Who is in greater danger: Tennessee football or the NCAA?

  • Tennessee is under NCAA investigation. Again.
    This time, the investigation involves potential violations to the NCAA’s flimsy NIL guidelines. And, this time, Tennessee is fighting back.
    UT Chancellor Donde Plowman has her elbows sharpened for this fight, and so does Vols AD Danny White. Perhaps more importantly, the Tennessee attorney general, Jonathan Skrmetti, is suing the NCAA. The lawsuit alleges that the NCAA's NIL guidelines violate the Sherman Antitrust Act and unlawfully restrict athletes' ability to monetize their name, image and likeness.
    On today's episode, hosts Blake Toppmeyer, Adam Sparks and John Adams unpack the investigation and the lawsuit and what they could mean - for the Vols and the NCAA.
    This investigation comes on the heels of a separate investigation in which the NCAA determined 18 Level I violations occurred during Jeremy Pruitt's coaching tenure.
    If the NCAA finds that Tennessee committed NIL violations, it may intend to impose harsh penalties, because the Vols would be a repeat offender. However, the NCAA routinely loses in court, and if it loses the judgement in this lawsuit, that could further hamstring the NCAA's ability to enforce its NIL guidelines.

    Have you guys seen the legal binding contract between Spyre Sports and Nico? This was based off of CA state law. Was the contract signed contingent on Nico being a VOL? If not, then it was Nico representing Spyre Sports regardless where he went to school. Spyre Sports - and every single one of us unless you are an idiot - saw that in a very short time Nico would be playing in the NFL. Seems they took a risk signing Nico to legal binding contract and having no stipulation as to where Nico signed to go to school to play football. So, the NCAA is saying that The Volunteer Club (TN's collective) flew Nico to UT. Well, the NCAA changed the rules to call those working with the collective to be called BOOSTERS. Nico is an employee of Spyre Sports and they should be able to fly Nico where ever or when ever they want.

      Yep, the contract stipulated Nico was, in fact, NOT obligated to play for TN and couldn't even wear UT insignia. They had that locked down. Of course, 10 days later, he signed/pledged whatever to Tennessee. But that's not illegal (apparently).

    The NCAA should be Disbanded.

      NCAA has to end, it's investigations take forever and are a seemingly endless cloud disrupting the program. An arbitration board in the alliance would be a better way to evolve the NIL issues moving forward.

      I'd love to argue, not a fan of the NCAA at all, but I do believe they serve themselves, current staff should be fired, bring in the school and conference leaders and let them figure out what to do, obviously the NCAA doesn't know what's going on, so give that responsibility to the people who have to deal with the BS they created

      The Volunteer Club is the Collective. Not Spyres Sports and no Spyres is not a Booster

    The allegations are serious. The fact they are being made is ridiculous! Can UT, singularly, and all UT student athletes collectively, sue the NCAA for compensary damages? I’m thinking 50M for UT & 150 M for the athletes.

    Spyre rented the jet for Nico. They gave the NCAA the receipts. He was a client of Spyre Sports Group of the time.

    Glad they didn't bring Tony Bolognia Basilo to put in his useless 2 cents! Imagine a coach taking another job but he can't discuss his salary with his potential new school! Imagine getting a speeding ticket 2 years ago for going 55 in a 45 zone and later finding out the zone has been changed to 35 mph and you now owe additional fines years later. NCAA is trying to change the rules to fit their agenda. I hope every Tennessee athlete sues the NCAA!

    Plowman made it clear there would be no negotiated conclusion. Additionally, the law suit calls into question “who’s in charge” of interstate commerce. That’s a no win situation for an organization that is universally considered useless on all levels. A larger issue may be if the NCAA will have to revenue share the tournament money.

    From what I understand it doesn't matter when they had the rules because they're going back over a year to Nico's recruitment. I agree with Our AD. They have a predetermined penalty and they're bending the rules and going back as far as needed to enforce the punishment. It's so wrong.

    Hasn't the NCAA been "looking" into this since December or maybe earlier? At least being on campus? If so, I am sure that Spyre Sports, The Volunteer Club and UT had many meetings with lawyers, politicians and the state attorney general and I'm sure they were asked questions, etc. to make sure the politicians and AG were comfortable to be on board with a lawsuit.
