You know what...... no. When these ID-10-T defendants want to go Pro Se, let them go Pro Se all the way. No "Standby" counsel, no advise, nothing. Let them lead themselves all the way to jail/prison. Then let them try to appeal, all on their own, how unfair it was to allow themselves to represent themselves.
This Judge is absolutely wrong. You have a right to represent yourself. The Judge has to establish that you knowingly and willingly waive that right. The Judge asked no questions nor did he go into reasons why. I've seen defendants who can't excuse their attorneys after they've gone through three or four. I would hate to have a guy like this as a client, but if the Judge appointed me I'd be screwed. I had a few & usually we do OK. I just let them think that they are making the decisions.
I'm just guessing but maybe there were previous interactions that let the judge know the kid isn't all there as heard when he told the judge to go fuck himself
The judge doesn't have to allow him to represent himself! It was very obvious that he incapable of doing so. I have been an attorney for 30 years and have come across very few people who are knowledgeable enough to represent themselves!
The defendant did not say that he wanted to represent himself but that he "was being forced to represent himself if the judge did not appoint another attorney". So the judge was right in denying the removal of the attorney.
