Driving Record Searches without Authorization?
Can you run a Driving Record Search through the DMV on a party involved in an ACCIDENT that is not your direct client without authorization?
This case involved NEGLIGENT ENTRUSTMENT and the CLIENT, a law firm in this case, wanted to see if the involved party who acquired a vehicle from our client and then proceeded to get in a police chase that resulted in multiple accidents and multiple claims had a HISTORY of driving related issues like accidents, violations, suspensions or DUI’s.
In this case because the client is a law firm working on active case in conjunction with an insurance company we can RUN the driving record with obtaining authorization from the involved party.
The key reason why it is permissible has to do with the fact that the request came from an attorney working on a case for an insurance company. If an individual called up and made the same request this search would not likely be permissible.
