licence - so while no action is the normal response, it's not legit - just not prosecuted. Most of the 'rules' we use stem from these basic features and of course keeping accidental reception info secret is in there too.
