A couple of years ago, I saw a silent auditor video. He had someone record him in action. He was standing outside a military base. Not important which one. He was on the sidewalk. When two base security persons and two uniformed base police (4 people) came out to him and all started talking to him at the same time. He held up his hand, and pulled a piece of folded paper from his sleeve and gave it to them. They each read it, handing it to each other, the SGT shook his head and motioned to all of them "let's go". They got in the car and left back in the base. He never said a word. He never moved. At the end, he posted his letter he gave them. I copied it. Here it is. Funniest audit response, ever.

If I am handing you this note, I do not wish to have a consensual conversation with you, for any Law Enforcement Officers this serves as notice that I am asserting my fifth amendment right to remain silent.
I am engaged in legal and constitutionally protected activity.
I am on public property, and I am not trespassing (as can be confirmed by county’s GIS maps.)

The Sargeant was cute, but she still believes in the Blue Line. As for the 6'2" Federal Park Police Officer, you could tell he's not used to people standing up to his bullying tactics. "I've already contacted JCH (or whatever it was he said) and they may be coming out, and that won't turn out good, so turn those cameras off right now! I loved the look on his face when you said, "NO!" Then proceeded to quote your 1st addmendment rights.
You can tell he's used to dealing with poorly educated citizens who are intimidated by that tactic. I loved watching him get more angry and frustrated that his usual bag of tricks just wasn't working! Instead, you were quoting Supreme Court cases, constitutional rights, and dispelling the old "Suspicious " routine. Then you quoted the 2018 and (2023?) Dept of Homeland Security memo concerning photography and audio/visual recording outside and inside of federal facilities, post offices, and military installations! That the eyes can not be trespassed, if it can see it from a public place, such as a sidewalk, it can be recorded and disseminated to the public. Further all government employees can be filmed during the course of their duties.

Military reservations can place limits on recording. Absolutely. But this video shows nothing illegal, the public can absolutely record from legally accessible property near the facility. From the parking lot maybe not, depends on how the facility has set its policy based on actual security needs, which are a compelling government interest. But from the edge of the reservation that is not property of the reservation? There is no question. I've stood on BLM land right in front of a do not record sign at Area 51.
