I did this a few years ago, but had the assistance of an attorney. My wife had died and needed to get her off the title. At the same time I was setting up a trust and it was recommended I put the house in the trust. So two quick claim deeds were filed with the county.

Thanks for your inquiry. Prop 13 was great for saving on Property taxes. Prop 13 applies when you sell a property, in this case it may not affect his taxes, but best you consult with your accountant or Attorney.
Hello Mr Patel, I hope you can help me with a quitclaim question. I'm trying to buy properties that belonged to Bobby, my friend who died recently. The properties were willed to Glenda, his sister, who wants to sell me the property. Glenda ( after going thru probate in GA.,) paid an attny for a title search. The attorney found errors in the legal descriptions. These errors came from 2 companies who aquired Bobby's properties 5yrs ago at tax sales but had to return them to Bobby (in GA you have 12 months to buy your property back after tax sale) When they titled the properties back to Bobby, they used quitclaim deeds and made errors but it was recorded with county tax office and went back into Bobby's name. I'm paying cash and time is my enemy and 1 of the entities cant be located or contacted (in NY). OK - My question: If Glenda quitclaims the properties to me using the ORIGINAL (correct) legal descriptions (instead of the erroneous ones from 5 yrs ago, will that fix it?
When you are paying cash etc. you are having a sale of the house and NOT a title change. Seems like you have legal issues going on. Recommend you talk to an attorney or a legal professional. Without much info, I am unable to directly help you...

Hi Mike, I have a situation with my family home in North Carolina. Both of my parents are deceased, and my siblings and I inherited the house (five siblings including me). A nephew was living in the house, and had three of my siblings sign their ownership over to him (60%). He now wants to revert his 60% ownership back, but one of my siblings (his mother - who did not sign over her portion) is deceased. Would a quit claim deed work in this situation? How should the grantee section be worded? Any insight you can provide would be greatly appreciated. I haven't had luck obtaining a lawyer in NC (I live in Florida)

I am not able to answer this accurately as I am am sure how the title is held and also if the mom had a will or trust etc. so it gets a bit complicated to answer. I would suggest you talk to a local attorney and do it right and 'legal' so in future if and when you sell, it will be smooth and easy. There are also tax issues to consider... Hope that helps

He moved to Philly 15 years ago and have took residency there. Can I send him the quitclaim form and have him notarized there and send it back to me. Also where can I find preliminary change of ownership form?
yes if he willing to do that and sign over that is fine.. also see if you guys have a loan on it and is he on it etc.. consult a professional for specifics.. you can find forms by going to LA county recorders office and go to forms page.. assessor.lacounty.gov/forms-2/. hope that helps!

Sorry to hear about your auntie, to transfer the title and since there’s a death in the family and the will involved, I would recommend you consult an attorney or an accountant so they can look over the will I’m not sure of the specifics so can’t really advise you on anything or recommend anything but have them review it and basically upon review then you can transfer the title from your aunts name to your name, you may lose title insurance on it by doing that but they can guide you with it you can even call your local assessors office and they can guide you as well thanks for watching my channel

Thanks for your question. Yes the quit claim can suffice the transfer of title. I always recommend doing it professionals who do this all the time so take into consideration of title insurance and tax consequences etc. I dont believe you have to sign the quit claim deed, but the transferor has to notarize it and deliver it to you.. etc. Feel free to DM for more info or contact info etc. Thanks for watching my videos.
Can the new owner fill this out if the property was just never titled after it was purchased. The property is all paid for so it's just the title that was never switched to the new owner

You can transfer the name and title to your name they can sign a quit claim deed, but that’ll still keep the name on the loan, so you may want to consult the local authority there to be sure that’s exactly what you and they want, quit claim deed can be recorded as well Can you ask your accountant as well?

Some questions I have: 1) If a divorced couple who both have their names on the title do a quitclaim to remove the wife from the title, then is the grantor both the husband and wife, and who is the grantee. 2) Does the leaving spouse use the words 'quitclaim all my interests" or "quitclaim 100% of my interests"? 3) If the leaving spouse is not expecting to get paid, then does there have to be some monetary consideration in order to make the deed executable?

There are several ways to do this. You can download the quitclaim deed from your county recorders site or get it from them or other sites or you may call your title or escrow officer for assistance. Depending on which state you are in, the rules vary, please check with a CPA or an attorney for the tax and other implications the transfer may cause or create.. I am not sure what state you are in so the rules vary. You can Quit claim the property to them or you can do a formal recording of the title to them and transfer it that way. This way any title insurance can be conveyed to them as well. seek local help if possible or feel to contact me again

Yes the title can be transferred, but if you do that , you will not have title to your house but you will have mortgage on your name. so it is not recommended and lenders may have to be notified of the 'sale' and may request a pay off etc and this will also impact tax deductions. Thanks for your inquiry. Prop 13 was great for saving on Property taxes. Prop 13 applies when you sell a property, in this case it may not affect his taxes, but best you consult with your accountant or Attorney.

Hello Mr Patel, I hope you can help me with a quitclaim question. I'm trying to buy properties that belonged to Bobby, my friend who died recently. The properties were willed to Glenda, his sister, who wants to sell me the property. Glenda ( after going thru probate in GA.,) paid an attny for a title search. The attorney found errors in the legal descriptions. These errors came from 2 companies who aquired Bobby's properties 5yrs ago at tax sales but had to return them to Bobby (in GA you have 12 months to buy your property back after tax sale) When they titled the properties back to Bobby, they used quitclaim deeds and made errors but it was recorded with county tax office and went back into Bobby's name.

When you are paying cash etc. you are having a sale of the house and NOT a title change. Seems like you have legal issues going on. Recommend you talk to an attorney or a legal professional. Without much info, I am unable to directly help you...

Hi Mike, I have a situation with my family home in North Carolina. Both of my parents are deceased, and my siblings and I inherited the house (five siblings including me). A nephew was living in the house, and had three of my siblings sign their ownership over to him (60%). He now wants to revert his 60% ownership back, but one of my siblings (his mother - who did not sign over her portion) is deceased. Would a quit claim deed work in this situation? How should the grantee section be worded? Any insight you can provide would be greatly appreciated. I haven't had luck obtaining a lawyer in NC (I live in Florida)

I am not able to answer this accurately as I am am sure how the title is held and also if the mom had a will or trust etc. so it gets a bit complicated to answer. I would suggest you talk to a local attorney and do it right and 'legal' so in future if and when you sell, it will be smooth and easy. There are also tax issues to consider... Hope that helps

He moved to Philly 15 years ago and have took residency there. Can I send him the quitclaim form and have him notarized there and send it back to me. yes if he willing to do that and sign over that is fine.. also see if you guys have a loan on it and is he on it etc.. consult a professional for specifics.. you can find forms by going to LA county recorders office and go to forms page.. assessor.lacounty.gov/forms-2/. hope that helps!

Thanks for your question. Yes the quit claim can suffice the transfer of title. I am in a Joint Tenancy, they want their name off the title. How do we go about that. They signed on the loan to help me get the house, but they want the title to be in my name only.
You can transfer the name and title to your name they can sign a quit claim deed, but that’ll still keep the name on the loan, so you may want to consult the local authority there to be sure that’s exactly what you and they want, quit claim deed can be recorded as well

Some questions I have: 1) If a divorced couple who both have their names on the title do a quitclaim to remove the wife from the title, then is the grantor both the husband and wife, and who is the grantee. 2) Does the leaving spouse use the words 'quitclaim all my interests" or "quitclaim 100% of my interests"? 3) If the leaving spouse is not expecting to get paid, then does there have to be some monetary consideration in order to make the deed executable?

If you refi then both have to sign or other party can quit claim to you or transfer to you. I am sure you could but not quite sure on this situation and also where it is located..."only the portion" of the property you owe" could be transferred, as you know you also sell your time share which involves a title transfer.. Please check with the managers of the time share or seek local professional help?

When u own your property u have to pay property taxes while u are owning it. As for the rates check with your local county assessor they will let you know . Each county has their own prop tax rates or talk to your accountant

Yes the title can be transferred, but if you do that , you will not have title to your house but you will have mortgage on your name. so it is not recommended and lenders may have to be notified of the 'sale' and may request a pay off etc and this will also impact tax deductions. Thanks for the inquiry Shahdeen, that depends on what authority you might have been given by the now deceased person...please check with a professional prior to signing anything so it is all legal now and so dont have any issues in the distant future if any problems arise... are you the trust or the will or do you notarized authority from the now deceased et ...? please let me know if you need any resources.. thanks for watching my videos

Thanks for the reply. I suggest you talk to an attorney there locally as this can become complicated and a legal situation, as such I am in CA and not aware of all the procedures there in NY to guide you. Good luck .
