- Ontario’s provincial police force has a new approach to reducing impaired driving, and it’s calling the move its toughest measure yet.
Drivers will now have to provide a breath test during every traffic stop, even if there is no suspicion that they have been drinking.
And if you don’t comply, you could be charged.
“Under Canada’s Mandatory Alcohol Screening law, drivers must immediately comply with a police officer’s demand for a breath sample, even in the absence of any suspicion that they have consumed alcohol,” reads a statement from the OPP.
Canadian Charters of Rights and Freedom S8. Everyone has the right to be secure against unreasonable search and seizure. How does this meet that when police can demand a breath sample without reasonable grounds!

In places with a rule of law, police need probable cause before conducting a search such as a breathalyzer. Now any contact on the road means a mandatory search without reasonable justification. This can be stretched to warrantless searches of your truck, body cavity searches if it's deemed 'for safety". The frog boils slowly.

You could be driving home with your kids and get stopped for simply checking if your license is still valid. And have to waste taxpayer money and time for something that is pointless 99%of the time.

@@JayHammerCA The right against "seizure" in essence is the "taking of a thing from a person by a public authority without that person's consent. Law usually follows the principle "presumption of innocence". This has nothing to do with public safety. If you look at the data they provided, which is couple years old, not even recent data. The trend of driving while intoxicated has actually decreased in previous years and has started to level recently which is clearly not an increase if you look at data for population increase and increase of licensed drivers on the road. This will also inflate those numbers and give them all the more reason to ask for a budget increase.

the person reporting the stolen car forgot to tell the police there was a gun he found on the ground and it was in the STOLEN car... that way nothing would stop the police and they wouldn't even have to have any warrants to do it. yeah, wouldn't even have to ask permission from a judge or nuthing. welcome to canada. OPP vehicles have ALPRs (automatic licence plate readers), they are cameras that read license plates and identify them. Police will know if a vehicle is reported stolen.

Police have always been required to have reasonable and probable grounds to believe the driver is impaired before demanding a breath sample. That requirement is being trampled here.

Yes but they are only testing for alcohol and if you open your eyes you'll see a bigger problem with any other drug, especially the harder ones. The wording tells you that it would not help much but they'll make the data show positive becuase they are also about to actually go after the harder drugs too. So they want to set this up now so when they reduce the drugs on the streets another way, well then they can say this helped and then implement this everywhere. (FYI - Mandatory testing on all traffic stops is also new in Saskatchewan with the RCMP right now)

There are methods done by the RCMP to enforce child pornography and minor exploitation, none of them involve randomly searching phones
If a device needs to be seized an searched a warrant is required, warrants are obtained through a court and law enforcement has no say in whether the warrant is accepted or not

I didn't hear all the details on that, but they said you can only chase when the person does something very dangerous. Driving the wrong way down a HWY would qualify. Though I suppose the police chased them onto the HWY. It was Durham police, who have a few loose cannon kills to their credit.

Beware,a breathalyzer test result can lead to a false-positive reading and an unjust DUI charge in Ontario. This can happen due to various factors such as health conditions, diet, improper device calibration, or improper test administration.
Breathalyzers are notoriously inaccurate. I've bought 3 different models that were "police grade", in order to stay out of trouble - I got a speedometer to tell me when I'm speeding, but how can I know my blood alcohol, which is much more contentious than speed these days.
Anyway, short version is that they are trash/inconsistent, readings all over the place because they are very sensitive to calibration and how the test is done as you said. This is the reason they cannot convict on them alone, it's only the 'probable cause' to haul you in for a blood test which is the gold standard upon which the state cornholes you.

@@notastone4832 Way longer than a month. If you test positive for THC with a road side test. You then go straight to the hospital for blood work. They will check the drug recognition evaluators. If you are over the limit, you get charged and now the cops got a DNA blood sample.

troyjollimore I am also vehemently opposed to this idea. However not complying is unwise and can cause the stopped motorist more legal problems. A better course of action is to agree to comply, then immediately ask police officer if his/her bodycam is on and/or record stop with your own electronica, then advise police officer that this action constitutes a violation of civil rights under Canadian Federal law, are you sure you want to continue with this action?? (Basically advising police officer, indirectly, that there IS going to litigation). If officer says yes, continue, provide breath sample. Then litigate. You will have a super-strong case against the clown because he/she will have admitted on camera to KNOWINGLY violate your rights under Federal law. Chances are very high that once you have politely made it clear that there will be litigation, police officer will drop the matter and you will be on your way. Police officers DO NOT like harassing citizens who are knowledgeable about law and make it clear that they will not hesitate to litigate. Successful litigation against police agencies causes them to lose money, and NOBODY likes to lose money.

On the other hand, complying whilst simultaneously advising (not threatening) law enforcement, on camera, of the ramifications of continuing with a course of action which constitutes a breach of rights or process,
accomplishes the opposite, in plaintiff's favor, because their council can prove to a judge, in court, that the responding officer acted incorrectly, in spite of being advised of the fact by the plaintiff, who complied anyway. Don't take MY word for it, ask a lawyer - like my brother. Best and only way to reduce/eliminate improper conduct on the part of bad/bullying cops is to hit their agencies where it hurts...the bank account. The province doesn't want people to stop drinking, nor do they want them to stop driving drunk. There's alot of money to be made by Ontario in liquor taxes, and from the fines thrown at the drunk drivers they catch. Same thing goes for speeding, illegal parking, and talking on your cell phone while driving. The province needs ticket, and tax money.
I've been saying it for years police services aren't there to protect and serve the public. It is a business there to earn money through tickets and fines.

Had a friend get 3 faulty breathalyzers in a row during a checkpoint traffic stop. They were trying to argue that he was high despite being a straight edge dude who's dad died to heroin, literally won't touch any stuff with a 20 foot pole. They searched his car, he had to wait a half hour before a sergeant showed up with a working breathalyzer and cleared him to leave with no standing charges for 'cooperating' with them.
There's protocol, then there's being obtuse and all this law is gonna do is make that happen all the time instead of just at checkpoints. Highly abusable, highly exploitable by the higher ups for their goddamn quotas

After chasing a driver with a Van going the wrong way, and police chased him cause he stole a bottle of liquor, 3 innocent people died and the thief died too in that crash that makes it 4 deaths for a bottle of liquor, now 10 million residents have to undergo alcohol screening test...!

What are the grounds for breathalyzing every single person is it because you believe everyone to be drunk based off of what bad driving does everyone have bad driving habits is that normal driving is intoxication a standard or is it just simply blood alcohol level I think the whole criminal code in that regard needs a revamp with better clarity.
