    Letting him resign doesn't solve the problem. Lawsuits don't solve the problem. Making cops personally and criminally liable solves the problem. I don't want to hear about resignations and lawsuits. I want to hear about charges and jail time.

      Ending qualified immunity is a step in the right direction. Also, requiring all sworn officers to have a $5-10 million in liability insurance will help close the loop on predatory policing for profit criminal enterprises!
      State licensed professions require liability insurance &/or bonds, why not State licensed police?!
      Pretty sure many cops (aka bad cops) would be found to be uninsurable..!

      @@pwilly_1 2 words "Police Union" no politician will pass anything against the police union. If the PU doesn't endorse you it is very hard to get elected. They need to get rid of all government employee unions. Police, Teacher all of them.

      If ever you are falsely arrested or accused of something you didn't do and in up in court make sure you leave with your expungement papers.

      I'm glad you mentioned that. One of the people in this video dealt with a pretty severe consequence of the arrest. It was the guy who said that they were going to take the department to federal court. The man was a pilot. I'll get to the consequences he faced later.
      He was pulled over because he slowed down to read a street sign because he wasn't sure where he was going, and that makes sense because we all know street signs are sometimes printed small. The officer pulled him over for that. The man asserted his rights and remained silent. The officer told him he was "driving erratically" and there was an "overwhelming scent of alcohol", and that by driving on Colorado roads, he automatically consented to a breathalyzer or a series of tests. So the man took a breathalyzer and blew a 0.0. The officer THEN said "well, you must be on SOMETHING because of your erratic driving" so the officer determined he was on something other than alcohol. But the "probably cause" the officer used to conduct the breath test, and to turn it into a DUI stop, was "There is an overwhelming smell of alcohol." Sooooo..... if the probable cause was a scent of alcohol, and the man demonstrated he was NOT under the influence, how come it was able to be turned into a "you must be on some other sort of drugs" if the original probable cause was null after he blew a 0.0? I guess if you are a corrupt cop working for a corrupt department, you can just ignore that logic.
      The officer took him to jail and handed him a form indicating that he had to give a blood sample to test for alcohol or drugs. The man asked if he could read the form before signing it. The officer tried to force him to sign it without reading it. As you would expect, the bodycam was muted during this exchange. The man never refused to give blood, but simply stated that he wanted to read the form that he was told he had to sign. The officer tried to turn that into resisting.
      Anyway, remember how I mentioned the man was an airline pilot? The arrest for DUI caused him to lose his pilots license with the FAA. The outcome of the DUI case took MONTHS to resolve. Someone who has a job, such as pilot, where they are entrusted with hundreds/thousands of lives have to be trusted. Therefore an arrest for DUI calls into question this mans character so he was investigated. The small hint that this man can't be trusted causes alarm with the FAA. The cases being dismissed doesn't automatically dispell the FAA investigation.
      Fortunately, the man was awarded $400K for this. HOWEVER, it was THE SECOND TIME. He literally had this happen TWICE in Colorado. It turns out that the police departments, and the officers within them, all compete with one another for the most DUI arrests. That's why these false arrests keep happening there. Organizations like Mothers Against Drunk Driving encourage it because they try to paint a picture that it will get more drunks off the road, but they ignore the fact that innocent sober people will be swept up due to the corrupt system. And according to my link below, officers would often ignore other calls to pursue DUI arrests.

    When a cop lies on a report in order to arrest and charge a person, that cop should be fired without pay or pension and charged with perjury. They should also be charged with kidnapping.

      I'm not a big fan of the death penalty. But IF we are going to use it, I think police officers blatantly lying and framing people should be on the list. Knowingly doing something to someone that could result in them losing their livelihood or even their kids in some instances is one of the worst things I think you can do to another human being.

      7. Obstruction and interfering = psycho babble for my way no matter what
      8. Traffic violation = theft by deception

    This just happened to me....i was arrested and taken to jail spent 10k on a lawyer and had nothing in my system. ..will be sue them soon

    This is one of many. The thing that’s a slap in the face is that the officer faces no accountability at all. Officers should not be allowed to resign until and only then, when the investigation is complete. Muting the cameras should be considered tampering with evidence and should be made a termination offense. PERIOD!!

    Here is why this has gotten as far as it did and why all of a sudden the police are "investigating" and why Haferman was allowed to resign before being fired.
    1: Police officers get monetary and prize rewards for making DUI arrests from M.A.D.D. The more arrests they make, the more prizes and money they get.
    2: Police departments get prize and monetary rewards for their officers making DUI arrests from M.A.D.D. The more cops that make DUI arrests in a department the more money and prizes the department gets.
    3: They did not really investigate officers for making fake DUI arrests because they did not want to lose the prize and monetary rewards they had already received from M.A.D.D.
    4: Haferman was allowed to resign instead of being fired because it was probably in his union contract with the department.
    5: Since Haferman was allowed to resign instead of being fired now the union will get him a job with another department and the illegal arrests will continue somewhere else.
    The take away from this?
    As long as M.A.D.D. is allowed to reward cops and departments with prize and monetary rewards this cycle of illegal DUI arrests will continue.
    Also, as long as the police union exists bad cops will keep being bad cops as long as they can continue to get jobs at other departments thanks to the union.

      There are some similarities regarding all the fishing expeditions they do for ID. They also get monetary rewards for arresting people with outstanding warrants. So they love to ask for ID and make up any excuse in their head to force people to give up their rights and hand over ID, even if that requires unlawfully arresting someone for not providing it.

      As bad as drinking and driving was in the past, DUI enforcement has now gone overboard. Now cops will arrest people for DUI without any evidence because they are incentivized to make as many DUI arrest as possible as it's a huge money maker for the state. And MADD rewards police departments for making as many DUI arrests as possible (even if they arrest people who haven't been drinking) because they think this will scare the public. It's become ridiculous in how many innocent people are arrested for DUI. Meanwhile, there's been countless stories of violent criminals being let out of prison, committing violent crimes, being let go again, and then committing even more violent crimes. There is something seriously wrong with this system.

    Allow the victim to take a "blood draw" or the arresting officer and all who signed off on this kidnapping. Allow the victim to decide how much blood to draw, up to and including "all of it". Let the victim decide justice.

    Resignation should never be used to avoid criminal or civil charges. I'm sure the PD is happy he is no longer working there, but I'm sure he will show u at a neighboring force. Not only lawsuits, but charges should apply!!!!

    Muting body camera should come under tampering with evidence . . . it's preposterous that we have these evidential tools that an officer can manipulate on scene . . . why have they even got a mute button in the first place ? If information needs to be redacted then it should be done after the fact, the evidence should be left intact, and if a review process supports redacting portions then it should be done at that point.

      Let them resign as we can't force people to work for someone...but the state should put a hold on the cops certification and make it so they can't go elsewhere until the review is done.

      There is no need for that. The footage of every cop should be recovered every single day, and can be removed by a supervisor.
      If cops don’t like that? Too bad. Cops are the problem.

    The clean breath/blood tests proved that the cop was (at best) mistaken or (at worst) lying when he claimed to smell "an overwhelming odor of alcohol".

    Sarah Shulkie is the same attorney that represented Karen Gardner and her family when the cops broke her shoulder. If anyone has been violated by this police department PLEASE come forward. I personally know someone that lost a full ride scholarship because of a cop that lied about a DUI. Took over a year and thousands of dollars to get it resolved.

    It's astonishing that a cop could ever get away with something like that. It's kidnapping and torture basically. You're taking an innocent person and putting them in jail where who knows what could happen to them with some of the scumbags in there. That cop who did this should face SIGNIFICANT prison time for what he did...I'm talking over 10 years. I hope all those victims get a big payout for this and every city's police force across the country pays attention. Don't give rewards to cops for making DUI arrests.

    Let’s review police punishments: 1. Promotion to sergeant or lieutenant. 2. Resign so they can get a job in the next town or state over. 3. Retire with full pension and benefits. 4. Paid suspension with full benefits. What is really bizarre is that the police chief will watch the same report and see himself and the corrupt officer as the victim. They’re not even capable of intelligent or reasonable thought. They only have the one goal of hurting people whenever and however they can.

    Cops get "overtime" when you go to court and they have to appear. For a 10-15 min appearance they are guaranteed 4 hours of overtime.

    This happened to my 70 yr old mother in Parker, Co. Eventually charges were dropped but she still had to pay her lawyer.

      They shouldn't be allowed to just drop the charges. Either the chages should never have been brought in the first place or someone, (many people) need to be held criminally accountable for weak or false charges. It has become that the process IS the punishment. If the DA can just drip the charges when he realized that he will lose or that his entire case if a house of cards, they he should never have brought the case. Often they bring the case and threaten severe punishments and most people take a plea bargainto avoid harsher penalties or excessive legal costs and the entire justice system from the cop to the judge knows this and allows it to happen. If found not guilty, the state should have to pay your legal costs. The state has no skin in the game. When they are found to by lying, withholding evidence, rigging evidence, or just corrupt through and through there are NEVER any consequences for those actions only for the defendant.

    This is why nobody should ever agree to a roadside sobriety test. This is why everybody should treat the claim of any police officer to be a 'DUI expert' with great skepticism. This test is not mandatory. Do not be stupid. Don't do it!

      They need to remove qualified immunity from officers that do wrong. They need to charge him with Title 18 - CRIMES AND CRIMINAL PROCEDURE

      CHAPTER 93 - PUBLIC OFFICERS AND EMPLOYEES
      Sec. 1924 - Unauthorized removal and retention of classified documents or material. He clearly manipulated the video document by muting in favor of benefiting his outcome. Hidden crucial video documents. The penalty for a conviction of unauthorized disclosure includes up to 10 years in prison, a large fine, or both.

    No Municipality should allow their LEO Dept to allow any officer to resign in lieu of termination. If there was cause to terminate, then compel the person to remain on desk duty (no paid vacations!) until any HR matters are concluded. The current practice allows bad cops to just slide on over the another Dept and carry-on being bad cops.

    Ruining peoples lives..when you get a dui you lose your license.. can’t drive to work so you’ll lose you job. Then you can’t pay your bills. You can lose your house. I can’t imagine what I would do. I have 2 babies at home.

    This cop has the ability to change someone’s life. His actions could cause a person to loose a job, keep someone from getting a job, he can put a target on someone’s back that might cause other cops to retaliate etc. He was allowed to resign and THAT, will make him hireable to other police departments, sheriff’s offices etc.

    Police departments reject that they have DUI arrest "quotas". It might not be called "quotas", but if cops don't write a minimum of DUI, they won't get promoted or get new equipment (e.g., patrol cars).

    I lived in Fort Collins from 93 to 2000. I moved, in part, because the cops got so bad in that town. Everybody I knew were affected one way or another by those bad cops in that town. They were (and apparently still are) thugs no better than any gang in a big city. And the rot starts at the head. The chief knows who the bad cops are...most of them by the way. I have never seen a single FC cop even come close to deescalating anything. In fact, they seem to be groomed to make every case scenario a zero-sum game event.

      I lived downtown in apt above College and watched cops beating up drunk college kids almost every night. It is crazy how it turns from a family friendly neighborhood into a war zone after midnight. Cops marching in swat gear and shooting tear gas. They got my little brother good with a Billy club as he was running away from the tear gas. I was walking upstairs and to my place and to my surprise a bunch of cops were in my hallway. They immediately threw me on the ground and put a shotgun barrel on the back of my head screaming obscenities. They realized I was the wrong guy and told me to get in my apt I screamed some obscenities back and they threw me on the ground again and threatened to shoot me and arrest me if I didn’t shut the f up. I guess someone called 911 and said they heard gunshots from my neighbors but they were lighting fireworks on the roof. Power tripping mentally deranged and evil. My bro calls them the tentacles of satin. I have met maybe 2 decent cops in my life but wasn’t in FtCollins.

    I used to drive Uber in Fort Collins. I got pulled over multiple times, always late at night. The reasons the cops gave me for stopping me were absurd. I would laugh at them. They are just out there fishing for lucky DUIs. Ironically, you can drive around hammered in the daylight and never get pulled over.

    The whole "a few bad apples" argument in regard to police misconduct is an absolute myth. It's not a few bad apples, it's a pervasive problem in law enforcement culture. Cops that respect the law, constitutional rights, and don't lie as a matter of practice are the exception, not the rule. The public is learning this more and more due to the proliferation of video recording devices. It is safe to assume that since we are seeing this kind of thing (and much worse) so often means there are many more of these instances occurring every day.

      I agree. They also seemingly can't record objective facts during the test. I know someone who got a DUI and the officer noted several failings when the camera clearly caught something different. Stuff that isn't hard. "They took 8 steps instead of 9". Additionally, if they start the sobriety test, you absolutely will get arrested because they can always claim that maybe they were under the influence of another substance. It becomes a judicial problem at that point.
