Had my drivers license suspended when I moved to a different state because someone with the same name , middle initial and birth date was arrested for drunk driving. He didn't look anything like me, different height, eye color, hair color plus they had his picture and fingerprints since he had been arrested. My fingerprints and picture was also available due to my employment, nobody would listen , I was threatened with arrest and jail if I was caught driving without a license. It took 8 weeks to straighten this out only after I had to constantly call every DA office and motor vehicle office in the 3 states involved with everyone agreeing that I was not this person. Such a mess I actually considered a name change, and yes I was told this happens quite frequently, so while I managed to stay out of jail I know of what her frustration was with this situation. I think she will easily win her lawsuit and hope she realizes most law enforcement are good people and don't hold a bad perception of all of them.

She very well may need counseling to overcome what she went through in that jail and may deal with this for the rest of her life. Law enforcement officers have to call the issuing agency and verify the warrant info. If the dates of birth didn't match, that is a dead giveaway it wasn't the same person.
