    Sir Let suppose A Ne B par case Kiya Order 33 rule 1 ki application ke saath Legal Ownership B ke paas hai aur barred by Limitation bhi hai aur abhi Filhal order 33 rule 1 pe A ki jaanch chal rahi hai abhi tak case accept nahi hua aur B ko court se koi notice ya summon issue hi nahi hua kyunki jaanch chal rahi hai aur aisi condition mein B ne C ko bech di toh kya hoga

      I'm assuming that this is a hypothetical situation and not a real case. If it is a real case , you should consult a lawyer with all documentation.
      Now Order 33 Rule 1 is application to sue as a pauper (poor or indigent person).
      Firstly court will decide if the application is maintainable or not.
      Thereafter court will decide whether the delay is justified to condone or not.
      Now if Mr. B has got legal ownership by court order, then all the above things will deem useless. And he can sell the flat.
      If B has legal ownership by any other means and he has not yet received summons of the court, he can sell the flat.

      @@LawGeek Sir B ke paas 2013 mein Relinquishment Deed ke Madhyam se aayi thi 2020 mein A aur B ke Relations Kharab Ho Gaye Toh Ab A ka Intention hai apna share vapas Lena, Toh A ne 2023 mein Partition ki Plaint Daakhil Ki with application of order 33 rule 1, Basically A is creating Pressure on B to sell property and to give him money as per the half share but B is the owner as per Relinquishment Deed and That share had been relinquished by A in 2013.
      So This is the situation and I guess A did This Just to announce property as disputed in Market, Nahi toh voh court fees bharke bhi kar sakta tha.
