      I imagine their going the approach of attacking his character to make views look at it as being not true, if their successful, it might not matter if the suit goes through at all as the public with already have a soiled view of him and not trust his comments. A similar thing happened with mcdonalds, when we had the "silly lady putting coffee in her lap and suing them for having hot coffee." completely glossing over the fact that regardless of the conditions, she received third degree burns from something thats meant to be ingested, which is an absurdly unsafe practice, but they get to continue without a care because the case got put in such a bad light.

      They are trying to pressure him to take down the videos, the lawsuit is there to threaten him financially and the smear campaign they are carrying out is to make him toxic so nobody wants to associate with him. Think about it like this you wouldn't want to hire someone accused of being a criminal even though they are perfect for the job. It's as he says "filthy" and their would be no point suing them cause Diamond company's have entire legal departments that would find ways to drag a lawsuit out for years in the courts which would ruin him financially with only a slight possibility of him actually winning.

      Trinity Joseph Like he said in the video, it's not about winning the lawsuit, it's about drowning him with legal fees and forcing him to bend over and take it up the ass. Most companies who sue like this can afford to, whilst the ones being sued can barely afford to defend themselves, and that's what's so sketchy about it. Even if he wins the case, he'll take a hit financially, and that's their goal.

    Diamonds are supposed to be so expensive because they are rare, but they are NOT rare. The global supply is controlled to be artificially scarce. The words "gang" and "cartel" are synonyms for "syndicate." DeBeers, Alrosa, RioTinto, and Dominion , are called syndicates for a reason. Dominion is the most honest in the bunch. With a name like that they aren't even trying to hide their true nature and ambition. Seriously people, don't give your money to criminals.. Don't buy diamonds. No matter where you think they came from, they are shady as all get out.

    I am a Gemologist with a degree from GIA, as a former diamond wholesaler, and as a current retail jeweler, and a rational human, I am glad he was able to bring this to light. Even if he is in the business , educating the public is in the best interest of the consumer and the industry. These large corporations have walked all over the real crafts people and honest family business owners for years. They have used less than reputable business tactics to make sales. The idea that you can track a diamond , without digging from the ground yourself, polishing it your self, then certifying it yourself, is utterly ridiculous. The Idea that your local mom and pop jeweler, or even a big company like Jareds, could even sell you a conflict diamond from an African drug lord is just about as ridiculous. Intentionally or not. Those stones have almost a zero chance of making it back to a retail jewelry market. Again if you wanted to buy a blood diamond , and know that it was a blood diamond, you would actually need to be handed the stone from someone directly within the conflict. If you don't like the idea that you can't track a diamonds origin then buy a lab grown diamond, a moissonite, a sapphire , or any other of the thousands of alternatives to diamond. I hope that this continues to gain attention and helps educate the public, If you want a diamond buy a diamond, if you want to donate to charity donate to charity, they are different transactions. If you want to know what you are buying source a local family owned business with jewelers and gemologist on site. I hope Brilliant earth and Blue Nile take huge hits from this. They have misled the public about their products they should be accountable, regardless of who blew the whistle.

      Elle P he is saying if you live in a country that regulates the sale of diamonds, such as Canada, the US, the EU countries, etc. Then there is no chance you will buy a blood diamond. Da Beers has the diamond market in its pocket, and controls the flow of diamonds. They would never allow competitors to flood the market with cheaper, blood diamonds, thus devaluing their diamonds. So they have worked with our countries legislation under the guise of "Fair and Ethical trade standards", to make any diamond that isn't from an "approved mine" illegal. Truth is, for all we know Da Beers could be buying up Blood diamonds, and the launder them to call them clean. But we would have no way to prove that true, just as they have no way to prove it's not true. Much like how you can't really track a head of lettuce in the supermarket, back to one specific farm, so too is a diamond impossible to track from start to finish.

    That diamond story makes me livid. Since when do companies sue people who call out their shady practices?? And even if they do, how can those charges be taken seriously, considering they have nothing to do with the issue at hand.       Also I don't like Trump but the only thing I disagree with in Pakistan is the lack of nation building. Personally I'd put most of my focus on the nation building aspect because the reason conditions in the middle East are so bad is because of the lack of political stability. Honestly at this point it feels like the best solution would be to redraw some political lines to correspond with sunni/shite divisions. Being in foreign wars is against my personal views but there's only so much that can be done in this situation without further destabilizing the region

    If you like the look of diamonds but don't want the conflict, jacked up monopoly price, or the hassle to figure out where your shit came from, look into moissanite. They are absolutely GORGEOUS stones that are almost as hard as diamonds and are all created, not mined, so you can be sure nobody is dying for them. A ring that would cost ~$20,000 as a diamond would cost around $4000 with moissanite, and they don't cloud, dull or scratch like CZ. There are alternatives out there, and the only real way to break the conflict and monopoly cycle De Beers has on diamonds is to not buy them.

      This is true, but they still created and perpetuate the idea that diamonds are THE stone for an engagement ring, and they're still making money hand over foot because of it. I suppose what I really wanted to say was, break the idea that only diamonds will do for this purpose and start opening people up to the idea of other stones being equal, not inferior.

      The issue is the way he went about exposing them clearly opens him up for a defamation law suit because he made positive, affirmative claims such as "They have defrauded their consumer base" while the way they have made these accusations is not the same. While the company said that he is "affiliated" with these illegal/unsavory practices which is technically, by the thinnest legal definitions, correct and therefore not defamation. So he has no grounds to counter their claims other than the truth, but our news media is a joke and they don't bother to double check anything and run the most readily available story. The diamond company likely made sure their's was the most readily available and probably provided copies of the law suit anonymously to "news" agencies across the company to frame the narrative in their favor. If only people like those that work for the Daily News and New York Post weren't incompetent fools and were capable of thinking for themselves long enough to do their jobs properly, we wouldn't have issues like this.

      I’m not so sure, if Brilliant Earth had been completely successful surely they would have bragged about it on their blog, like they did when they first filed the case. Because the thing is, brilliant earth actually have a fuck load to loose here, if his claims are proven to be correct, It will hurt their brand sure, but more importantly it opens them up to what would be a Fait accompli class action lawsuit from previous customers who they duped, which would certainly sink them.
      There is a small reddit thread discussing the story where somebody had been keeping track of the court documents, and in his opinion Jacob had a strong lawyer and the case appeared to be going in his favour before they mutually agreed to adjourn, basically the judge was asking them to provide documentation to prove how their process of guaranteeing a stones origin worked, and they didn’t seem able to do so. To me it seems more likely their case was ultimately a bluff and they were hoping he wouldn’t take it to trial, and then when things started to crumble they offered him a nice payout in return for signing a comprehensive NDA just to make the whole thing go away.

Also there's irony in that newspaper calling him a psuedo-journalist, here's what I have to say to you, Mr. Legitimate Journalist, legitimate journalists don't pick up lines from the defamation lawsuit of a company in a shit soup trying to silence the investigator and pass them off as facts.     I find the whole concept of the diamond jewlery industry confusing. It's a product with fabricated values from companies that use abusive and unethical mining practices, yet people are willing to go into debt for them. At least with something like clothing, food, cars, smartphones, etc they can be extreamly overpriced but they still have inherit value in actual usefulness. Diamonds are shiny rocks...

      Yes, JEWELRY grade diamonds have artificial value, but that doesn't make them useless. Industrial grade diamonds have plenty of applications.

    This is so sad and common which makes it even sadder. The awful thing is based on his version of events- he not only has the "legal high ground ", but totally beyond implication of any violations under the law period (and certainly holds the more ethical position). If he were to pursue action against any large company (using only the same sort of weak arguments as they have employed to his discredit) the case would probably be tossed out, unless concrete evidence could be presented. Sadly, an almost equally dismissive response would most likely be given had he brought his definitive findings to trial, or if he pursued the clearly justifiable course from here and filed a defamation counter suit. Why is this? You already said it. He's the little guy, more importantly, the guy with less money. This ultimately comes back to greed and corruption by some individual or party within the system, but it is in my opinion an unavoidable drawback to our economic and justice systems. It also gives the company the advantage of being able to throw entirely baseless legal claims at him, slander him in the media without reproach, effectively discrediting him or frightening him into silence, and if necessary, taking away his career, depleting his finances - whatever they can to dismantle the platform from which he can attack them or even defend himself. However, there is also a powerful benefit afforded the righteous individual or party in situations like this, and its become even more powerful with the internet age. "Word of mouth". Its the free spread of ideas that's available as well as a general awareness from we who live in this society. It takes some faith in society particularly the American public (sometimes ill-deserved and not readily given) to see through the corporate propaganda and tell others of the real crime being committed. We are (most of us) well practiced in siphoning truth from the media and seeing past draperies of corporate dollars, particularly those with the most active and powerful voice on the web.
    I'm taking all of this from anecdotal experiences and of course, sadly there are many times greed and cash will win out or buy out over the rest of us. There are also times that the general public will blindly swallow a tale like the one carefully woven and propagandized by this company.
    But I'm betting if you're reading this or watching this video, you never would've have bought it to begin with. Certainly if I see a company- ANY company - attacking a name I've never even heard before by attacking their character and bringing no attention to the actual alleged actions of that person, I find instant credibility in that person's position. Why would they need to research and spend money preparing a campaign and litigation against some "little guy" (who made a video, they aren't defending against his suit) if his claims were false. Now they've stacked one despicable action onto another and instead of the original thousands who saw his claims and may or may not have taken them seriously- everyone who watches Phil has now seen this (as well as viewers of other online/independent media) and putting out in the mainstream media which is trusted less and less today is just gonna lead more and more people here, where the truth will ultimately prevail.
    Now we not only see their dishonest, exploitative business practices unquestionably proven - but also the despicable attempt to destroy the career and potentially life of the customer who wanted to being attention to their wrongdoing. He's already vindicated as far as the public is concerned.
    We can only hope the justice system will make that same determination or that this surge of attention will bring the support he needs to effectively fight them off- regardless though, Brilliant Earth did irrevocable damage to their own image with this suit and the longer it drags on, the more it will only hurt them. They're the only entity that still has a stake in this fight really.

      Agreed. As a second-hand jewelry dealer, he already has some experience in the industry. It's also in his (and other second-hand resellers) best interest to buy second-hand jewels at the best price he can negotiate, and people coming to him with BE diamonds should know why he won't give them a premium price for the diamonds if they are not legit conflict free.

      I was so into this company because I didn't want a diamond someday that was sourced unethically until I read reviews how their rings actually fall apart. I do believe this is a scam feeding off of people's real beliefs that they are doing something good by buying a diamond that didn't have anyone in a third world country suffering in the diamond industry.

    My wife and I never buy diamonds for this exact reason. This is nothing new. All of this information he is talking about has been around for years and years and people just ignore it. The entire diamond industry is a completely false industry. They manipulate the supply to justify the insane cost of diamonds.

      You can buy what ever you want. My wife chose Moissanite. The idea of a diamond for marriage was just a marketing scheme by the diamond companies to sell their worthless blood diamonds. Do some research online or checkout Adam ruins everything on youtube. He did a great piece on it. cheers.

      Yep diamond rings is a very recent development in our society created by the diamond cartels. It is fairly well documented and you can find several videos about it here on youtube. The whole gem stone trade is extremely shady and they create false demand by limiting supplies and hyper inflating prices. Despite what countless ads and TV commercials want you to think a diamond has no more value than any other rock you pick up off the road.

      Sagaris 380 yup if you think you can sell that diamond for what you paid for it think again. If you're lucky you'll get half to one third the price you paid. Depending on the ring the precious metal in the setting may be worth more. If you really care about not buying conflict diamonds don't buy any diamond there are many alternatives.

      Of course diamond jewelry won't sell for nearly what you bought it for. Fine jewelry has very high markups over cost, and even after that, why would a place buy your diamond jewelry if it can just go to it's supplier for the same thing for a similar cost? This isn't exclusive to diamonds.

    My take on the leaked celebrity nudes: though it may be inherently dangerous to have these images saved electronically, these PEOPLE (let's not forget, please) STILL have the right to their privacy for these images. Put it this way; if these were old Poloroid pictures taken and someone broke into one of the celebrities' house, stole the photos, and began distributing them, I believe we would all be in an outrage at the invasion of privacy. In my eyes, the two situations are the same. As a person who has been the target of someone breaking into my house and stealing personal information/possessions, I can attest to the fright and hopelessness that one can feel.

    If you can't own up to somebody making claims about your business and respond to it with a defamation lawsuit, deep digging into their past (drugs, sex?) and humiliating them through the media as a 'drug addict', then there is no way your company is NOT in the wrong. This right here is a sinking ship firing bullets at a ferry, not for justice but for revenge. They're in the wrong, I don't even need to point my finger at it, they are just wrong. No righteous company would use their influence to ruin the life of somebody who makes claims about their business unless they have something to hide.

    As requested, some clarity on my position: I did not vote for Trump. I am staunchly in between our two parties (closer to Libertarian, though I still disagree with a few parts of their platform).
    In this case, I get the feeling that Trump is listening to his military advisers and changing his previously uniformed stance and changing it based on information from those advisers (hopefully the ones who have experience with Afghanistan). So I actually feel okay with this decision. As the daughter of a vet, I never like the idea of endless engagement or nation building as it can be costly (both to the soldiers themselves, their families and to taxpayers) but I'm not a military strategist. We've made our bed in Afghanistan so now we have to deal with that.
    I'm just heartened to see Trump listening to advisers and not stupidly sticking to a position when he gets new information and advice from experts. Frankly, he needs to do that a LOT more in my opinion. Yes, there is a "swamp" in Washington, but there are also people that know a hell of a lot more than Trump.

    I hate the story about the Canadian diamonds. The fact that they are posting it as a SMEAR CAMPAIGN feels ridiculous to me, and the claims they have against him seem to be totally fake. It didn't feel like he was lying about buying the domain names. This shit sucks and its BAD JOURNALISM. Nobody hunted for the facts or truth, which would have been a WAY bigger story. They just took the easy route to getting a story to put in the paper. but picture it: BIG DIAMOND COMPANY TRIES TO SAVE FACE BY SMEARING A NO-NAME INVESTIGATOR WHO SEEMS TO HAVE FOUND OUT THE TRUTH. I would read that headline.

    Almost bought my ring from Brilliant Earth. Hated the idea of blood diamonds, and we asked them to use a lab-created moissanite stone. They added hundreds of dollars in fees but wouldn't tell us what they were actually charging us for. So we had a local jeweler craft a ring reminiscent of one of their leafy designs and it turned out great with the moissanite. Glad we didn't go with BE. They are still disingenuous. Look into moissanite. Spend $200 for a half carat- more brilliance, luster, less impurities, and nearly the same hardness.

    Having his own diamond business shouldn't take away from the argument or make his videos ads. If anything it shows him in a better light becuase he's actually has an alternative to buying diamonds. It's like if a guy made a video about puppy farms and had a link for his puppy adoption business. You wouldn't say "oh this guy just wants to make money selling dogs".

    On the celebrity photo hack: Having your phone or data hacked and your private files or photo's stolen, and given to strangers... that is awful. The rules that apply to one of us should apply to all of us. If this was done to a loved one, we would be pissed. That shouldn't change because the person is attractive or famous. This isn't the part of their life they agreed to share. Someone violated their privacy, and shared something that was private. That is reprehensible.

    As a Canadian I can confirm to you that, that diamond is not Canadian. Jenko, Ekati, Diavik, Snap Lake, Gancho Kue, Chidliak, and Redard is where diamonds come from in Canada. As a person from Canada I can tell you that if: they don't give you a certificate from one of those places confirming it's a Canadian diamond. It's most likely not a Canadian diamond.

    there are many articles on the www.gia.edu website that state that there is no way to trace the origin of a cut and facet diamond. there is nothing in the chemistry nor in the inclusions of diamonds that are region specific. In the US, and any country that actively participates in the Kimberley Process, requires a KPC, (Kimberley Process Certification) to document the importation and exportation of rough diamonds. There is a separate system at which any person or company that deals in diamonds can voluntarily participate in, System of Warranties, which would require them to include a statement on their invoices that reflects that to the best of their knowledge the stones they are selling 'conflict free'. lastly, the gia report that was issued for the stone used in this case was a diamond dossier, which automatically inscribes the diamond with the gia report number. so even if he submitted it blindly, countless times, the stone would be identified and the laboratory would then issue and updated report reflecting the current date.

    I think that now that we are all educated enough to call bullshit on marketing techniques, we should stop throwing our money away on fucking rocks. Like i get it, they look pretty, but so do plenty of other rocks that are a million times cheaper. I mean just take 5 minutes to read the history of diamonds and why they became so valuable and you may realize how stupid it is to blow thousands on them. That being said, I am inclined to believe this guy simply for the sketchy ass lawsuit based on accusations about him personally. that is grimy, and even if they are 100% honest about getting their diamonds from canada, they are sketchy grimy fucks for going to that level to sue him. And why would they stoop so low if they had legitimate arguments about the actual points the guy made? thats like a child calling someone stupid because they can't think of a rebuttal to an argument.

If he had no legitimate claims, they either would've ignored it all together or sued him for defamation; the lawsuit would entail the defamatory statements that the defendant made, and why they were defamatory. Rather, they ignored his allegations, and attacked his character. Why attack his character, rather than confront the actual problem? Simple, to destroy his credibility; no one will buy into the words of a "Drug Lord Pimp."
      If only people knew about the debeers campaign in the 1900's in order to sell worthless rocks to the masses. The diamond industry is entirely a scam altogether with the way they control the supply of diamonds, and only release an appropriate amount to meet demand every year. Who in their right minds would drop several thousands of dollars on a damn rock filled with compressed carbon. Millennials are getting married less in todays day and age, so who knows; we just might see the scam that is the wedding and diamond industry get totally and utterly wiped from existence within our generation.

      I work for a jewelry company and I can tell you with absolutely certainty: the diamond has VERY little value. We charge you $75 to get a small side stone replaced in your band, the shop charges us $10. They are real diamonds, but diamonds have no value. None. Its all made up.

    This saddens me as I was looking into brilliant earth for rings solely for the reason they were "no conflict diamonds" (and gorgeous too). It's discouraging hearing it's impossible to track a diamonds origin. Makes you wonder what companies you can trust...

    I don't see why Jacob shouldn't be allowed to expose shitty business practices just because he's in the industry. His knowledge of diamonds and where they come from is what allowed him to discover and research the issue.
    Its disgusting that the company used so many false claims to attack him, and disgusting that the media reported them as truths rather than doing research.

    Phil, I was actually in the market for a diamond when I saw this video that Jacob made and it totally changed my perception of what I was purchasing. I asked more questions than I would have normally when I went to the jewelers and ultimately decided that since I couldn't tell what region a natural diamond is from to buy a "Lab Created" diamond. It comes with the etched "Lab Made in the USA" insignia on the diamond (can't be seen with the naked eye), was better quality than the natural diamond I was looking at, and about $200 less because they aren't as well known. The process is the exact same as the one nature uses, just in a speedier fashion. Without seeing the insignia, a jeweler couldn't tell the difference between lab and natural, and more importantly it gave me peace of mind knowing exactly where it was from. I appreciate Jacob informing the public about such a world wide scam and think Brilliant Earth is really Scum of the Earth for attacking his character instead of attacking his claims with proof. Good story and good luck to Jacob!

      +Not Blazio i've seen a few people with moisannite rings and they are colourless, perhaps take another look from a different source. there are yellowish diamonds as well but its due to contaminants (similar to moissanite)

    The last point on the Jacob story happens big-time in my industry. His competitors are attempting to outperform him through lying and cheating.     I've been looking on specifically brilliant earth and blue Nile for my engagement ring. I HAD the perfect ring picked out. Now I feel more educated and will be looking deeper into diamond history before purchasing anything. It's so troubling because what I thought were ethically sourced rings could have a history behind them that I could never know. An engagement is supposed to be a special moment, I don't want to feel guilty on that day.

    Its crazy to believe people actually value diamonds, the represent nothing of true value, they are an infinite amount, they aren't neccesarily hard to come by, the aren't a major recource, the don't make electicity, or fuel anything. But marketing makes it seem like there "special".

      i looked up the answer, it happens to be that the value of diamonda are more about where they come from. natrual diamonds are valuable, synthetic are not. so in this story, if those diamonds they're selling arent where they came from, their price will flux dramatically

    What gets me about the blood diamond story is the news papers! How can they just also slander the poor guy when clearly not looking into the whole situation.This is bullshit! How can news papers, actual journalists not look too much into the story as to why this huge company is going after some small guy? How can someone think that this big scandal won't sell more newspapers than some guy gets sued. Is it because of avoiding laws suets! Surly the bad press from this situation from a company view point put them of suing a newspaper if they decided to do so.

    On the leaked nudes: While I do think you have to accept the risks when sending nude photos, it doesn't mean you consent to them being shown to the public. They are private images intended to be seen by few. It'd be different if people posted their nudes on their instagrams but they don't and for good reason (other than the terms banning it). It's still an invasion of privacy.
    Edit: There's a risk of them being shared [by the person they're sent to] which is simply a trust issue. When hacks like these happen, no one is at fault aside from the hacker.

Like yes they are at a higher risk for people stealing their nudes but it doesn't mean it's their fault for taking the risk anyways. Diamonds are not that rare; the prices are driven way up by the handful of companies that dominate the entire industry. A tiny shiny rock is not worth a car or a house...

    Brilliant Earth could end all speculation and doubt about this issue by simply *showing how one tracks a diamond's actual origin.* If it can really be done, it shouldn't be a huge secret as to how. Since they will not even defend themselves to this extent, I have to question everything else from them. Worth cannot be called a competitor because he isn't one - he does not sell new diamonds; it would be like saying I compete with JC Penney because I sell one of their old blouses at my rummage sale or on eBay. The BS with domain names is exactly that. Plenty of people have bought huge chunks of domain names to resell them with no intention of ever using them, but even if he were currently using them for the businesses that Brilliant Earth accuses him of being involved in, it *still* has absolutely nothing to do with whether or not he is defaming them. They are in fact defaming *him* and counting on the fact that their wealth far outweighs his to protect them. I hope he is able to stick to his guns and beats the pants off B.E. in court and gets to file and win a countersuit to boot. Of course, that's how our legal system should work, but too often does not. Thank you for covering this story.

    I think no matter the motivation he had for making the "exposed" videos, the fact a large company like Brilliant Earth is attempting to discredit the 'pseudo-journalist' not only tries to cover up what he discovered, but continues the narrative that he is not credible. It's entirely possible he originally did this for profit on his website service, but that shouldn't matter. If you, Phil, tried to uncover a potential scandal in a large news agency solely for views, that doesn't negate the scandal committed. But hey, that's my opinion 🤷‍♂️

      The difference here is that Obama played with celebrities and Trump uses Golf to get work done. Almost every golf partner has been a person working for our government or another government and that is not uncommon at his level.     I have two ways to look at the Trump situation; 1) He had no clue the reality of the situation when he campaigned and said whatever sounded good or 2) I'm actually impressed that he admitted he made a mistake in judgement, researched it, and changed his policy due to strong evidence against his initial view. Not many politicians would ever do that, and instead would twist the narrative to make it seem like they always believed this.

    I like Jacob's video, he goes in depth and does a lot of background research and cleanly and plainly lays it out. He doesn't attack them as some people would, he's not saying they're supporting blood diamonds, he's just saying they can't claim to know the source of the diamonds when they don't.
    He covered it all with a very level head, and I appreciate that. Sadly the companies response to real criticism isn't surprising, but I hope he counter-sues them and absolutely annihilates Brilliant Earth. Thanks for using your platform to shine some light in the little guys Phil, I for one appreciate it.

In no world is you being a klutz and spilling coffee on yourself the responsibility of the people who made the coffee. The woman won that case sadly, and then rightfully a few years later it was overturned and the woman was ordered to return every last cent.

    Watching this, I am thniking it would be really cool to have a monthly show rounding up what happened with stories you reported on a year or two ago. You have such a huge library, it would be a neat reminder for us old timers, and I'm sure there are some gems with how messy real life can be.
