Two legal heirs (sons) staying jointly in 1 society flat wth share certificate on elder sons name. The property was purchased by their father (via cheque in late 70s) for both of them.
(There was no sale deed and flats were given on allotment as the entire building was for extended family members)
Now flat is sub divided (mutual understanding) into 2 individual flats with separate toilet, kitchen, entrance and electric meter.
Can the other legal heir(younger son) be eligible for membership and ownership.

Sir you told that in class 2 , for succeeding the property one who is alive first then the property will go to that particular person. So in class 2 in 2nd group suppose all are alive SDS SDD Brother Sister all are alive then the property will go only to SDS or to all members i.e SDS SDD Brother Sister ?

This happened due to 2005 amendment....some heirs are have added in class one and they are there in class two as well.
