@@KissMyFatAxe Don't be too certain. Legally, an assault doesn't have to be physical (although battery does). An assault can also include the fear of physical harm. If a guy sends a picture of their dick and another person takes it as a sign that that guy would grope at them or worse if given a chance, that's all that is required to meet the burden of assault.
Why are you discounting victims? Some men are falsely accused of things. Both things are disgusting. Larry here however is a creep.

It was a little hard for me to follow what the woman in the follow up video was saying. ("And then he was like, Get your s*** together Larry! And then I was like, Bleeeeeeh.") Come on now, cut to the chase. 🤦🏻♀️
Cornell Lawschool - Assault is generally defined as an intentional act that puts another person in reasonable apprehension of imminent harmful or offensive contact. No physical injury is required, but the actor must have intended to cause a harmful or offensive contact with the victim and the victim must have thereby been put in immediate apprehension of such a contact. “Intention” in the context of assault, means that the act is not accidental, but motive is immaterial. It does not matter if the goal of the tortfeasor was merely to scare the victim or if the act was meant as a joke. The tortfeasor need not have intended for the contact to be harmful or offensive, only to have intended the actual contact. “Reasonable apprehension” in the context of assault, refers to the victim’s reasonable belief that the act will lead to imminent harmful or offensive contact. The victim does not need to prove fear, only that they were aware that such a contact might occur. If the victim and the tortfeasor do not know each other, then the legal standard is what an ordinary reasonable person under the same circumstances as the victim would have believed. If the victim and tortfeasor have special knowledge of each other, this special knowledge may be considered when determining whether the victim’s apprehension was reasonable. “Imminent” in the context of assault, means the threatened harmful or offensive contact must be certain or likely to occur very soon. “Harmful or offensive” in the context of assault, is an objective standard referring to touching that is likely to or capable of causing harm or offending a reasonable person by violating prevailing social standards of acceptable touching. However, an otherwise inoffensive contact may be deemed offensive if the tortfeasor knew the victim was unusually averse to such a contact. There is some disagreement among jurisdictions in regard to the role of consent. The prima facie case for assault has three components: The defendant acts. The defendant intends to cause the victim to apprehend imminent harmful or offensive contact by the defendant. The defendant’s act causes the victim to reasonably apprehend such a contact. In tort law, assault is considered an intentional tort. Some jurisdictions label assault as attempted battery. Assault is typically paired with battery as assault and battery. In assault and battery, assault refers to the act that causes the victim to immediately apprehend a harmful or offensive contact, whereas battery refers to the act that causes the actual contact. Assault committed under aggravating circumstances may be raised to aggravated assault. For example: In Vetter v. Morgan, the Court of Appeals of Kansas held that “[the defendant’s] threat and the acts and circumstances surrounding it could reasonably put someone in [the plaintiff’s] position in apprehension of imminent or immediate bodily harm.” In California, under § 240 of the Penal Code, assault is “an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another.” [Last updated in June of 2022 So yep, it’s an assault of potentially several kinds! Thanks for helping us learn!
@@veronicaveeroni no, thank YOU for helping us learn...being that there was no imminent threat, or insinuation of a threat, a penis picture alone in no way meets the criteria of assault. Had he used threatening language to imply what he was planning to do with said penis, then by your citation it may have constituted assault. Because there was no direct intention asserted along with the pic, it can constitute distribution of obscene material, but not actual assault.
@@Jaystub okay well many people, states like Texas , legal laws, and facts, disagree with you on the “penis picture alone” thing. An unsolicited dick pic is 100% assault and not some joke or hot pickup line or different because your gods gift.

Age and wisdom are not the same thing. How could you not think this decision was going to backfire immediately?
My biggest worry is that when sending the airdrop he has no idea who he was sending it to. I'd be worried he was trying to send it to a child.
Airdrop has to be enabled on the device. If you give your kid an iPad you probably shouldn’t have it turned on

Wow, what can I say. Xenoshot said it all. He could've said it was a mistake "happy fingers" and apologized but when he admitted he did it on purpose, it just went to a whole other level and he deserved what came to him after that. NASTY OLD MAN!!
Yeah people would have bought the old man didn't know how to use technology card, I've had enough elderly family members inept enough to do something like this legitimately by accident I would have bought it too. It's like those dudes who expose themselves. They get their jollies from the humiliation. He knew what he was doing it's the attention he wanted.
I can’t fathom what it takes to do something like this. I mean, just imagine how awkward the rest of the flight was. Wondering about the legal ramifications and if he can be given extra charges given that children did receive it, even if they were lucky enough to not actually open it.
The prima facie case for assault has three components:
The defendant acts.
For example:
In Vetter v. Morgan, the Court of Appeals of Kansas held that “[the defendant’s] threat and the acts and circumstances surrounding it could reasonably put someone in [the plaintiff’s] position in apprehension of imminent or immediate bodily harm.”
In California, under § 240 of the Penal Code, assault is “an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another.”
[Last updated in June of 2022
So yep, it’s an assault of potentially several kinds!
@@veronicaveeroni yeah people go to law school for this, not google. Nice try
@@Jaystub okay well many people, states like Texas , legal laws, and facts, disagree with you on the “penis picture alone” thing. An unsolicited dick pic is 100% assault and not some joke or hot pickup line or different because your gods gift.
