Pay close attention to when he speaks about your credit effecting your Housing, Employment and Insurance. Your credit could be effecting wether you work an office job and rent a home in a nice neighborhood or working a bad job and living in a place that leaks etc etc. In the past I've been denied really good simple jobs due to my credit history so ya it's legal 😐

I'm 99% sure you would have to file for bankruptcy together or not at all (in most countries, at least). Yes, you'll most likely have to show your taxes as well as a whole bunch of documents for all your other debts. They'll go through your life with a fine-tooth comb before they let you of Scott-free of all your debts.
Yes. You can file separately without your spouse. They will consider your spouse's income to determine which type of bk you are able to file. But, if your loans or credit cards are in your name only, not joint accounts, the bk won't go against his credit, but yours only, if you file by yourself. You are able to claim more expenses and double your exemptions if you file jointly. It also depends on what state you live in and what their exemptions are. You can choose to go by the federal exemptions, or your state's exemptions, which ever you decide will most benefit your situation. Google bk in your state, and you'll find many informative websites. Most bk attorneys offer a free 1 hour initial consultation to determine what your options are, and you may want to talk with several before you make your decisions. Bankruptcy is not for everyone, but a qualified bk lawyer can advise you if it's the right decision for you.

I did chapter 7 the judge will decide on a case by case basis but I kept both of mine. Also they stopped sending me monthly bills because they can't because of the bk 7 so I had to mail a check.
Secured debt like cars and houses won’t be discharged but you can reaffirm on them and keep them. Filing chapter 7 is for getting rid of unsecured debt like credit cards and medical bills that destroy your budget. With the savings you get by getting rid of unsecured debts, it’s much easier to pay for houses and cars. The best thing to do is put the money you no longer have to pay on credit cards, etc. in savings and build an emergency fund. Inevitably, you will have an unexpected major expense such as a car repair or something for your home such as a furnace, air conditioner, water heater, etc. and the emergency fund will save you every time.

Student loans are generally not dischargeable in a Chapter 7 Bankruptcy. There are some narrow exceptions to this rule. Chapter 13 Plans can be used to defer student loan debt but not to eliminate them. Feel free to contact me to discuss your options.

That's a good question. My opinion is that it is better to wait until AFTER your bankruptcy is over to get a secured credit card. It is an important part of a system designed to help rebuild your credit.
They will turn off any credit cards when you file bankruptcy. But you can get cc again 6 months and up later. And better cards cuz you won't have debt. BUT BUT BUT do not get a cc if you can not school yourself to use only 10% of the limit or less and do not get one if you can not pay the balance 100% the day after the statement posts. If you can stick with 10% of the limit or less a month and pay 100% of the bill the day after statement posts OR as soon as your next paycheck comes, your score will blast off high, FAST.

Maria - 10K is not alot and it depends on the means test in order for you to apply for BK. You need to talk to an atty.

If you can stick with 10% of the limit or less a month and pay 100% of the bill the day after statement posts OR as soon as your next paycheck comes, your score will blast off high, FAST.

They force us to live in a society to build better credit. Credit is king. Without it you can't get a place to live. So you have to be in rotationary debt, but it has to be under your means. All of our economy is based upon real estate so you know the system is about to fail.

I usually pay cash for stuff I buy. however i have quite a bit of debt due to my low income, how is that viewed when applying for a credit card. My credit score is constantly on a roller coaster and now severely suffering because my cousin has not been paying her monthly note as expected and myself has been skipping few bills. I applied for an American Express card, the application was denied. Though I had one many years ago, and I used it to pay my minor expenses on time. This is the second time that I get denied.
