I was born with Cerebral Palsy, brain damage, chronic pain, bi-lateral leg and foot deformities, autism, low vision issues and more 60+ years ago. From birth till adulthood I went to the best specialists in the nation at the time to be diagnosed and taught how to live my disabilities. Doctors said my deficits were irreversible meaning my constellation of disabilities will not get better no matter how many doctors I saw yesterday, see today or find tomorrow. My disabilities get worse as I age. When I could work I did so for 21 years. Now I'm on disability again! Why would they waste time investigating me because I don't visit doctors? Doctors do NOTHING but offer me pain meds, I refuse because I don't want to become a dope addict!

This is a very good point. Typically, a CDI investigates folks under the age of 50 and with diagnosis that are difficult to physically observe. (ie., some mental health diagnosis, etc.).

@@evansdisability Attention Investigators ! - A neighbor in San antonio Texas who lives on Rustic Park in 78240 zip code is about 60 she is white, named Renee Kerr, and she just applied for disability and she said, she is a nurse, and went to the doctor and claimed she has Covid Long Haulers and she said, I'm a nurse, I know how to fake all the symptoms and convince the doctors I have all this. That is what she told me, she was saying on the phone all the symptoms she was going to pretend to have. She does Ubereats driving around taking food to people. I am being 100% honest and serious folks ! She told me how she was going to a nearby University health care acute care clinic to report symptoms to get them into her medical chart so it would be documented prior to her making the application. Yes Renee has methodically and meticulously planned out this process to increase her chances of winning the jackpot ! she was a nurse, but quit working because she refused to take a Covid Vaccine, now she hit the jackpot and is going full circle to cash in on SSA benefits since she claims she caught Covid, and is now a Long Haul Covid Victim. She also steals cats from people, like Maine Coon or other fancy cat breeds.

I was long disabled before I painfully had to admit it to myself, once I could do that,I started writing down all my pain and what triggers them, how long, what are my limitations, etc I had to relearn everything about myself as a disabled person and once I was confident and ready to go to war disabled I hire a lawyer
When I first apply then sent me a book full of nothing but questions, I cried for days, and 30 days later I still couldnt answer all the questions
I was too unstable and I do understand why so many Americans choose to die with there disability than fight back disabled

@@biancasaldanah7761Exactly, a lot of us don’t want to admit we’re disabled. I often dress to hide mine because I have a very visible physical disability. The reason I do that is because I get stared down and that makes me uncomfortable. Sometimes that causes me to get judged because people can’t see it. I also have cognitive issues and agoraphobia/depression/anxiety, so it’s hard for me to get out of the house and when I do I dress up. So, lol, that sometimes causes me to be scrutinized. What I hate is that I can tell that I’m being judged but no one actually approaches me about it and gives me a chance to explain.

I got my SSDI years ago (can’t remember how long) pretty fast and with no resistance. I was in for combat stuff though, and the VA had rated me already. I think the VA stuff helped, because SS expedited my claim through the wounded warrior section or whatever. So if you’re a combat vet, definitely take your VA rating stuff, DD214, any combat awards citations, etc… They treated me real good from what I can remember at the office. I don’t really care if I get investigated, because I keep up at the VA Hospital and I am Permanent and Total through them. I get my treatment because even though the VA says I’ll never get better, I have to believe that it could happen someday.

I was harassed by an investigator I drove to my daughters bus stop .3 miles from my house and as I was sitting there a random woman pulled beside me and told me to roll my window down . When I did she said the word “No” three times . No no no . I said “no what ? Super
Confused. She had this mean look on her face . Then she said “ oh sorry I thought u were my daughter “! Ummm excuse me
. She was sitting beside me for like 20 seconds before I noticed her so I’m sure she knew I wasn’t her daughter. So that’s why I think it was an investigator. I have all my
Medical history documented . I am a hard worker have been my
Whole life , it’s embarrassing to even ask for help so when you get the courage to see if you qualify these type of
    Things you will

I was alerted to this video as a person who is on disability and has DID. I really resent that a judge pre-decides that someone who has a legitimate disorder that is in the DSM might be faking it if they are vague. (?!) DID is caused by severe and repeated trauma in early childhood. No, it’s not actually like what you see in movies, but for many folks it can be disabling, extremely so. It is for me. Especially if you have multiple ego states that are not aware of each other and so you have lost time during your days or weeks (again, my situation). Then answers to questions can be legitimately vague because it can be hard or impossible to remember. Those of us who have this disorder are already having to live with the stigma of this diagnosis (just confirmed in this video)…we don’t need this kind of bias on top of it.
Also, regarding a blind person not needing a handicap placard. They often have someone who drives them places. If they are walking from a vehicle to a door with a cane, shouldn’t their driver or caregiver get to park in a place closest to the door so they can accompany them in? You’re gonna make the blind guy shuffle a long way with his cane just because you think he doesn’t need a permit for some reason? I hope all judges aren’t as pre-biased as this guy.

Dan Hyatt (former SSA Judge) is referencing the CDI investigator believing that if the claimant with a mental impairment carying on a normal conversation that "they're probably not going to conclude that the person has a serious mental impairment..." Former Judge Hyatt is refering to the CDI investigator believing that if the person with a mental health impairment can have a "normal" conversation must not have a mental impairment. We strongly believe that people with mentalh health impairments can present "normal" in conversation and still suffer from a mental health disability. It's really important to note that a person with medical records that support disability should not worry about a CDI investigation.

Well, sometimes people who don't like you might say those things to the OIG just to cause problems. Now Just because the OIG sent investigators to follow you around it does not necessarily mean they will find something that a judge could use to remove your benefits! Also are there times when this happened and the investigators found nothing and they told the person who made the report to stop wasting their time? I would hope that they take down the name, address and phone number of each person making a report even if the claimant never sees it. Then if that person continues to make those false reports the SSA making the troublemaker cover the cost of the investigations against that claimant. I only seems just to me. If they think they won't pay they *WILL* think again since the SSA could get the wages of that troublemaker garnished or collect the money some other way. Or make it a felony to continually file false reports to the OIG. I can already imagine the evil Karens saying "not fair". No, that couldn't be more fair. The SSA has enough money problems without being sent on a wild goose chase just because someone doesn't like someone. I can be evil and bitter too but never like that!

Every case is different and without fully knowing the details of your case I do not want to give a legal opinion. That being said, make sure to get all your medical records into your file. Also, if you can get your treating doctors opinion on your ability to work that would be very helpful as well. You can visit our website and we have a free sample Physical RFC Questionnaire you can download/print and take to your doctor to fill out if you cannot find a specific questionnaire for amutation. evansdisability.com/services/medical-questionnaires-for-your-provider/ I hope this helps.

I do think people report people who are on disability if they see them seemingly enjoying life or doing things. Just because people are trying in life the best they can doesn’t mean they’re not disabled. That’s like expecting someone who is literally dying of a terminal illness to just stay home and lay down until they’re dead.

Then a week later the said school, call me and asked me if I need help with food,I said yes and I had tears in my eyes
And the school send 4 big box of can food and a bunch of stuff we dont eat,I asked them to give me giftcards to buy food at the grocery store because I have a weight limitation

      @evansdisability  6 місяців тому +3

This is a great question. Unfortunately, the answer your looking for is not so black and white or win/loss. Winning an SSA claim required solid medical evidence. Generally, if someone is using an electric bike or electric scooter - the questions that might raise is how much does that scooter/bike weigh? Do you need to lift the scooter for any reason? If you're riding an e-bike how long are you able to sit and ride it before you need to stop and rest? How long are you able to stand on the scooter before you need to stop and rest? These are the types of questions SSA might ask you if they find out your using an e-scooter or e-bike. Remember that you want to be consistent in your testimony. If you tell SSA you can only lift 5 pounds but then later say you can lift up your e-bike which weights 100lbs... SSA might raise an eyebrow.

    • @evansdisability

Thank you for your comment. I think you're referencing his statement at around 14:00 minutes in the video.

Nah there's just lots of misinformation that goes around, plus a lot of folks who have no clue about how the system works. There's legit disabled folks who are scared to walk to their mailbox bc some internet clown has told them they're probably being watched, and a stroll to the mailbox could somehow "prove" they are not disabled (now, if they're claiming they're a quadriplegic this might be a valid concern lol). Add to this that a lot of people on disability have mental illness that includes severe paranoia, so yeah.
