Willfully ignoring legislation that prescribes protection of the public is a shield from accountability for the uniformed criminals in our midst. Excellent work exposing their crimes.

The legislation states that camera equipment can be seized where the officer reasonably suspects that a person is a terrorist. Surely the seizure must be coupled with an arrest. After all, having let the suspect walk free; if examination of the camera proves terrorism-related acts then it is too late to arrest the suspect who will have gone to ground or left the country. This surely proves that at the time of seizure the police did not suspect Kolee at all, but seized his phone as an act of retaliation. Personally, I would put that to my solicitor as it would make a good test case.
So according to DS Wiseman a cars registration is private when it's on police officers private cars. I just love it when he admits on camera that "the public don't like us" ! I wonder why that would be mmmmm?

Fear not. Any Judge will see through the Force’s utter contempt for the [GDPR] Law (which Judges of course hate). Damages will be higher. Ask your solicitor to request the Judge specifically includes this matter as a SECOND “perversion of the course of justice”. As mentioned at the time, you’ll win this one.

I had the same issue for my SAR, It took my solicitor to get it in the end, It revealed in the end documents that criminalized them thus proving them at fault. End result was £12.000 out of court settlement.

Hampshire constabulary used the same tactics on me even though the ICO contacted them to inform them that they were breaking the law and to reconsider my request but Hampshire constabulary still refused access to any bodyworn footage or custody CCTV which contains the torture footage of myself in the police cell and following trip to hospital. The ICO then basically told me there was nothing they could do for an individual and only really act when there have been many complains or a major data breach. The ICO are toothless !
In other words... Assisting the POLICE to cover up a crime against a member of the public. & assisting them to brake the law. Which makes the ICO complicit in the offence.

The ICO told me they broke the law first because they didn't respond within the allowed time frame and then told them twice to blur out any people in the videos they wanted to protect but they still refused. They even refused the CCTV of me alone in the custody cell. Eventually they sent only 3 snapshot still photos from the bodyworn video. Looking forward to seeing them in court very soon as the papers have been served.

@@koleeberks Police also denied liability so my solicitor served papers on them for trial, we going for a jury trial hopefully some time in Feb 2022. Looking forward to showing the jury my bodycam footage of my unlawful arrest as well as evidence of their officers perverting the course of justice by making up false statements against me which I have video evidence of. Morons the lot of them. This is why you should always run a bodycam from start to finish.
That is funny because I took a long time ago the Hampshire Police to the Magistrate court and I walked in alone and they sent their best solicitor and I won.
Once you issue a court case you must request this information and the judge will order the release of the footage. Your main priority is to get the police to confirm thar the footage will not be deleted.

A public access request system,which the public are only allowed access to if the Police say so & doesn't show them breaking the law😂 The attack dog PC has 'Little Man Syndrome' .Thought he would chuck his weight around to boost his ego and show off to his inept colleagues. Keep going Kolee... You're doing a great job exposing (and hopefully weeding out) the wrong 'uns, in a very entertaining way. Withholding body cam footage looks like an institutional cover up to me. Stay at it, the public need people like you to hold the rogues to account.
Unfortunately if it's not in their interest to release the body cam footage they will refuse or try & make it as hard as possible to get a copy even though we are entitled to it.

@@heresjohnny602 sorry to burst your bubble! 😁I did get body worn footage from an incident involving me when i got CS sprayed but it was heavily edited & messed with to suit their narrative. I naively thought it would protect me! Which began my journey into enlightenment on how bent cops can be.

Long story short I was stopped in my car & accused of having no insurance by an aggressive young power tripping cop. The ANPR system was wrong. I wasn't happy with the guy as he had been speeding to catch me up without blues & twos etc, got into a heated debate then asked for his ID & receipt of the stop.said I would put a complaint in. He went back to his car, returned & said I believe your driving under the influence. That was wrong & I refused the breathalyser. Xyz im arresting you on suspicion of driving under the influence. I Said you've got no reasonable grounds to suspect I'm on drink or drugs.He Pressed his emergency button, ripped open my car door & slapped the cuffs on me excessively tight.This wasn't going down well with me for obvious reasons but he then said if you don't get out of the car I'll spray ya!! Next thing he sprays me in the face at about 10 inches, drags me out the car, throws me on the road with the help of his female colleague. As I'm screaming in pain then threatens to taser me!? Dragged into the back of a van that had pulled up b4 I refused the breathalyser & drove it like he had stolen it with me in the back being thrown around. Got to the custody suite did blood tests etc all negative. Interviewed ,then accused of speeding & trying to abduct an officer & resisting arrest. I was Released pending further investigation. 5.2 months later I'm charged with resisting arrest & had a court date. Pleaded not guilty at Magistrates court & had another date for the case to be heard in full. CPS then dropped the charges as not in the public interest. It's now in the hands of a solicitor. Thats a short version, Bloody nightmare. The amount of BS in their statements is unbelievable. So in summary record every interaction with um, I've learned the hard way, i had no previous experience with um.

They are small changes I agree, but it is better than doing nothing at all. What have you done?

You have plenty of convincing evidence as it is.
The forces closing ranks and depriving you of your rights to access their footage just makes them look even more bent.
I think this paper trail of yours, and their lack of suitable response does nothing but strength your case.
Systemic abuse....they are all bent (at least the one involved here).
The refusal to give you a copy of the BWV under section 45(4)(e) of the DP Act 2018 is nothing to do with protecting others. It's all to do with not being arsed to blur the appropriate bits of the video or mute the audio to hide the identify of constables and cars that got recorded. They're just being lazy which is not grounds for the refusal. Plus it means it looks worse for them come the court case as they will have to explain to the judge why they refused it.

Please take this as constructive criticism I've watched a lot of auditors videos and a lot of the time I find the auditors talk too much try and get it back down to yes and no don't ask things like am I being detained wait until they say it and when they asked you a question try and keep it Brief and yes or no and then let them continue with the conversation and then after I finished talking you can put your point but when you try and talk over them it becomes an argument you should take a breath and just let them speak until they get fed up with hearing their own voice

Great videos Koleeberks. The process of getting justise is just met with a wall of ignorance and suspicious deception. Keeping fighting this and keep up the brilliant work, highlighting our rights and their disliking to it, even when using section 43.
What interest me at the moment is the defining line between private and public property like crown court buildings as far as I'm concerned you're in public outside of the door once you enter the door will go through the door and it's private if you like but that's still debatable this is interesting I'm going to try and research it if anyone's got any suggestions or know how to check and find out properly

Just for a second, reverse the roles, .. a member of the public gets pulled over in
his car by a policeman who's filming on his BWC, the man tells the cop he doesn't
want his car filmed, and asks him to turn the camera off, the cop refuses, so the
man makes a grab for the camera. ... Has anyone got a comment on how long that
investigation would take, before the man was charged with an offence?

If you tell them you need the footage as it is required to bring a legal claim against the force they cannot refuse:
Requests made under Schedule 2 Part 1(5) of the Data Protection Act 2018
(a) Schedule 2 Part 1(5) of the Data Protection Act 2018 states that personal data are exempt from the non-disclosure provisions whereby:
a disclosure is required by or under an enactment, by any rule of law or by the order of a court;
for the purpose of, or in connection with, any legal proceedings (including prospective legal proceedings) or the purpose of obtaining legal advice, or is otherwise necessary for the purpose of establishing, exercising or defending legal rights.
I think that is mentioned in Kolee's letter to Hampshire Police, it is too small to read on-screen though.
Section 45 (4) (e) of The Data Protection Act (2018).
(5) Where the rights of a data subject under subsection (1) are restricted, wholly or partly, the controller must inform the data subject in writing without undue delay-
(a) that the rights of the data subject have been restricted,
(b) of the reasons for the restriction,
(c) of the data subject’s right to make a request to the Commissioner under section 51,
(d) of the data subject’s right to lodge a complaint with the Commissioner, and
(e) of the data subject’s right to apply to a court under section 167.
(6) Subsection (5)(a) and (b) do not apply to the extent that the provision of the information would undermine the purpose of the restriction.
5a and 5e were not correctly carried out. They gave no reasons nor did they inform Kolee of his right to obtain a court order under section 167.

This witholding information when someone applies a SAR is getting awfull. I do understand to go through all the requests and omit sensative names etc The man power would be huge but!!! Its our right. However I do think under Boris we will loose this right with regards to the Police files.

First class auditing Kolee, this is how auditing should be done, it puts most other so called auditing to shame. Most other auditors just post videos of themselves being abused and humiliated by the police and leave it at that with their viewers left hanging in mid air and frustrated. The class of auditing, the updates and information posted by Kolee are impressive. Other auditors should watch Kolee and learn how the job is done or Kolee will be the only auditor worth subscribing to.

They are not going to disclose anything that going to assist your claim. The whole point of seeing the body cam footage is to decide whether to litigate or not and also to save costs. Litigation should be the last resort. I would send emails to all concern and make sure you get confirmation that it has been read.

I love the update videos. If you didn't take action then it would be pointless you auditing, so thank you for going all the way and sueing them. One thing I will say is always have your preferred method of contact be via email as this will always leave you a paper trail if and when it comes to you needing it for evidence. Good luck 👍🏻

This is the way to do an update video, start at the beginning and quickly go through everything. Many auditor go on and on, sticking to the facts and keeping the video short is key. Good Job!!
