  • There are new twists in the murder trial of a former police officer in Dallas. Amber Guyger was off duty when she shot Botham Jean last September. She claims she thought the apartment was hers. On Wednesday, a judge blocked jurors from hearing a portion of the testimony supporting her claim. Omar Villafranca reports.

    This is absolutely ridiculous, she walks into another mans apartment and shoots him. It doesn’t matter if she was “confused” or not. If a police officer cannot remember where they live- they shouldn’t be operating a vehicle or carrying a firearm.

      exactly, she's a sworn Civil Servant tasked with the safe carry/transport of a firearm (24/7 both on duty and off duty). the standard to which she must be held is HIGHER than that of the "average Joe", therein the "average Joe mistake defense" DOES NOT APPLY here.

      But do you think it was premeditated? That's basically what the trial is about. She going to get charged with something, but the severity of the charges is what in question.

    If someone walked into my apartment unexpected I would get off the couch and attack the trespasser as well. IT was his couch and his apartment he had every right to go towards her.

What is sad is how many more times will this have to happen before they start to teach law enforcement to try to use taser first instead of fire arm.       I've done a similar thing in a hotel once (minus the hurting anyone part, of course). All the floors were symmetrical in a near perfect way. I got off on the wrong floor and stuck my key in the wrong door. The woman inside heard me fumbling with the lock and asked who is it. Thank God she didn't panic and shoot thru the door.

    The man lived on an entirely different floor, had a different apartment #, had a red doormat at his door, and this guy says it was reasonable for her to believe she was in her own apt.     She lived on the 3rd floor! A covered parking garage, Jean lived on the 4tu floor open Air parking area. You can look at the sky. Doesn't have to go any further than that.

      Around 15% of residents at the complex have said they have gone to the wrong floor and wrong apartment. The complex obviously needs to make it a little more clear on what floor someone is on. I'm by no means excusing what she did but it's obvious they have a problem with that. I also believe all the parking is covered.

    This is so unreal that he would consider this killing not a crime. I can imagine the domino effect this case would have if this claim was to stand in court. Prior murders similar to this one overturned and not to mention all murders that would happen after this since a "simple mistake" of confusion like this one would be able to justify killing a person. What a system. I wonder if there would be the same consideration if it would have been the other way around and he would have killed her in her apartment.

    Her actions were REASONABLE? What's reasonable about killing someone in their own house and then claiming you were afraid? I don't think anyone was more afraid than the innocent man who was murdered.

    I live in Dallas in one of these types of Apartment buildings and that is a lie. When you drive through the gate there are large numbers right in front of you telling you which floor you're on. You can't miss that. Also, there are obvious signs your on the correct or wrong floor and there are numbers right in front of you telling you the apartment # on your door as you enter your door. This cop lied. Also you use a card as a key and it's green to enter red meaning this key does not work meaning the door will not open. These doors are heavy and close behind you. How did she gain access?

      Not in the South Side Flats. They have since put numbers on the floors because all that indicated it before was the 3 or 4 before the numbers on the elevator and beside the apartment doors. I can understand her parking on the wrong floor and even going to the wrong apartment, like neighbors testified they did. But what I will not excuse is that she didn't see his red floor mat the size of a freaking stop sign and when her keys worked because his door didn't lock right, why she didn't back out of the apartment and call for backup if she thought he was an intruder (sitting in his boxers eating ice cream and watching TV??). Then, she renders Botham no aid or CPR of any kind? A trained police officer? Plus, this is the first person she has shot while in uniform. She is guilty and deserves to go to prison

    That Texas ranger is going above and beyond his duty to protect that cop. She is either incompetent or simply murdered the man for personal reasons. He probably complained about her noise so she killed him.

    I'm glad they showed pictures of both apartments. Before I saw the pics, I was willing to give Guyger the benefit of the doubt, but now I can't take her story seriously. Apart from the fact that both apartments have a TV and a couch, they have totally different interiors. There's a stand with flowers in Guyger's apartment that's not in Jean's. There's a large rug between the TV in Jean's apartment that's not there in Guyger's. The back has a door and a window with blinds in Guyger's apartment that's not present in Jean's. There's also a laptop and a large cushion close to the couch in Jean's apartment, but not in Guyger's. Jean's has a lamp behind the couch but not Guyger's. Plenty of people have also mentioned the red doormat in front of Jean's apartment. I'm sure you guys could point out even more differences between the two places. Even if it was dark inside the apartment, the TV would at least emit enough light to make some of the interior decor visible. For Guyger to miss all of those clues, she would have to have 0 situational awareness at that point. Even if that were true, she should've made a conscious effort to regain it once she saw an "intruder" in her home. It looks like the only thing she saw was a black man inside her apartment and that was reason enough to use deadly force. She probably wanted him to bleed out so he wouldn't get a chance to tell his side of the story. What do you guys think? Do you think her story is believable after you have seen the pictures of the two apartments at 1:11?

    I live in The great state of Texas and it seems that whenever the Rangers get involve it's always on the side of law enforcement. Also there aren't that many rangers that are members of a minority group, so I think that having one of few black rangers say that it was reasonable for a white police officer to shoot a Blackman that did absolutely nothing that could considered a criminal act doesn't surprise me. Killing black men seems to be a sport in the great state of Texas. The police get away with it all the time, however I pray this time it will be different.

      She didn't attempt to use her key to open her door. She entered the wrong apt by CLOSED, unlocked door. She did not announce WTF she was. She failed to recognize the apt furniture was NOT HERS. She just fired and mins later, she was on the balcony pacing back and forth, on the phone, BEFORE calling for backup. SHE GUILTY. PERIOD.

      It was a mistake, as a police officer, she would've planned better if it had been intentional. The fact that it's a mistake, doesn't exonerate her guilt, and she needs to plead guilty to manslaughter and ask for leniency. No trial needed.

    The minute she opened the door she should have know it was not her apartment. The door opens to a hallway, NOT to the living room he was in the couch in. So she saw the decor in the hallway BEFORE she walked in to see him in the couch....so she didn't see that is was NOT her house?? Plus the lights were ON! There has to be more to this. It makes absolutely no sense.

    HOW did she get INTO his apartment? Why wouldn't he go towards the door when someone was coming in his apt? She was off duty, so why was her video camera still on?
