Rashy really put Donna in a bind. He should never have agreed to represent her. Now she faces starting over again with delays and expenses doubled at the very least. Not good.
He took his million and bought a house and left her hanging!
She knowingly relied upon him to coordinate the preposterous extortion tale. He led her to belied that he would.

This was the best possible action the judge could have taken to preserve the integrity of his court room and the proceedings. NO ONE wants Donna to have an appealable conviction or worse to be not be help accountable at all for her part in the death of Dan Markel.

he should have to pay the court costs up to this point in my opinion.
Big mistake he didn't get things in writing from Charlie. What lawyer doesn't everything written in triplicate, signed and notarized

Judge E finally did the right thing! I love this judge, but he should have made this decision a long time ago. Also, Niles did a great job arguing the motion in court in place of Ufferman during the last hearing!

I wonder if Charlie realized how bad Rashbaum was when he started working with Offerman. He saw what a truly professional and skilled lawyer should act like.
Could be Charlie blamed the attorney and didn't want same for his mother. Who knows.
Idk that he had anything personal against Rashbaum… he just had an appeals lawyer that said he should not waive his rights as it impacts his appeal. We all saw waving his rights was against his best interest.

I can’t tell you how many times that we needed to get a hold of parents or family members. It’s only a suggestion that’s all. Just really worried about you all. Hiring Rashbaum was a very expensive mistake. I doubt he will refund.
He's got financial crime info IMO
Criminal Defense is not even his regular thing.
He is required to return so much of the retainer as was not used. He must provide her with an accounting of the time and all fees, costs expended and refund what is left.

When I heard that Charlie Adelson's lawyer was going to be Donna's lawyer, I immediately thought "conflict of interest," so I'm glad I was thinking in the right direction. I could not imagine how they could continue to protect Charlie's rights while also defending his mother. I specifically imagined Donna Adelson's defense being something along the lines of having Charlie take the fall/responsibility for EVERYTHING of the crime. I won't lie, I was not thinking good thoughts about Donna Adelson and I admit wondering if she wasn't manipulating Charlie for her own purposes in an effort to skirt responsibility for the murder. I would not be surprised if Donna is actually the mastermind, and Charlie was in fact manipulated into doing his mother's bidding because he was used to being manipulated all his life. But maybe I'm reading too much into this (or perhaps projecting LOL).

Great content as usual, I hit the like button every time before I start the video.
I don’t put anything past the Adelsons but Donna looked devastated when Rashbaum resigned that day. It doesn’t mean that Charlie isn’t manipulating things but she seemed upset to me and like “what do I do now?”
At this point, the state should offer a plea and see if she bites.
I see Wendy somewhere behind all this .

The judge's ruling reflects that he doesn't want to see justice jerked around again. IE, if it starts to look bad for either Adelsons with Morris, they'll file another procedural objection. Good for his Honor for cutting across.

I have learned so much about the gamesmanship of the legal process since I started watching this channel. It sounds like the judge made a "statement" about Rashbaum and went for the worst case scenario for salvaging the defense team. I like it. Better safe than sorry. The Maestro must be very pleased with himself. Sad though that justice for Dan Markel is delayed. Peter, I hope you and pray that you and your family remain safe throughout Hurricane Milton.

Peter I do wonder if Charlie did this at the 11th hour to delay his mom's case knowing it's easier to exist in jail than prison.
Kinda late in the game for changing your mind about waiving any conflict . As to her son. Judge really should give her time to get an attorney if she wants, or a public defender if she is now indigent😮

This will not go to trial prob by end of next year right ?? How is she going to get a lawyer ?? Harvey can't do it alone, and if stories are true Wendi not around and if she was , they weren't even talking much.....and HIGHLY doubt oldest son in NY would find her a lawyer
If they wait that long to arrest Wendi &/or Harvey it's going to be so long after its ridiculous-- already be 10+ years

Very smart of the judge to do this, we certainly don't want it to be a appellate issue and need to redo trial.
Why was it allowed in the first place ? It is bizarre , as is Donna wanting to use the same lawyer .

I may have missed something, but could it be possible that Charlie's attorney became Donna's lawyer knowing there would be a problem, like something that would cause a dismissal of the case or delay the trial as long as possible?

I would loooooove to hear a few jail calls from Donna after this!! Totally forgetting it’s recorded & going OFF on Charlie ~ "I did all of this for HIM! This was all his idea… wanted to be Wendy's 'hero'… I gave these guys how much money for HIM?! I didn’t know them but apparently Charlie did - they’re perfect, they kill people all the time he said - and he got ME to go along with this f'n plan!! We'll never get caught he said… literally wash the money first then bring it to him… I did everything HE said & look how he 'repays' me! I knew I shoulda left for Vietnam sooner - he waits until the last minute to really screw me… now I’m sitting in jail longer cuz HIS plan failed again!! Or maybe he’s afraid Dans new story for me will be better than his & I’ll be home with my sunshines while he rots?!! UGH!!" - sorry, that’s just how imagine one of those calls would sound like. (It’s hard to stop when your ranting as a pissed off Donna Adelson ) 😂😁😂

I bet she is so mad at Dan and also at Mr. Charlie! She wanted a trial ASAP and Dan’s lack of foresight and possibly his greed cost her trial to take 2 years from her arrest to her actual trial.
I have she knows why at last minute Charlie had an issue and my guess she does understand as that he's trying to appeal. But yeah I'm assuming she is fuming that she just wasted all this money and time. I think she's more upset that now she won't be easily able to communicate with Charlie, Harvey, Wendi and her attorney all in confidence. However I'm assuming Harvey has been looking for other attorneys as loose as Rashbaum was and that would handle this overbearing woman. Just sad that they won't get Wendi and Harvey for a while. This should have been done 10 years ago.

@@BlackStump172 Jail is mayhem. No consistency. New people coming and going all the time. it's dirty, food is worse, and conditons are just worse over all in general.
The problem with all these delays is that it delays arresting and charging Wendi.
This will be another wild case.

She was crying when she lost Rashbaum, so how is having NO lawyer at all going to affect her? I do not feel sorry for her at all since we have seen plenty of evidence of her major complicity in murder.

Everyone is missing what judge E actually said about AM. He said he could help her get new lawyers and help w a continuence of the next trial. He never said AM could be her lawyer & stay on. Judge E said Alex could help her find new counsel & help continue for trial date. That day when I heard Judge E my understanding was AM was out too. Then AM does a presser and I was confused b/c Judge E NEVER said AM could remain as 1st chair. Am I wrong?

The Judge will give the new defence lawyers as long as they want to prepare. I think all the lawyers are content for it to take as long as it takes, the prosecution have never seemed in any rush. The problem with all that though is that Donna seems to want this trial to go ahead ASAP, which I guess is unsurprising since she's stuck in jail anyway.
It's obvious that during the in camera meeting he was swayed to let them go without rashbaum, but after some shower thoughts, going over the motion by ufferman and re-reading the case law, he thought that there was a possibility that charlie was going to hit them with another conflict motion with those that were left.
So in agreement with CYA, he decided it would be better to have donna start fresh with new lawyers.
What happens with the costs for the defendant?
Surely they have a contract with the lawyers and that the lawyers are expected to be paid by Ms Adelson.
This would cause economical hardship for her.
Donna Adelson could retain a civil law attorney to sue Daniel Rashbaum for a partial return of payments. She has the time.
