Her max is 90 days; Seeing as how she only has to serve a % of that, she will do around 75 days. If the judge gives her more, she wont have a job (If she hasn't lost it after this; I'm guessing she will...), so, just getting it over with becomes a very logical option...Judge knows it takes about a week to get used to being in jail, and she will start thinking: "I might as well get it over/done with...?" No more treatment (she doesn't wan't), or probation. Time served; "Don't do it again!" , and done...

There are factors that can make 1 DUI a felony in Michigan. Automatically a felony for a 3rd DUI. Her attorney was able to get each DUI plead down to a misdemeanor. The judge mentioned she was surprised about the 3rd not being a felony ( 3:52 ). Driving the wrong way on an expressway is another way to get a felony DUI on your first. Three DUI’s in 14 months. @patrickscalia5088 13 годин тому

You're both completely missing the point. Yes, 5 days in jail for three DUIs in a year would be a pittance. But she's not doing 5 days for her DUIs. She's doing 5 days for refusing to obey the judge's orders, essentially a contempt charge. And 5 days for a contempt charge that doesn't involve attacking the judge or court in some way is pretty harsh. The punishment for the DUIs will come later in the process and is likely to be harsh, restrictive, and very expensive for this woman.
It's like the story of the stubborn mule who was standing and refused to move no matter how much he was whipped. An old Army mule driver came in, observed the problem, then picked up a 2x4 and proceeded to viciously beat the mule in the head with it. An Army officer, outraged at this cruel treatment, came up and told the mule driver "That's no way to train this animal!" And the mule driver replied "Oh, I'm not training him yet. I'm just getting his attention."
The 5 day sentence is the judge getting the DUI suspect's attention.
