This is a really clear and concise guide to some aspects of the Partner visa process.
I would also say that the repercussions of using a visitor visa for long term de facto residence in Australia could be very dire - if refused entry as a non-bona fide visitor, you will generally be subject to a three year exclusion period - which is not going to be ideal for proof of an
    on-going relationship.
Currently, processing times for any application made in Australia to the Department of Immigration are "blowing out" - not just as far as Partner visas, but even citizenship applications are taking a great deal of time to finalise.
The quoted official processing time for a sub-class 100 Permanent Partner visa are an extraordinary 19 - 33 months! So yes, as you suggest, Emma, updates during the course of processing are almost essential. I assume an updated Police Certificate would also be required after that amount of administrative delay.

Hi, thanks for your comment, yes once the police check is out of date you would need a new one.

Hi there, I got a question about Australian Partner visa subclass 309. If I apply off shore, besides the visitor visa, can I apply for the short term working visa like Temporary skill Shortage Visa subclass 482 to go back to Australia before subclass 309 is issued?

Hi Robert, really good question, you need to be super careful with what you are planning to do here. Are you coming to Australia to study or are you coming to lodge a partner visa? You need to be very clear about your intentions before you get on that plane. This is not a conversation you want to be having with border force at the airport. You should really consider get some advice before you proceed. You can book in with one of our team here: www.freedommigration.com/how-to-book-a-visa-planning-session/

Hi, I am an Australian PR (got in in Jan/2014) & made my first landing in Feb/2014. I couldn't make it then after, due to job commitments elsewhere and then got married later. Was planning to migrate in 2018, but my wife got pregnant with our first child, so, I had to be with her to support her. Now, the travel facility attached to my PR visa got expired. I applied for RRV in Oct/2018 citing reasons of my wife's pregnancy as compelling reason, but it got rejected. Is there anyway for me or my wife to come back to AU again ?
    Thanks

hi thanks for your videos, they are very informative,
I am Australian Citizen, I applied partner VISa 309/100 for my wife 8 months ago. I visited her 4 times last year. Now I got the news she is Pregnant. My question is if I bring her here in Australia on visitor VISA and we deliver the baby here. Is she eligible to get benefits from Medicare? As one Partner (father) is the Australian Citizen and born baby will be Australian Citizen too.
your response will be highly appreciated.

Realistically for many couples it might not be possible to see each other if they applied for off shore visa due to hefty cost of visa itself. Air fare + visitor visa cost amounts to annual wage in some countries. So look at this situation - someone spent 7k+ on the offshore partner visa and then for 2 years they need to prove that relationships are genuine and lasting, while not being able to see each other which by itself jeopardize outcome of their application. Even though technically you are correct, yes you can visit etc, but it's not achievable if you are not from first world countries. So yeh, it's not misconception but rather realities for a whole lot of people, but they are not your clients are they ?

Hi. get a visitor visa while waiting for a partner visa is not a guarantee and likely to get refused for high risk countries applicant. I got my wife's visa refused and I had to move outside Australia to be together :(

    • @FreedomMigrationAUS
      @FreedomMigrationAUS  4 роки тому

Hi Adam, yes very true, there are no guarantees with any visa. We have had a few couples in similar situations to yourself and we have reviewed the visitor visa application and managed to get it granted the second time around.

Wanted to send back europe then. They were ficking bumholes. Confiscated both phones 2 laptops.
Went through everything and my ph never returned. I had 3 security guards + 2 federal officers guarding me. Whilst 3 immigration officers, confronting intimadating her for a confession?

@@FreedomMigrationAUS hi. Yes I want to apply for a visitor visa but also be a sponsor so she has all her expenses taken care of. I then plan to apply for an onshore partner visa during the time she is here on a visitor visa.

I’m really glad you got in touch with us as this is a mistake couples in your situation often make. A sponsored visitor visa will almost always come with an 8503 “no further stay” condition on it so you will be blocked for applying for the onshore 820 visa. Don’t worry there may be other things we can do if this is your plan. The best way to move forward is to book you in for visa planning session so we can sit down with you for an hour and get all the details of your case and find out what your plan is exactly, after that we will give you the strategy to use so that you guys can secure the visa and your future in Australia together. If you want to book in with me personally, here is a link to my calendar. calendly.com/emma-38/skype-visa-planning-session-online-booking I’m actually in the Philippines at the minute working on some cases. We can do a Skype call so that both you guys can be in on the session.
