The Supreme Court needs to have term limits. For real
Term limit of 8 years. If they are overtly aligned to a political party, they. Should not be nominated to serve on the court. Typical examples of people who should not be on any court are Cannon, Thomas, and Altto. These people are legislating from the bench. They are not independent arbiters. It is so obvious they are advocating for their preferred litigants.

Strange that a juror can be dismissed for showing even the slightest bias against the defendant, but a judge who was actually appointed by the defendant can decide on the law the defendant is judged by....

In wartimes as Ari mentioned. But the problem with that is they established that FDR’s interment of Japanese Americans was ruled illegal eventually. So, they used an argument that would be able to be appealed if the cases are dismissed before they go to trial. They will likely send it back to Florida and let Cannon dismiss that case, which she will do if she knows Trump will be convicted.

Although that isn't the question that SCOTUS should be asking. Their job isn't to decide policy, their job is to interpret the constitution and other laws. The constitution says nothing about Presidential immunity, that doesn't mean the founders didn't have an opinion or didn't think to put it in, they had just fought a war to get away from having King, it was the very essence of the constitution that all should be equal before the law.

Not having immunity would increase their chances of staging a coup at the end of their term so that they can avoid accountability for crimes they committed while in office. For example, say they attempted a coup, then not getting immunity for the coup attempt would increase the odds for a President to attempt a coup, not withstanding the fact that he would have already attempted a coup. Talk about a circular and tautological argument. SC Chief Justice talked about a tautological argument today, yet seems oblivious to (or just willfully chooses to ignore) Alito's tautological argument.

Most of us sane people are, because the autocratic sickness is evident. This should NOT involve politics, and it should NOT be transactional as it appears to be. No previous president has needed immunity and no president should have it. Mr. Trump is a convicted criminal who became president. If there are restrictions, it should be upon the person running. Trump isn't qualified to flip burgers in a mall according to the questions put to supervisors at the mall. How then can he possibly be qualified to be president? He isn't, and his presidency clearly showed he was not. A leader has to be able to delegate. Trump claimed l alone can fix it. He couldn't and didn't. We do NOT need a repeat.

If a president has total immunity, is it not a small step of (tortured) legal reasoning from there to the court concluding that anyone following the president's specific instructions also has immunity for their actions? Even the hierarchical and authoritative military does not absolve a soldier from the responsibility to refuse an illegal order.

I listened to the entire case and i was infuriated by the way it went. Justices Alito, Thomas, Kavanaugh, Roberts & Gorsich didnt want to go over the facts of the case. Instead their questioning sounded like they were going to create a new law. WTH? The justices have one job, to make a ruling based on the facts of the case. Our government doesnt do their job any more. I am so scared about the direction our country is headed. God help us.

Alito in particular seemed oblivious during the hearing. And Thomas should have recused himself. He and his wife should be in prison.
Alito's speculation about needing presidential immunity in order to assure the peaceful transition of power was appalling. Before Trump, forty-four presidents had no problem leaving office when their terms were complete.

Here is my idea for a supreme court justice ethics committee: There should be a lottery established for retired Federal judges, where they could submit their names if interested to be part of a committee should one be needed. The names would be forever changing and only pulled from a hat when needed, thus making it harder to contaminate the pool.
