It's worse, He never actually paid the 12% refund. What he's doing is presenting an unfavorable deal-a 12% refund-with a super short time frame to claim it (just one month). As this deal is unlikely to proceed, he can use this scenario in court to appear as though he attempted to issue a refund and is doing everything he can to make things right, while actually paying $0 to anyone.

These aren't victims. They're adults that willingly gave Logan money. No amount of financial recompense is going to fix the root problem.
This isn't a refund; it's a settlement offer. He's trying to reduce his downside liability in a class action. I can see why it took so long now - his lawyers were trying to find a way to give as little as possible and his PR people were trying to come up with a way to make it look virtuous. I can't believe the lengths this guy will go through to not pay what he owes when he is literally swimming in money and paying this back wouldn't make a dent in his wealth.

They won’t “teach him a lesson” they’ll likely settle the case. The punishment is up to the jury to decide on damages and likely legal costs are going to become the defendants burden, and that’s if the case doesn’t settle. It’s likely Tom the Lawyer took the case up pro bono and will get a percentage of the pie when they win. That’s how my class action lawsuit played out.

Coffee, you should consider filing an amicus brief in whatever case you think is the most impactful. It can have a big influence on how a court views at a respondent's claims and, therefore, the outcome as a whole. You would have the opportunity to make your point that the characterization of Logan's claims are faulty (the plagiarism isn't really relevant, though) and provide color around the expectations of NFT purchasers and to the response of Logan's "apologies".

Only issue is this runs the risk of getting wrapped up in the lawsuits himself. Coffee making a video talking about the situation is one thing, sure it makes a difference but it won’t influence the situation *financially*. That’s what tends to happen in these cases, one party knows they’re in the wrong and will ultimately lose but as long as they can drag the case out longer than the other party they’ll financially ruin them

If this gets turned over to the SEC he's going to be looking at a lot more than the $18M and probably being looking at jail time due to securities fraud. We all can only hope that is where this eventually ends up. Class-action lawsuit from those whom he scammed, immediately followed up by securities-fraud from the SEC. I get the feeling that his assets are not liquid and the constantly fluctuating crypto market makes it difficult to nail down when selling one coin and a percentage of another will give him the enough to make good on his promise while also netting him a profit. It's also possible that he was involved with SBF and has nothing to burn which would explain why no refunds were ever given. The most likely answer though is an actual lawyer got his ear and explained to him that giving any refunds would be viewed as an admission of guilt which is why the refunds now come with the massive string attached that the lawsuit has to die in a fire. Coffee doesn't mention it but if we look at the agreement I wouldn't be surprised if there was some kind of language there suggesting that this is an all or nothing deal. Meaning If the lawsuit itself doesn't go away then no one gets a dime.
