They collected millions in investment even without have one qualified engineer on staff. The only difference was that somehow Elizabeth Holmes was able to pull the scam over on alot of the higher us in the US Government for a few months before they caught on.

Considering Sanjay Gupta who is their medical advisor admitted to knowing exactly what it is and how amazing the medicine has been I would say that leads to more of a case for Rogan.
What sanjay said on the podcast is not necessarily what he said or believed if he were advising cnn before they made their report. Actual malice is a bitch to prove, especially with the hot news defence which allows you to get away with negligently spreading false information that you would have known was false if you did your due diligence so long as you have a pressing public interest argument for rushing the story (I. E. Wanting to dissuade the public from trying to self medicate with actual horse dewormer and not medically prescribed stuff). This is a far cry from the Covington kid situation. Joe gets far more mileage in the court of public opinion than he would get in the court of law with this story.

While you might be correct if he was to sue just Acosta they said he has decent case against the network as a whole, especially after Gupta went on Rogans show and they discussed just that. The very next day multiple anchors had Gupta on to discuss his experience on the show and they doubled down on the horse paste statements. Continuing to make the claims after they were clearly aware of the interview where Joe explained what he took was doctor prescribed, shows malace and using the hyperbole defense when so many anchors made the claims so many times is a weak one. And one might call you an idiot for criticizing Rogans medical decisions while knowing nothing about his health and possible preexisting conditions that might preclude him from getting the vaccination. How about people just stop getting involved in other people's medical decisions.

Considering Sanjay Gupta who is their medical advisor admitted to knowing exactly what it is and how amazing the medicine has been I would say that leads to more of a case for Rogan.
What sanjay said on the podcast is not necessarily what he said or believed if he were advising cnn before they made their report.
Actual malice is a bitch to prove, especially with the hot news defence which allows you to get away with negligently spreading false information that you would have known was false if you did your due diligence so long as you have a pressing public interest argument for rushing the story (I. E. Wanting to dissuade the public from trying to self medicate with actual horse dewormer and not medically prescribed stuff).
This is a far cry from the Covington kid situation. Joe gets far more mileage in the court of public opinion than he would get in the court of law with this story.

I have talked to a couple attorneys I work with and they all disagree with your assessment. While you might be correct if he was to sue just Acosta they said he has decent case against the network as a whole, especially after Gupta went on Rogans show and they discussed just that. The very next day multiple anchors had Gupta on to discuss his experience on the show and they doubled down on the horse paste statements. Continuing to make the claims after they were clearly aware of the interview where Joe explained what he took was doctor prescribed, shows malace and using the hyperbole defense when so many anchors made the claims so many times is a weak one.
And one might call you an idiot for criticizing Rogans medical decisions while knowing nothing about his health and possible preexisting conditions that might preclude him from getting the vaccination. How about people just stop getting involved in other people's medical decisions.

Because Rogan is a public figure he would need to prove malicious intent with the lie iirc from the random business law class I took in college. It's fairly obvious to me that there was malicious intent but technically it's very hard to prove.

It preponderance of the evidence as opposed to beyond a reasonable doubt. It just seems to me that if a malicious intent can be proven against a private person, especially a kid, it seems as though it would be easier to prove damages for a pronounced public figure. I don't know. Not advocating either way, I just think it's an interesting conversation.
