It was only after several hours did the British finally open fire on the French fleet.
At Mers, the British didn't just suprise attack the French. The British commander tried to convince the French commander to hand over the ships or sail them to British ports. It wasn't a Pearl Harbor attack, the French commander kept stalling so the British open fire.
"Stalling" because the British purposely sent a Captain to negotiate with an Admiral, an Admiral who said he wouldn't negotiate with a Captain and demanded someone of an equal or higher rank in the Royal Navy be present as every other meeting between French and British navy officers had been before. The British couldn't have known which side would the French ships defect to. In fact, a lot of the fleet defected to Vichy France, aka German puppet state, confirming the British fears. So what the British did was perfectly justified, doesn't mean frog eaters need to like it. Germany was intent on capturing the entire French fleet, but those ships that weren't destroyed in combat either escaped or were scuttled mere hours before German troops arrived.
