the absence of 58 MPs from the National Assembly won't prevent
parliament from proceeding with its duties when it meets in two weeks'
time. The duties include the election of the speaker and the
president.
She was reacting to MK Party leader Jacob Zuma's threat that the party
may boycott parliament when it resumes.

350 is the necessary quorum for the national assembly(parliament act 46(1)), without the MK the number only makes 342. What is she talking about?

At the end of the day it will be based on interpretation, the way I read it is that its not a National Assembly if its less than 350. I will actual implore MK to abstain it is time our constitution is test and reviewed. Most People in SA are told and except that our Constitution is good, yet have actually never tested its implementation and its time it is to see how good it is and whether it needs to be amended, which I think it does. You forget that laws are created by people based on convening and agreeing what is wrong or right or fair for the betterment of society. It doesn't fall from the sky. At some point slavery, apartheid and women not voting was seen as right but were change when due to being tested and being found wanting.

I think the rule is very clear with numbers. It's says they should not be less than 350 and not more than 400. So, they will not form a quorum if 58 seats boycott, unless if that rules are ignored because even constitution of SA is ignored lately. They will be 292 and below stipulated rules. That will be a stalemate and thus call for rerun of elections.

Exactly what is written. Parliament act 64(1) talks about this exactly, if it's less than 350 its not a quorum.

What the law says about the national assembly qouram? The professor says the quarom for electing the president t is 1/3. This appears to be the law. But, where is the law.
