Had my drivers license suspended when I moved to a different state because someone with the same name , middle initial and birth date was arrested for drunk driving. He didn't look anything like me, different height, eye color, hair color plus they had his picture and fingerprints since he had been arrested. My fingerprints and picture was also available due to my employment, nobody would listen , I was threatened with arrest and jail if I was caught driving without a license. It took 8 weeks to straighten this out only after I had to constantly call every DA office and motor vehicle office in the 3 states involved with everyone agreeing that I was not this person. Such a mess I actually considered a name change, and yes I was told this happens quite frequently, so while I managed to stay out of jail I know of what her frustration was with this situation. I think she will easily win her lawsuit and hope she realizes most law enforcement are good people and don't hold a bad perception of all of them.
Sadly the taxpayer foots the bill unless she sues the guy civilly and personally for acting outside his scope. Which given how negligent he was, might be possible

She very well may need counseling to overcome what she went through in that jail and may deal with this for the rest of her life. But the county is covered by insurance and yes the taxpayers pay the insurance premiums but won't be paying the amount she wins in the lawsuit, the insurance company will pay it.
Law enforcement officers have to call the issuing agency and verify the warrant info. If the dates of birth didn't match, that is a dead giveaway it wasn't the same person. There are so many people with the exact same name that the wrong people would be arrested all the time if they didn't verify.
Scary story....what a horrible thing to happen to that poor woman after her vacation. Law enforcement did a horrendous job of checking their facts. A lawsuit seems to be in order.
Oh it gets better Don. Houston is located in Harris County and the District Attorney wound up dropping all charges on the original person the warranty was issued for. They said the case was too weak to pursue. I hope she gets a nice settlement out of them.

Upon walking off the Ship I immediately realized I left my Cell Phone on the window sill. Security notified and they called up to have someone CHECK for the Phone. Just wait here. They said no Phone was found. Well. WRONG. The phone was STOLEN by the fella that was assigned to clean our room. R-190. I waited for Carnival to check back to me. Now I find from the Cell Service provider that MY PHONE has been calling some shithole foreign country for the past few days. SO. I am Screwed. Carnival will do nothing

And just a few months later another man came up dead and they are investigating it now. Some police officers let the power of the law go to their head. And it wasn’t just one person involved. The deputy sheriff was also only recently reinstated, there was a previous incident in which the deputy sheriff was involved in an altercation in which the suspect was killed by the officer, but it turned out the suspect only had an "Air" gun... ridiculous, I would think his career is quickly coming to an end

Indeed, his department ought to be investigated; you rather doubt that this is the first time that something like this has happened. Incompetence and corruption are more common within law enforcement than we would like. Worse still, there is rarely any meaningful accountability/justice for the wronged in these situations.
This isn’t true. There’s no examination of orifices. You are searched and put through a scanner which will beep if there are weapons on you. Not saying she doesn’t have a good law suit but there is no sexual assault.

There are currently a slew of these “errors” that start way back down the line in records. Unsupervised hires who care not about accuracy. That person should be included in the suit. It wasn’t a small error. But blatant disregard of factual comparison. In simple terms that person failed to do their job.

Just imagine if the lady who was arrested wasn't even from the States but lived in another country. With modern technology it's just incredible to imagine that this could happen let alone the sherif involved not being bothered.
In the US, we have way too many in law enforcement that are not protecting and serving. They're in it to get a paycheck and be able to wear a badge and gun. Many of the good LEOs are leaving through retirement early or not and just finding better employment. There are still some good officers maybe even more than half, but way too many aren't.
I lived in Texas until 2015, and worked for a criminal defense attorney for 10 years there. Texas cops get it wrong a lot, and they don't care. Too many of them feel like they're above the law, especially these days. I'm glad she sued. More people should, but probably can't.

From what I hear, the county jails receive money to hold people with warrants. from other states and counties. I have heard stories where they will sometimes hold you for two weeks to earn maximum pay, even if it’s a mistaken identity.
