    Fair Housing Act
    The Fair Housing Act prohibits discrimination in the sale, rental, and financing of dwellings and in other housing-related activities based on disability, among other protected classes. Generally, the Fair Housing Act applies to a broad range of persons and entities, including public housing agencies, property owners, landlords, housing managers, real estate agents, brokerage service agencies, and banks.
    Section 504 of the Rehabilitation Act of 1973 (Section 504)
    Section 504 of the Rehabilitation Act provides that no qualified individual with disabilities should, solely by reason of his or her disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance.
    The Americans with Disabilities Act (ADA)
    The ADA is a comprehensive civil rights law for persons with disabilities. Title II of the ADA prohibits discrimination on the basis of disability in all programs, services, and activities provided or made available by public entities (state and local governments and special purpose districts). This includes housing when the housing is provided or made available by a public entity regardless of whether the entity receives federal financial assistance. For example, housing covered by Title II of the ADA includes housing operated by public housing agencies that meet the ADA’s definition of “public entity,” and housing operated by States or units of local government, such as housing on a State university campus.
    How to get Disabled Housing and Who Is a Person with a Disability?
    Federal nondiscrimination laws define a person with a disability to include any (1) individual with a physical or mental impairment that substantially limits one or more major life activities; (2) individual with a record of such impairment; or (3) individual who is regarded as having such an impairment.
    In general, a physical or mental impairment includes, but is not limited to, examples of conditions such as orthopedic, visual, speech and hearing impairments, cerebral palsy, autism, epilepsy, muscular dystrophy, multiple sclerosis, cancer, heart disease, diabetes, Human Immunodeficiency Virus (HIV), developmental disabilities, mental illness, drug addiction, and alcoholism.
    Some impairments are readily observable, while others may be invisible. Observable impairments may include, but are not limited to, blindness or low vision, deafness or being hard of hearing, mobility limitations, and other types of impairments with observable symptoms or effects, such as intellectual impairments (including some types of autism), neurological impairments (e.g., stroke, Parkinson’s disease, cerebral palsy, epilepsy, or brain injury), mental illness, or other diseases or conditions that affect major life activities or bodily functions.
    The term “major life activities” includes those activities that are important to daily life. Major life activities include, for example, walking, speaking, hearing, seeing, breathing, working, learning, performing manual tasks, and caring for oneself. There are other major life activities that are not on this list. Major life activities also include the operation of major bodily activities, such as the functions of the immune system, special sense organs and skin, normal cell growth, and digestive, genitourinary, bowel, bladder, neurological, brain, respiratory, circulatory, cardiovascular, endocrine, hemic, lymphatic, musculoskeletal, and reproductive systems.
    Under regulations implementing the ADA Amendments Act of 2008 some types of impairments will, in virtually all cases, be found to impose a substantial limitation on a major life activity resulting in a determination of a disability. Such impairments are “predictably assessed” as disabilities by the very nature of the impairment as substantially limiting a major life activity or major bodily function. Examples include deafness, blindness, intellectual disabilities, partially or completely missing limbs or mobility impairments requiring the use of a wheelchair, autism, cancer, cerebral palsy, diabetes, epilepsy, muscular dystrophy, multiple sclerosis, Human Immunodeficiency Virus (HIV) infection, major depressive disorder, bipolar disorder, post-traumatic stress disorder, traumatic brain injury, obsessive compulsive disorder, and schizophrenia. This does not mean that other conditions are not disabilities. It simply means that in virtually all cases these conditions will be covered as disabilities.

    Incredibly helpful & informative video. Does having multiple Disabilities compound into higher priority? For example having Developmental / several Mental Health & Physical disability? Well established & on SSI Disability. Thx greatly for your great work Jay

    Im going to watch your videos again over and over. I feel so sad and bad today. Every place I call I had bad news. Disable, dealing with MS, chronic pain and more stuff and will be homeless. So hard. Im sorry today is though. Thank you for your help!

      @@Section8Consulting Im in Massachusetts and it is so hard dealing with housing authority. All online applications, cannot send the doctors note online or the agents dont know the programs or help with application. I have cognitives issues and mobility, because the ms brain and spinal cord lesions and they do not provide accommodation. Maybe will send someone to get my signature. Im on ssdi already for years, just applying for housing now and to be honest applied by myself online with help for ssdi was easier than housing. It is sad.

      @@carinabarros135 I wish you the best I know it’s hard . Do you have anyone who can help you ? Usually disability are first in line for help . Try your local housing authorities as well find an agency who works with homeless individuals too .

    Ty I had never heard of this I'm a brain injury patient as a result from brain and and spinal cord cancer also I have nerve damage as a result from brain surgery and I have ADHD and fine motor skills disorder I work with a life coach who helps me with errands and my daughter I live with my mom and she worries about if something happens to her how would I be taken care of the program I'm in would provide 24 hour care but this also is very good for me my mom has me on her section 8 but this would be better for me my daughter and I live with her but I'm ready to regain my independence

      They give you a form to take to your doctor that ask if your disability will last greater 12 months.

      You can get selected ASAP. I used to live in section 811 housing and I went to a local mental health treatment center and my old therapist fast-forwarded my application to get it ASAP. (That was back in 2006) but if you go to a community mental health center, they find housing for the disabled quickly, then you applying by yourself.

    My ex is 65 now in NYC, in a HUD building already, but our grown son is on the lease too, can he still receive section 8 having him in the apt? , after your info here I think he is eligible because he was diagnosed with PTSD 3 years ago and now at 65 has been on social security limited income. (would our son have to be taken off his the lease and move out?) I just can't get this info from anyone. Thanks Jay, I will get in touch with you if you say yes he can!

      He has to either have his own voucher or be on another persons voucher as occupant.

      I’m in colorado as soon as my kids hit 18 they calculated their income and basically want to take my voucher for being over qualified . Well I got hurt so I’m on short term disability now .

    Hi, i am on SSDI and have been for most of my life but thanks to my family members who have sacraficed so much for me over the years is now unable to continue so i am trying to get out on my own but have no ideal what i am doing so any help will be greatly appreciated , like i said i draw a monthly SSDI check and have called my local section 8 housing office only to be told there is 300 people on the waiting list and it could take up to 3 years to get help, i dont have 3 years to wait i am in an emergency situation with only about 60 days to get help or i will be homeless, i reside in lakeland, florida with my mom and dad who are over 75 now and can no longer help as they themselves need help, so please if you can help me it would be greatly appreciated. I am 55 years old myself.
