    My wife and I are considering a move back to the uk after 40 yrs in oz and have had a bit of difficulty finding the right home !!plenty of 3 bedroom houses with land but the 4 bedrooms are either still to small ie one bedroom being useless or generally jumping in cost this may well be the answer to out dilemma I’ll keep this in mind !!big thumbs up from me 🤙

      I think you may be quite right, a house with a smaller number of bedrooms and with a reasonable sized garden would be perfect.

    My place is a semi(end of terrace), I have a side entrance into my large garden and I don’t share a fence with the next door house, between my self & next house there’s a wide walk 🚶 path, then the next house’s fence. Question I have is; how will the caravan be moved into my garden? Are there legal restrictions for space to be able to wheel the caravan in & out? I doubt it. I’d like to discuss with you please, I’d like a photography studio in my garden and home we can build one using the caravan act.

    Looks like a great option. We live in a barn conversion which as is often the case had permitted development rights removed, so technically even a new shed would need planning permission! Would I be right in thinking that this doesn’t matter for your product as it’s not a permanent structure? Many thanks.

    Looks alright but it’s a mighty expensive gamble to take compared to getting planning permission and avoiding enforcement or headaches down the line

      We get a certificate of of lawful development from the council, there can't be any enforcement down the line it is all perfectly legal utilising the 1965 Caravan Act.

    Nice, do you use a reinforced concrete plinth rather than substructure foundation strips? I'm assuming that with a bit of earth clearing, you can get the straps (or beams!) of a crane lift underneath and raise the entire structure intact? Clever, - I'm guessing that due to the weight you'll need heavy duty lifting and trailer though although I assume there's nothing in the Caravan Act which limits the weight!

      This annexe is 11m x 5m with a height of 2.6m, internal height floor to ceiling is 2.4m

      To build an annexe you need planning permission which is quite difficult to get, if we build the annexe in a certain way we can build them using the caravan act rather than planning permission with is much easier to get permission from the council.

    Hi I would really appreciate any sort of reply in advance, I live in a private owned semi detached house , if I was to buy a static caravan and have it craned into my garden and off course with power and drainage, would this be allowed? I would also be planning on cladding the whole caravan so it would look more like a lodge and not resemble a caravan whatsoever hopefully thanks

      Hi, yes you can, I would advise you obtain a certificate of lawful development first though. Alternatively, we build one on site for you.

    It would need Building Regulations approved if it's for living accommodation wouldn't it?

      We build to current building regulations, however, they don’t need approval from the council. No one inspects and no neighbours need notifying.

      We do construct all of our annexes to all current building regs. However, they don't need approval from any inspector. As we build our annexes to conform to the Caravan Act which means we don't need building regs the same as any traditional towable or static caravan doesn't need them.

    Can I ask hypothetically if a person had a field and wanted to house homeless people as an example and was considering caravans , cud they do this type of thing under the caravan act and How many can you have if the council give the certificate does each caravan/annexe need it's own certificate or is it a case of once they have one that's job done , is this how the travelling community get on their land and aren't bothered

      Legally, to obtain a certificate the caravan has to be ancillary to the main property and a member of the family has to live in the caravan.

      The siting of a caravan within the garden of a property does not require express consent provided a ‘material change of use’ or ‘Development’ has not occurred. If a caravan is parked in a drive or sited in a garden and used by members of the household in connection to the enjoyment of the house or as extra accommodation for visiting guests, provided the occupants continue to use the facilities of the house, then the siting of the caravan has not changed the ‘use’ of the land. However, if for example a caravan is sited in a garden and used as business premises, separately rented or used as a primary independent dwelling, with no relation to the main house, the local planning Authority could decide that an unauthorized ‘material change of use’ has occurred, for which planning permission will be required.
      With your process is the mobile not used as a permanent residence?

      @@lando3655 The annexe has to share some facilities of the main dwelling and has to be ancillary to the main dwelling . A member of the family has to live in the annexe. Some meals need to shared and perhaps laundry facilities, obviously the annexe shares power, water and waste with the main dwelling and usually some storage facilities. Therefore a change of use hasn't occurred it's just additional accommodation which happens to have all the facilities of a house and the same facilities as a static caravan. But it more closely resembles a timber bungalow, we just build them in a way that they are classed as caravans, therefore no planning permission is required, just certificate of lawful development which we have a 100% success rate obtaining from the council.

    I’m not sure that this would comply with the caravan act. Can it be picked up and transported on the back of a lorry? If it’s not mobile in one or 2 pieces then it will not -ass the test unless the law has changed? Let me know if I’m wrong

      I assure you it does comply, it can be disconnected from utilities and lifted on to transport in 1 piece. As part of documentation we provide to the council to gain the certificate we have to prove that concept.

      @@DJ-uk5mm We build from scratch to a max size of 20m x 6.8m. Any design you want. We do all the planning for free. They generally take around 3 months to build, and the council can’t stop you.

      The caravan act states that the annexe has to be ancillary to the main residence, so unless the main house is within distance of the annexe then no.

      @@yorkshireguy5388 The law states that the annexe has to be sub-ordinate to the main dwelling. In this situation as the main dwelling isn’t habitable the council will deny the certificate.

    My brother is having a garden room/annexe built in my parents’ garden. It will have a living room, kitchen, bedroom and bathroom in it. It won’t be made out of bricks and will be screwed into the ground. It will look very similar to the annexe above but I’m not sure if it will be moveable on a lorry as it will be screwed into the ground. Are you able to tell me if it is legal for my brother to live/sleep in it? It is being built under permitted development and a building notice has been approved. It doesn’t have planning permission because the architect didn’t think it would go through. The company we are using is saying it’s fine legally under the caravan act but I’m just not sure.

      If the intention is to use it as additional accommodation with all the facilities you mentioned, then you will need to apply to the council and pass the caravan act test for use, mobility and construction. The council will then issue you with a certificate to state their approval. Don’t build it without that certificate otherwise it could be a very costly mistake.

      I would be happy to apply for the certificate on your behalf. It costs £131 + £26.80 admin fee to the council. Plus a location plan and a block plan costs £26. Plus my fee of £150+Vat. If we build the annexe then I don’t charge my fee. We have a 100% success rate obtaining certificates from councils.

      We cut and build on site, footings are concrete pad stones, so not concrete in ground, as council call that engineering work that requires planning permission

      You can't rent it, but you can pass on bill costs, which could have a percentage as maintenance I suppose. But the lodger or tenant would need to be a member of the family, or to be more precise if the annexe had more than one bedroom a second bedroom could be occupied by a lodger, assuming a member of the family stayed in the first bedroom.

      Using the Caravan Act means that neighbours have no say in the outcome of the application, no bright yellow notices are issued and the council have to ignore any responses from neighbours regarding the application. The council can only turn down permission for legal reasons. Which is why we have a 100% success rate obtaining the certificate as we have all legal reasons covered,

So no legal or moral obligation to consider the local effect, creating eyesore, possible inconvenience etc. I can see this creation is not invisible to nearby properties. How do you factor in those aspects with this apparent rather loose freedom of ignoring one’s neighbours? Do you, at all?

      Most people want to get on with their neighbours, and I encourage clients to speak to their neighbours before we start work. The vast majority of annexes we build have a flat (actually it is angled slightly to remove rain water) roof to significantly reduce their impact, and are usually placed in a position in their garden to keep its impact to a minimum. The internal height is usually 2.4m which is no different than the rules which govern a shed.

      The annexe has to be ancillary to the main property so a member of the family has to live in the annexe, although the rules don't state how close the relative needs to be, it could be a long lost relation. The alternative if you want income from rent, is to live in the annexe yourself and rent out the main dwelling.

    How did you prove that it could be craned off if needed as it looks to be built off a solid base?

      The Annexe is built off a solid base but not physically attached, as part of our documentation we provide to the council we include a structural engineers report that shows how the annexe can lifted off the base and be craned off site and then placed on a low loader for transportation away.

      It's only an issue if you need to transport as the law is hypothetical (see our article mobileannexe.com/how-would-a-large-20-x-6-metre-5-bedroom-granny-annex-be-transported/), you don't have to prove it, all our Annexes are custom built from scratch on site so it isn't an issue. There are specialist transport companies that can transport 6.8m wide.

      @@sichere Sorry, let me clarify, the maximum annexe width is 6.8m wide by 20m long, the annexe can be supplied in 2 sections and transported 3.4m x 20m on a lorry transporter

      It’s not something we have considered, we would need to do some research on rainwater filtering systems etc. So maybe in the future.

    We would like to have a suitable insulated building to be used as an extra bedroom in our garden, and as far as I can tell it could be constructed on site easily enough, but could never be craned out because we don't have any driveway , but a brick like garaged sized structure that runs narrowly parallel to the side of the house ,( split internally into a L shaped shed, being shared by our neighbour.) Could we still be considered under caravan rules if we built it to the specifications do you know please?

      You don't have to prove how the annexe could be removed you would be fine, you just have to show that it is built in such a way that in theory it could be removed. In reality our annexes are rarely moved, but they could be if the owner chooses to.

    Surely a granny annexe would have been better suited with a walk in shower cheap and easy to to do whilst under construction rather than to retrofit afterwards

      I agree, however, we custom build each annexe to the clients individual requirements. Some like to have a bath installed, which means we install an unvented water cylinder. Some like a shower, so we install an electric shower, either in a wet room environment or a cubicle. We then use a 9kw inline instantaneous water heater to supply hot water to the kitchen and bathroom taps. We can also offer all sort of mobility enhancements to the bathroom to cover all disability requirements.

      @coling9390 ok, so it is classed as a caravan, so it has to have a maximum internal height, floor to ceiling of 3.05m . There is no external legal maximum height.
