Hi!, watching here in Zamboanga City. Thank you so much, this is more than recalling, but rather it is more learning better about the subject.......so very much thankful of this, hope more like of this, especially in mercantile
I just wanted to ask, we're not a law student but our teacher in obligation and contract requires us to answer from a format "Yes or No, In accordance with the law......, relate the situation and the conclusion". How can we suppose to answer her oral recitation if we don't have a deeper knowledge and understanding. Also, The teaching style is more like a law student but we are marketing student. Can I get your opinion or suggestions?
8. Cersei and Jamie entered into an agreement on 1 January 2020 where Jaime promised to find Cersei a buyer for her condominium unit. Jamie has until 31 May 2020 to find a buyer. In exchange for such service, Cersei would pay Jamie twenty-five thousand pesos (PhP 25,000.00). However, should Jamie fail to find a buyer on or before said date, he will pay Cersei a penalty of five thousand pesos (PhP 5,000.00). In the alternative, Cersei may require fulfillment of Jamie’s obligation instead of payment of penalty. These are the only stipulations of their agreement. When 31 May 2020 came, Jamie still has not found a buyer. Cersei demanded fulfilment until 30 June 2020, instead of payment of penalty. However, an epidemic broke out on 2 June 2020. As a result, a lockdown was implemented, but Jamie was still legally able to move around and travel due to his work as a bank employee. The lockdown was lifted on 30 June 2020. Still, Jamie was not able to find a buyer. Can Cersei still demand payment of penalty even if she has previously chosen fulfilment? Why (10 pts.) 9. Illustrate an obligation subject to a period where there are two (2) solidary debtors and two (2) solidary creditors over an indivisible object, if possible. (10 pts.) 10. On 1 April 2019, Cherry agreed to give Mae her only Toyota RAV4 on 30 April 2019. On 27 April 2019, Mae agreed to repair Cherry’s bicycle on 29 April 2019. Neither was able to comply with her obligation. Is Mae’s liability tempered by the fact that Cherry likewise subsequently failed to comply with her obligation to deliver the RAV4? Why? (10 pts.)
