The Legal aspect of the chartered accountancy work is too complicated for just Lawyers to handle especially when it comes to taxation. Lawyers stand the risk of giving in accurate advise when it comes tax laws and other business related laws. Let balance the two field in this argument.
Eagle Search News the legal aspect of any field is easy for a Lawyer lawyers since are legal experts, they tend to give better information about the particular case, rather than a charted accountant who has nothing to do with Law
@Captain World dude there are CA's who earns more than a advocate and Vice Versa... comparing top Advocates with Average CA's is not fair... CA's do study Taxation Laws, Corporate Laws, etc... indepth as that of a advocate... CA's is not allowed to practice law in court and FYI tax lawyers also provides services as that of a CA...
As far as I know Chartered Accountants are eligible and qualified for making legal advices as said by pankaj Jain , they are taken exams relating to diffrent fields of laws, taxation laws and highly exposed to practical field undergoing articleship training. so they are perfect blend of practical and theoritical knowledge.
Whatever the CA firms are serving to it's clients ....these all are within the scope defined by the respective statute of the country....& If clients are more comfortable with ca's than lawyers in some specific issues then there is no base of that allegation.!!!
Mr. Bhasin is completely right because as per Advocate Act, 1961 only an advocate can do the practice of law, like wise chartered accountant Act, 1949. We should respect every professions. As per law if some one has two professional degree LLB and CA both, in that case also person can not do practice both the professions simultaneously that means both the professions has there own identity and importance. Kindly don’t comments on any profession without the proper knowledge of law.
As per ICAI a CA can provide legal services and can appear in front of tribunal... ICAI also allows a person who is both CA and LLB to practice law in court... the only condition ICAI has is that one shouldn't prefix Advocate while providing CA services and Vice Versa... but as per BCI a person with CA and LLB can't practice law in court... No CA's does it... being an expert in some laws a CA provides services such as IPR, Corporate law, etc... Even Tax lawyers are providing ITR services to their clients...
lawyers don't know tax. if lawyers doing tax mean they do accountants work. by the way I'm a both llb and CA finalist and have understanding in both. I'm sure CA would have 5 times better understanding on tax and same understanding in contract drafting of lawyer. when u r a company accountant why u hire lawyer to draft small contract it's 5 minutes work for accountant.
Chartered Accountants are way more knowledgable than lawyers. CA's have a right to advise and offer other legal services. It's within the ambit of law.
I believe lawyers have all right to appear before courts. But as far as legal advice is concerned, I think it's sole discretion of person obtaining the advice from he wants.
Mr. Bhasin is right somehow as every profession should have confined somewhere. CA is a very intellectual profession as I am a proud member of this community but legality is something that should be briefcase of a Lawyer and should be especially meant for this honorable profession called Advocate.
Chartered Accountants have zero knowledge about procedural and constitutional laws. Just by reading a few law subjects like company /contract / tax laws does not mean you have completed an LLB degree where one studies not less than 60 law subjects in a span of 5 years. Most CAs have an ego of superiority complex wherein they feel they understand everything under the sun and have an illusion about their profession. They fail to understand the limitations of their profession. Most of them have very poor knowledge about civil laws/consumer laws/ or any niche laws like IPR or mining laws. Respect each other's profession and let one be independent of the other. Most CAs are part of a commercial team where they think they can dictate the legal team. Please remember you might be flexing your muscles like an executive, but remember that the judiciary is also a distinct and separate pillar of the democracy. Gone are the days when people used to get a "nakli" law degree just for the sake of it. Peace out and let each profession be at its own place !
Nonsense, it's pretty obvious CAs know tax more than lawyers. Also as long as the client has confidence in the firm they are enquiring from its their human right to source information. Lawyers should being more ethical than they are being...... HP Raina is right. That lawyer needs to get a life, Lalit Bhasin. It's not anyone's fault that they don't have enough clients to keep em afloat
this lawyer is clueless. Chartered accountants don't only perform audits. They also do tax. In fact they are more qualified to advice clients on matters pertaining tax if compared to lawyers. Tax laws are still well within their field of expertise. It's not like they advice clients on civil cases.
Let them know that we studied Partnership Act in 11th standard and Income Tax Law in B Com. Law and Acts are in our blood now. In contrast, i have seen lawyers who file Income Tax Returns. 🤣🤣🤣🤣🤣
CA have a least knowledge on law matters whereas A good lawyer is more and more enough to give legal opinion rather than CAs...of course CA is good in handling accounts but legal sector they least know only...both are experts are in their respective field...
Mr. Shrinivas Kulkarni your saying that CA's has least knowledge in law matters is totally wrong... there are many Lawyers/ Advocates who can't pass Company Laws, Taxation Laws, Economic and Commercial Laws, Industrial, labour and General Laws, Capital Markets and Securities Laws of CA, CS and CMA examination... does that mean those Lawyers/ Advocates don't even know law?
you should learn to respect each profession... no one is best or least here... it is the skills which matters... saying Lawyers are better than CA's you are comparing...
sher Khan CA captures the persons who are doing corruption. A CA indeed serves the nation in true meaning as it provides the public trustable reports. They find the disease of corruption and cure the country on higher level not like liars..... sorry lawyer.
had u ever visit high court or supreme court do u know wat is justice and how much effort a lawyer put in his duty to bring happiness in his client face... goods and bad people are in every profffesion ... but the status of legal profffesion will always remain high... in human society..
you are talking about the minority of lawyers. Both are assets of nation but I am considering the best between the both. Here majority of CAs are good. I will say you that I usually visit the courts. But you need to visit financial regulatory institutions like places of auditing. Moreover CAs make the budget and financial analysis of nation's wealth so their service is not limited to micro level. They serve the society as a whole.
chartered accountants knowledge of taxation is often greater than lawyers so why should they not practise it? A Chartered Accountant is a cross between a lawyer and economist.
This comment section is a Battle ground for young CAs and Lawyers

Sir, an advocate is permitted to study Chartered Acvountancy?
Why not
Please don't compare a CA and a Lawyer.
Why
What happens I am going to study both lawyer and Ca
I believe lawyers have all right to appear before courts. But as far as legal advice is concerned, I think it's sole discretion of person obtaining the advice from he wants.
pankaj rajgor very true but its not about legal advice its about drafting and litigation which is only be done by a lawyer
secondly there is a difference between just advice and legal (law related) advice
CA oviously can be authorised represent till itat not above like hc and supreme court
Sahi confused bahut hi sab but CA have very powerful
