Florida law looks like it needs 5 trials in a 5 year, all going south, for him to get that label.

TG's got dismissed for lack of prosecution, Apollo's was settled out of court, the DKF lawsuit was dismissed without prejudice by Mitchell himself, and Race's was dismissed for lack of jurisdiction. I'm not sure if the TG lawsuit counts as one, but even then I only see two bad lawsuits at most from your conditions.
Because it can take a lot to get labeled a vexatious litigant. A few lawsuits probably won't do it.

That phone call is the golden evidence for every defamation suit he has since it destroys his credibility and proves his character as a liar and a cheat, which is exactly what hes fighting against with his lawsuits
Good times. I just saw a video that is almost this good. A person created an almost perfect fake document, but with a different font... The problem, that font hadn't even been invented yet. Dude had a decent case and threw it out of the window. Edit: to clarify the document was supposed to be from 2000. The font used was created in 2004.
Yes but he didn't admit cheating. He only admitted intention to deceive to manipulate public opinion. So I'm not sure how strong that tape is. It seems like he is stalling his Mai lawsuit. No idea what his endgame is with all this. There must be some scam underlying things here. Financially none of this makes any sense. There must be a money source being overlooked that is the big secret.

It will devolve into a whole "if he would do this now, who's to say he hasnt before or won't again?" Which shatters any defamation directed towards him on the accusation of him being called a cheat. I think the real way to Beat Billy (when he’s not suing anyone) is just to act like we have no idea who he is, can’t sue us for that, and that shit would drive him nuts

This is pure speculation on my part, but from what I gathered, I think he did that after the reaction from suggesting the videos might have been edited. At least he publicly apologized to Dwayne about it.

I get he can't simply turn his back on his old man, but I've been in a similar situation with a serious accusation against my cousin. However, his response to the evidence against video tampering is "all we need to do is convince a jury", which tells us all we need to know.

Paul threatened him because California is a two-party consent state, ignoring the fact that Coffeezilla is in Texas (a one-party consent state) and federal courts will always defer to the more permissive state's law. I anticipate Billy's lawyer(s) will be sanctioned for bringing this suit.
@@keres993 yes but we don't know details. Like maybe they claimed he was traveling and not in Ohio at that time, etc. Then it's not easy to show its frivolous. Because you would need discovery to subpoena phone records, etc. From the video it sounds like his lawyers over complicated matters. Which probably makes it hard to prove frivolous. Nor sure.

I'd say David is pretty smart here for not saying much in the phone recording, because it got Bitchell's narcissism to manifest and speak out his mind to reveal his plans, while not saying anything himself that would land him in hot water

@@laggory He's already trying to do that in the lawsuit by alleging Race edited the recording to make it sound like he consented. Admittedly, it was just cropping a specific window of an hour-long call, but even without context Mitchell's "You ready?" is still rather ambiguous.
I love how insane his thought process in the call is. "If I have a tape where i don't cheat, everyone will be so embarrassed that they'll illegitimize the one where I did cheat"
He also seems to be overlooking the obvious: to make a recording of him doing it legitimately, he'd have to be able to do it legitimately. The whole reason he got his records revoked is because he has never been proven to have achieved those scores legitimately.
@@asteroidrules Billy can't see obvious things. Remember, people often walk around believing they can do something regardless of the probability or reasonableness of it. Some can believe it even after it has been proven false, and they are the only one who believes it. Their failures can even attenuate this belief and cause them to field more strategies with long odds.
The original lies almost certainly began with Billy telling someone he could do something, then successively failing to do it until he was driven to cheat. The cheating for him is just fulfilling something he believes he could do. To him it isn’t even cheating, it is a shortcut to getting everyone to agree with his correct reality.

Don't get me wrong, I love video games, and I understand why a world record score is a big deal, but at the end of the day it's never going to be worth how much Billy has lost in public opinion.
Yeah, and it isn't a very popular video game anymore either as far as retrogames go AFAIK. Like scores people care about tend to be speedrunning times where you beat a game with some ruleset as fast as possible. One of the most popular speedgames would be Ocarina of Time at this point, people love it. That and Mario 64.
Once people start with cheating/lying/deceiving, it’s common to go all the way with it. His ego simply won’t allow humility and decency to creep in, even though everybody can clearly see that he’s a shady dude. But you’re right: The decent thing to do is simply admit to his mistakes, and ask for forgiveness. (For all the ridiculous lawsuits)

I had a 'friend' like that. He just keeps talking, and you can never get a word in. And when I say I have to go, he keeps talking for ages. If I don't just hang up while he is talking, he just keeps going. I will say "I have to go, I'll talk to you later" like 5 times before the 'conversation' actually ends

The thing I never understood about Billy Mitchell is that he's actually pretty good at the games he's plays. He never had a reason to cheat, but he did it anyway and discredited himself.

When people lie about themselves enough times, they really do start to believe their own BS. I once knew a guy that did it to himself multiple times.
It starts with a "fake it 'til you make it" mentality, but in reality what happens is "fake it 'til you think you've made it, but inevitably get called out for being fake and have nothing but more fakery to fall back on".
Billy may get this or that detail wrong (such as the hardware he's playing on), but overall, he's better than everybody else, which makes him right regardless.

That's not how you prove you're not guilty.
You know what really gets me about Billy doing all these lawsuits over the fact that he cheated? It's that all the time he's wasting suing literally anyone and everyone on the planet that talks bad about him could've been spent trying to get back in everyone else's good graces. He could've just said "Yes, I cheated, and I'm sorry. But I'm coming clean and I'll redeem myself by both getting legitimate scores AND helping to prove other fakers as well should an incident like this come up". Would it erase what he did? Maybe not. But it would've been much more productive for the community as a whole AND towards Billy's own reputation if he had done this. Instead, he's out there suing anyone and everyone that even mentions his name without talking positively about him the entire time, thus contributing towards his negative reputation even further, ON TOP of him losing pretty much every single lawsuit that he brings forth. And all of this for...being held accountable for the fact that he cheated in a 40+ year old video game? It's not just stupid, it's also sad and pathetic

IDK. I'm also an Ohioan and I routinely record my phone calls, not because I expect to be dealing with con men, but because I don't trust my own memory and so I refer back to them if there's a commitment I made over the phone and I can't remember what I promised.

Billy does still play these games, he's just not as good as he says he is. Most expert DK and Pac-Man players can do perfect games on demand but Billy struggles to even that. He also does pretty poor in competetions for the most part.

There is SO much case law in the US reinforcing that the person recording the call answers to the laws of the state they're in. This will get thrown out in a heartbeat for lack of personal jurisdiction.
