    I’m a public speaker and stand up comic and I worked in 30+ states in 2019 and paid state income tax in any state in which I met the respective minimum threshold to do so. I don’t think that legally means I’m now a resident of all of those states? It just means my taxes are an unfathomable nightmare

      @@libbyannbest1723 it depends on how much I earned and what the requirements are for each state. But for each state I earned over a certain amount, yes I do. Luckily now my agency pays me so it’s all through California.

    For those who keep saying KJ's lawyer needs to tell her to shut up: I don't think it's safe to assume that they *haven't* told her to keep quiet. What they advise her to do and what she does are two different things. She strikes me as someone who has trouble censoring herself. Her lawyer can't duct tape her mouth. All an attorney can do is advise - they can't control a client.

    I don't know about the other site mentioned, but Ancestry absolutely does not have birth certificates for people Tati's age. They very specifically try to avoid holding records for people who are alive.

      This is true. And every state has different rules whether they release BC at all. The general rule is 70 years, I think. So even if a state releases BC, they can't be sooner than 70 years after the fact. I believe that's how I understand it. So Tati's BC will be unavailable to anyone other than herself or designated relative on certain cases.

      @@snowwhite7704 no, the analytics are from a certain time period in the past so she wouldn’t be able to go change those records simply by blocking or deleting people. Blocking and deleting would only show up the dates she blocked and deleted someone. She can most definitely show prove of the 0.7% or she wouldn’t have said it. Use your brain.

    I posted this on Twitter to Emily and Saltzy ... KJ has a lack of understanding on how Ancestry.com accesses its records. When you pull a record up, and are going to cite it (which all good researchers should be doing), it specifically lists where the original data came from; i.e., KJ states that she accessed "images" from Ancestry.com and therefore not from Washington State. However, she doesn't seem to understand that Ancestry ACCESSES the state level records that are digitized -- therefore, she retrieved records from Washington State.

      Barbara - that is not really true. It can be difficult to parse when you are thinking electronic documents and aren’t an IT nerd/work in IT as your profession. However if you think of it in terms of what it would be considered if it was a hard copy document it can be more clearly understood.
      For example, let’s say I was born in Virginia. And I have a copy of my Virginia birth certificate provided to me by DHeC/the state of Virginia. Years later I move away to attend college in Vermont. I provide the University of Vermont a copy of my Virginia birth certificate that they put in my student file in Burlington, Vermont. A year later, some new flashy scholarship is available- but only for students who were born in Virginia. So - when the admissions office in Vermont checks my student file and finds a copy of my Virginia birth certificate, they are actually accessing records in Vermont.... not Virginia...even though that document copy clearly states Certificate of Live Birth - State of Virginia.

    Are they intentionally ignoring that someone can own multiple homes and reside in them at different times? It sounds like shaky argument to me. Tati’s husband could also have been staying at one home for a time and tati in the other. And are they really claiming only the two people saltzy had statements from are the only Washington viewers? Sounds like an invitation to subpoena some analytics. The last thing that sounded fishy to me is kj’s claim she only looked at two websites for the personal information. There’s already video of her saying she’s looking everywhere and even asked for donations if people liked that she was digging into her families personal documents. I wonder if there is record of kj paying any courthouses for documents or any FOIA requests.

      I was getting a similar vibe - where they're arguing that Tati's social media posts of her in California are valid enough to prove she wasn't a WA resident, but then pictures on social of her in Washington...aren't valid enough to prove she was? It seems like they're kind of grasping at straws for the domicile argument in hopes the court just tosses it and that it discourages Tati and James from refiling in Minnesota

    KJ actually said she used Washington records to search for info on the Westbrook’s though... she said she went “above and beyond” the info usually available to the public and dug into them deeper than ever using other means during that one video public for all to see (if not deleted/privated 🙄) Does she not recall that everyone saw that clip to where she admits that fact?

      If she actively searched the records she would have to be there, get a friend to do it (who lives in Washington?)... or pay someone to research and get docs for her (costly I know as I have a family member who is a researcher)

      She’ll probably say that lied to impress her viewers, that she exaggerated her abilities to conduct thorough researches, she’s doesn’t really have the skills of a reporter. It’s all her UA-cam persona and none of it is fact. She’d probably get away with it because everyone who watches her knows how much she lies

    Why do I feel like there’s a belief having the jurisdiction issue “won”, by KJ implies this goes away ? Saltzy has already said IF the jurisdiction motion is granted the case WILL BE REFILED.
    Is KJ just going to keep having the case tossed from jurisdiction to jurisdiction ? that’s going to get expensive.

      IMO, she believes that she will win it, no matter where it is brought. She also believes that she can go after them for maliciously using the courts to try to keep her from "Telling Her Truth." She really does believe that she is a victim, and being "used as an example" to scare other channels from reporting on The Westbrooks.." I do think that she will win the Tati side, I am not sure if she will win the James side, but the thing I question the most is, if UA-cam will allow her to keep her channel as she has to testify under oath about potential actions that broke UA-cam TOS.

      Omg! I just made a comment yesterday saying that I always have to re-watch Emily’s videos because her voice is so relaxing to me that I doze off (and I’m an insomniac so I don’t fall asleep easily at all.)     My sister & her husband own 3 homes, MA, NH & FLA. They are residents of MA because they live 51% of the year in MA.

      I'd like to know how much that matters, it seems like a way to muddy the waters to me.
      Regardless of if she went to those states and looked at their records, phoned them or found them online, the information came from those states, so doesn't it amount to the same thing?
      I'm in the UK so I don't really know how it works with states or the US as a whole, but this just sounds like a diversion tactic to me.

      @@herbiehopkins Not necessarily. Going to the state to search OR using resources located in the state (like government servers) goes to the “purposeful availment” of the resources of the forum, granting jurisdiction. If it a 3rd party site that gathers information and stores it on a different server in a different state, KJ can better argue she did not avail herself of the resources of the state.
      It is nit picky, but that is the law for you. Also courts and legislatures are WAY behind on the interwebz stuff. ;)

    I’m thinking one aspect they haven’t touched on is not just the effect of WOACB’s videos but the many many videos that reported on what she said. The effect is much broader than her own channel audience. I mean that’s how I heard about it. I decided to purchase another brand of hair vitamin because of how horrible what I was hearing was. Even though I didn’t hear it directly from her, what she said totally affected my decision.

      It seems to me that the defence strategy here is to digress from the subject itself and to argue about jurisdiction and other things until Tati’s side gets tired of this. They would argue any jurisdiction: Washington, Minnesota, anything. I wonder what happened if Salzy claims it to be a federal case... Is it even possible to get this to a federal level?

      Kj also fails to mention halo in this response.. which is situated.. in Washington.
      Also, you can only get birth records from places where someone is born.. so theres that.
      Another thing to mention is that she basically admitted to using a website that is defamatory and unreliable.. you should read the ftc class action against mylife dot com - basically, even if you dont have any criminal records, it will say they do.. just so someone pays for their website.. the ftc class action lawsuit with the mylife is an interesting read. The fact she admitted to using that as a source, definitely shows that kj herself is not a credible source by any means on anything she says. 🤣

    As someone in a journalism major I think her understanding of "sources" is so bad. I cringed so hard at 45:11 that it honestly hurt. My VERY FIRST CLASS of journalism basics went over this. Sources aren't just people.

      THANK YOU. Sources can’t just be “unnamed” people” who she claims are close someone she’s talking about. If she knew anything about journalism, or writing in general, she would know that she bears the burden of proof. If she can’t cite her sources properly, then it’s reasonable for her audience to assume that she has no source, and that she made everything up. No citation = no source. If I can’t fact check it or verify it for myself, I have to assume it’s a lie 🤷🏻‍♀️

    The fact that they argued "Tati has social media posts in LA so she lives there, but these social media posts in Washington don't prove that she lives there". Like WHAT? If social media is "proof" in one it can't not be proof in another just because it doesn't suit your argument.

      Tati said in numerous videos about Sherman Oaks being her 'home' and where her office is. This was up to December 2019. She can't delete these videos but, there's lots of proof what Tati says, that she is in LA FULL TIME. She also made a video in late 2019 (December) saying she'd moved to Seattle. In April 2020, she'd got her stepson to mail her PR packages from their home in California , to Seattle. Tati has also used an L.A based P.O Box number for years

    It looks like KJ’s lawyer has been watching the “UA-cam Lawyers”. He’s just taking all the suggestions he has been listening to on UA-cam and applying it to his defense documents....Honestly, I think you and the other smart lawyers discussing this case online helps KJ’s case. It’s like she’s getting free advice and taking it...

Looking at the evidence that's been compiled we have Katie committing purjery, acting in contempt of a motion to preserve evidence, blatant defamatory statements coupled with selling her content as "facts based," openly supporting threats against the people involved in the lawsuit, and consistently waiving her own confidentiality rights throughout the process. None of that changes from Washington to California, and while that state is more lenient with journalism Katie would have to even prove that she's a "journalist" at all to be covered. With confirmed cases of her swaying opinions of previously paying customers of Halo with her statements that she did not specify as speculation I don't think she'll be half as protected as she thinks she is.
      Even then, this case work alone will ruin her. I can't imagine what her bill is going to be by the end of this.

      I'm thinking Mr. Brown either let KJ or a junior attorney write the first document (not sure why, though, makes no sense to me).
      Then, when things started happening - and I guess when he saw the word salad - he got involved and produced this document. However, he probably still let the incompetent person do some minor stuff - the number of lines is still not correct per judge's order, and KJ supplemental declaration has two typos that I could find with just a cursory reading. So, there is still some fuckery going on here.

    Ok so:
    1. KJ’s lawyer sounds much more competent in this motion than in anything else we’ve heard from him.
    2. Just because you own a house, doesn’t mean you live there. This happens to regular people too, not just rich people. (Real life example: the man who my hubs & I bought our house from had bought this house with the intention of retiring in it with his wife, but she got sick and died before they could move in, so the house sat empty for 6 years. He never lived here.)
    3. If “residence” and “domicile” are different, they need to be defined and used differently, not interchangeably.
    4. I still don’t believe KJ, though. Especially since she won’t SHUT THE FUCK UP when she’s in the middle of an active lawsuit.
    5. I want all the receipts!!! Let’s get to discovery y’all!!

      James Westbrook literally told the court he 'moved' to Washington in 2018 but, told another court he lived in California AFTER the fact........ seems a bit dodgy in my opinion. I don't suppose lying to the court will go down well. Financial records of day to day transactions will show where they lived ;)

My grandparents go to Florida in the winter so I send their packages to that address because that’s where they live. The rest of the year, they live in Minnesota and their packages and mail goes there. It’s like when you go to college. There are a lot of reasons why people live multiple places.

    Honestly, where I the judge that got his/her standing order ignored, again, I would dismissed the document altogether and grant jurisdiction just out of pettiness. I mean how hard can it be to write a document on 26 lines?
    That is saying to me, I don’t care about your rules cause I believe you have no business with this suit whatsoever and it would pissed me as hell

      I took a paralegal/legal assistant course 30 years ago, and when we were doing up these things, if we didn't do it according to the rules (which we had copies of, from the court), it would be rejected. Right down to if you forgot ONE memo. And if you kept making mistakes, you failed and the "court" threw whatever you'd screwed up on, out. (I hate civil for this reason lol much preferred legal research bc nerd, and wills & probate bc dead easy (pun intended 😋). Civil and family law are very very work/paperwork intensive and just... no. My brain can't handle that.)

    Tati has a video when she was in Seatle with James, and his son, was in their home in LA(I believe he still lives there) sent her mail. It even shows footage the son sent from the studio in the LA home but they were not there

    Tax prof comment: of course they paid tax to California. Likely many states. Washington not having income tax could go either way though, but I’m not a Washington expert. I do think saying “hey see they paid tax in California” is absurd, anyone who does business in California does. (Good reason to shift depreciation and expenses over so you don’t hit the minimum income for taxation)

    Looking for a birth certificate as she states she did, would require accessing Washington State Department of Health information. Another state is not going to have that information. Even ancestry has to get there data directly from the state the person was born or died in. She seems to think that because she used an intermediary website that is not in WA it meant she did use WA data, which I think is false because the data is coming directly from WA state even if she didn't go there herself.

    This reply actually came back with a compelling argument. The fruit salad of the last one was... something from a drama/tea perspective but this one gave me the legal argument that I was really interested in seeing play out. Ultimately, these are the kind of legal discussions that are worth having. One where both sides holds up their logical and grounded arguments and then the court can deliberate on which one holds the most value or is contextually the most applicable. I am not a sports person but I imagine its like in football, you want a "good" game where both teams play hard and play by the rules and its a close match in the end.     I watched Uncivil Laws stream and there were some things that he was thinking had more weight than I thought they would, which matches closer to your statements. It is interesting to see the diversity of opinion.
    Once again going over the limit? After the last time youd think Brown would have made more effort to toe the line and not piss the judge off by showing "hey I respect your standing order" (I'm not sure if it's been extended for everything, but even if it was it would be courteous to say "hey I screwed up last time but you can see here I'm taking it seriously"
    Honestly so much of this felt like a pathetic "gotcha" attempt, because they keep arguing against stuff stated by the plaintiffs like it came from a vacuum, even though it was in REPONSE to THEIR motion! Like sure maybe those arguments about jurisdiction would have held more weight if those arguments weren't literally in response to KJ saying "washington? Never heard of her". Like it felt they were trying to take all the context out what the plaintiffs' response was for.
    This response was vastly improved from the motion to dismiss, but it still left me riled because more than one argument they refute exist in that way because of their butchered motion to dismiss.

    I feel like the judge wouldn't go for this simply bc it would almost set a precedent of no accountability for your actions on the internet, since then anyone could argue against any jurisdiction on the basis of the internet being too broad to identify an intended recipient

      Exactly. With that in mind, it seems reasonable (to my non-lawyer mind) that they’re pursuing the case in Washington, because that is where the victim was living while she was being victimized, and KJ’s attorney hasn’t presented anything compelling about why any other state would be a better fit. Tati was in Washington, and KJ (allegedly) targeted, stalked, harassed, and defamed her while she was in Washington, period. Tati was able to provide proof that people in Washington were part of KJ’s audience, as well as active participants. KJ needs to give up the jurisdiction tantrum and focus on the other aspects of her case...

      Second this. I don’t know the back end of UA-cam, at all. Is it an option to enable auto captions?
      I completely understand why providing proper captioning isn’t always possible. It’s expensive or very time consuming. That you’re probably in a place of - big enough audience to have viewers that use captions, but not big enough for the cost of that to be sustainable.
      Auto captions aren’t the ideal, but they’re also good enough to be functional. I feel like they’ve gotten better in the last year ish. Especially when someone is clear spoken, auto captions are accurate enough that context clues fill in the gaps.

      Yes please! I'm hard of hearing since birth. I can't understand anything at all without the captions. :( I read lips too, but still miss a lot. But i think when it's live they're not aval.       I thumbs up the comment hoping you might get some more answers but it seems like videos that are longer then 15 minutes could take hours for captions to generate with some longer videos taking a half day. (This is a Google answer cause I was curious)

    Hi, from Italy here. One thing I don't understand is how are birth certificates available to everyone in the US. If I want a birth certificate of someone that is not me, here in Italy, I have to have in my possession a written paper signed by that person that I am authorized to do so together with an I.D. document of said person. The clerk that will give me the birth certificate will fill up and file away a template showing my details, I.D, and date together with the authorization paper and copy of the other person's I.D. That is a measure to protect the personal data of citizens, to avoid stolen identities, to avoid people discovering very private things about somebody else's life etc. This boggles me.

      Here in the U.S., you can’t actually go get an official birth certificate for anyone...it has to be your own BC, or for someone you’re immediately related to (such as your own minor child). Some states are extremely restrictive about this; others are more flexible, but they still won’t give out an official birth certificate to a stranger. They may release a non-official birth record with limited information, but it will not be an official BC that could be used as proof of ID.

      Same here in Australia. I have to apply for mine online because I live in another state of Australia than I was born in, but I have to provide ID and my parents details all the legal shit.. and have to do a electronic signature. Nobody can get my birth certificate.. I mean, kj won't ever find mine. She doesnt have any of my family's information to fill out the paperwork let alone the 100 points of ID needed.

      You need the two forms of ID, fill paperwork out, and then get two copies.
      I lost mine so I had to replace it. Same for SS card.

    It is not telling that they didn't not mention if they had CA taxes in the year to whether they lived in CA. If they had work in CA, they most likely do have wages and taxes to CA. But it doesn't mean they lived there.
    You can have some checks recorded as living in the state and working in the same state and then part of the year reported as no longer living and paying taxes, when you move away.
    If you live in WA and work in CA, CA wants your taxes.

    I don’t understand how this is relevant, it has to be heard somewhere. I live in Australia and I’m sure the majority of the Ytube audience is outside Washington however, where could they hear this case when there is no global court and why is this such an issue to KJ argument.

      Also a fellow Aussie, hope you are both staying safe atm x. My understanding is that the different states have slightly different laws, so one might be more favourable to defendants. Perhaps it's just a shot in the dark at the moment and part of a bigger strategy? But, I agree with both of you, I cannot see the logic in it!
