I also experienced an issue with a friend's son and our local warden. My buddies boy shot a trophy 11pt with his bow on the Saturday opener during the evening. They looked for his buck all day the next day on Sunday. The next day, on Monday, a neighbor found the buck laying just off her yard when she let her dog out first thing that morning.
She called the local warden who retrieved it. Later that day my buddy heard what happened from the neighbor so he called the warden up. The warden came by their house that afternoon to show them the deer. My buddies boy described it to a T and which shoulder he shot it in. It literally died within 100yds, only mere feet from where they previously searched.
Thinking the warden was going to allow him to tag it, the warden began lecturing him about practicing more and learning the anatomy of a deer to avoid the shoulder blade. When my buddy finally asked if his son could tag it, the warden told him, flat out, "no!" No excuse given, except they didn't find the deer.
There was no doubt it was his deer and what was taking place. The warden wanted the rack. It was a beautiful, thick trophy 11pt.
His son got the last laugh because three weeks later he shot an even bigger racked 13pt. and made sure the warden knew about it, thanking him for not allowing him to keep the first buck.

American law enforcement is universally out of control everywhere about everything. Iraq and Afghanistan combat vets returned to America full of jitters and itchy trigger fingers, viewing us not as citizens but as “civilians” who are potential threats with no constitutional rights. So our police everywhere are militarized and ready to go from talking to beating the snot out of someone in five seconds. It’s a problem

I bet it was the same warden who called me and told me that it was illegal and he would be watching and if he caught me I would be arrested and charged for hunting with an electronic device because they consider recovery as part of the hunt! I still want to become a pilot if we can change this issue in Pa. I had Clayton locate my buck in Ohio a few weeks ago that went onto the neighboring property. What a great guy, although it took him less than a minute to locate my buck he was more than willing to share a wealth of knowledge for when I become a DDR pilot if we can clear this issue in Pa.........

I feel like the game warden wanted a thermal drone for state use and his request was denied to purchase one. So he found an easy way to seize one. Game wardens have the worst repore with the public than any other law enforcement agencies. I can tell you that here in Ohio that I shot a deer just before dark and waited an hour before planning to go to recover it. Hunting on my own land. I tried to call my local game Warden and was unable to reach him because it was after hours (????). So since we have a horrible problem with coyotes around here, we proceeded to get permission from our neighbors in writing to look for the deer. We did not find it. The following morning I called the state office of the DNR and they told me it was my responsibility to locate and recover the deer if at all possible, and I was within my rights to do so after legal hunting hours as long as we had permission to be on the land on which we were going to search.
This sounds like a bunch of BS coming out of the DNR in Pennsylvania. Trying to make an example out of this drone pilot.
Now this year, I just bought a new DJI thermal drone for the purpose of recovering fatally wounded deer for people. Studying right now to take my part 107 test, info on how to get proper waivers, info on health to work with public servants, etc.
Now I'm afraid to proceed in order to help anyone after hearing about this Sting in Pennsylvania. This cannot be correct. There must be the same rules across the board for everyone whether it's the hunter or someone trying to help the hunter like in this case. In my opinion they had no right to take the equipment or even approach this pilot. The liability form that was completed by the supposed hunter should have covered everything legally. This is quite an upsetting situation.

Therefore, we didn't invest. I've spoken to that joker in Ohio and he's not telling you the truth and the whole story. The law is clear and when it's changed, we will consider it. However, he charged 450 plus another 100 if found and mileage. We charged 150 and found 80 plus deer. Not many people are dropping 450 etc. For the average deer hunter.

I am a recreational flyer and I live in a rural area in NW Pa. 95% of my flights are out of my yard. An incident occurred on September 3, 2023 and the PA State police now have my Air 2S. I was filming a hyper lapse video of the sunset when I received a critical battery error (my own stupidity) and the drone made an emergency landing about 400 meters from home. I could see that it had landed on a neighbors property and waited until the next morning to go there and ask permission to search. When I did they told me that they had found it and called the police who came and took the drone. I was happy to hear that it was found and figured that all I needed to do was call, explain what happened, and go retrieve it from them. I made that call on September 4 and was told that the officer involved would have to call me back. I waited a few days without hearing a word then he finally contacted me. He informed me that I wouldn't be getting the drone back soon if at all because there had been other complaints, about drone flyers in my neighborhood. I explained that I could easily prove that there was no malicious intent on my part by showing him the flight logs. I also told him that everything I filmed would be on the memory card in the drone and, if he removed the battery, he would find a sticker with my name, address and phone number on it. He didn't want to hear that though and was very arrogant and downright rude when he told me that he was gathering everyone in the area who had complained and they were taking me to court. When I inquired about a timeline he said that he couldn't even start the 'investigation' until he gets off of 3rd shift. Its been a month and he still has not started the investigation. Since then I've done some research and found that civil forfeiture laws exist that allow them to keep property indefinitely even if there is never an arrest.
    UPDATE
I received a call from Trooper Lewis of the PSP today (12/10/23) and he informed me that he would be filing 'unlawful use of an unmanned aircraft ' and also 'disorderly conduct ' charges against me. The disorderly conduct charge really blows my mind. When I asked him about it he said it was because 2 other officers had visited me with warnings. Those officers never issued any warning either written or verbal. Unfortunately with my wife battling breast cancer and heart problems and with both of us being retired on a fixed income the money won't be there to hire a lawyer and fight this and my income will keep me from getting legal assistance.

I would definitely go to court if they try to go through with it and request to review the footage from the drone. If footage is "lost" then there's no proof of a malicious act and if the sunset footage you say is there then when that is seen it court the judge will probably laugh and dismiss it

    • @skidrose6067
      @skidrose6067 7 місяців тому

The charges were filed on 12/14 and they are 4 counts of 'unlawful use of an unmanned aircraft - conduct surveillance' and 1 count of 'disorderly conduct/physi off'. Fingerprints have also been ordered. The offense date is listed as 7/14/23 so it looks like there aren't any charges for the flight om 9/3 when they took my Air 2s. I checked my remote and on 7/14 I made 6 flights using 2 of my drones. None of those flights were near any structures. The 2 drones that I flew on 7/14/23 were the DJI Mini 2 and Mini 3 Pro. I registered both of these drones with the FAA even though it is not required because both are under 250 mg's in weight. They are considered toys. I am being charged with conducting surveillance with a toy. The disorderly conduct charge with physical violence really stuns me as there was never a confrontation of any sort. The arresting officer, PSP trooper Andrew J. Lewis 13714, never even came to my house. All my interactions with him were over the phone.

Hey guys I love the channel and content and I believe that the drone recovery process is a valuable tool. I have been hunting for about 40 years and its everything to me, and my life revolves around it. I use any tool I can to help aid in finding, identifying age and target deer, as well as the most efficient weapon allowed. So I agree there is a place for drone recovery. The only sketchy thing I saw was on a video of a recovery there was a live deer found with the drone and it was a giant. After a few seconds it was realized that this live deer was way bigger than the deer that was being looked for. But the hunter was watching the video and I heard him say "Ooh where is that at". I cant remember if any detail was given to the hunter about its location but if it was or if he figured it out I am sure he was in a stand near that location the next hunt. My recommendation is that the hunter doesn't get to see the video feed or any discussion about the amount of live deer in the area while the search is on going. I understand at some point the hunter does need to evaluate whether or not it was their deer if it is still alive. Just my 2 cents.
With regard to using the drone outside of hunting hours. I rarely have had any interaction with CPO's mostly because I hunt on private property. However there was a time when I was coming back from hunting, it was after shooting hours and I didn't have on my orange hat, I did have one, it just wasn't on, it was hot out. I got a ticket and 9 points against me and my argument was, I cant legally hunt, and no one else can either so why do I have to have any orange on after hours? I took it to court, showed the judge the book of regulations which doesn't say orange has to be worn 24 7 during the 3 day season, showed him the time on the ticket and all the judge did was yell at the CPO for not giving me more tickets. I then filed a grievance against the CPO. I met with the Captain and Sargent, it was clear they were mainly there to try and trap me in some violation but I am as legal as they get. After about an hour of discussions, they of course did nothing to the CPO but to my amazement the next year, the regulations book had many revisions made based on that discussion, and cleared up a lot of unknowns and undocumented rules.

4th Amendment should prevent that seizure without charges. It seems unreasonable to me to seize a $10k+ piece of equipment without a warrant to take it or unless a felony level crime is being investigated and if that was the case it would surely involve an arrest. This will only be resolved in the Courts or the Legislature.

For interpretation by the warden/ an individuals opinion or own interpretation. The Laws & Hunting Regs are outdated, unpopular, confusing, and down right dumb. The State needs to do a better job of updating and defining the statutes and regulations. We are allowed to hunt some Sundays. But not all.. It’s ridiculous and absurd the confusion and lack of explanation or accountability to make the changes needed. It is about time we stand together and hold them accountable to make the necessary changes. I hope you find

CELL CAMERAS ARE AN ELECTRONIC DEVICE THAT NOTIFIES YOU IN REAL TIME (within seconds anyway) WHEN AND WHERE DEER ARE IN YOUR HUNNTING AREA! You can even tell which way they're headed and head to the right stand for an electronic assisted high-tech ambush. Unlike drones that need an operator to fly them and observe where the deer are, you can have cell cameras throughout your hunting area WHILE you're hunting that will tell you within seconds if the deer are in your area and headed your way. I don't know if cell cameras are legal in every state though. And what about cell phones that almost all of use while hunting and two-way radios that are also frequently used? Aren't they electronic devices used during the pursuit of deer? Just a thought.

Another thing that might help besides signing the waiver would to not let land owner/hunter be involved in watching the monitor. Only give him the results of what you find. This kinda kills the moment but would be crucial in any allegations of hunting the deer.
If the deer is not dead location information can not be given. The hunter would not be any better off from you coming unless you find his dead deer.
Bottom line is ,we all know everything can be done in a unlawful manner but try to show as much as possible that this only for recovery!! And I dont think there is any more possibilities toward that other what was mentioned.
