The Problem is they are so quick to blame the child that was riding an e-bike and following safety rules by wearing a helmet and not the woman who wasn't wearing a helmet AND crossed the center line to collide with the child. Oddly enough the results of the accident would have been exactly the same if both parties had been riding normal acoustic bicycles. The woman perished when her unhelmeted head hit the pavement. she would have fallen if she collided with a normal bike too. The only reason the child didn't suffer the same fate is because he was wearing his helmet. It was the woman's fault 100% yet they blame the type bike the child victim was riding.
Edit: So why not ban ALL bicycles electric or non-electric?
Thanks for watching Chuck. Where the law is concerned, they do have to ban all bikes in order to ban the electric bikes. In Florida, defined ebikes Have the same rights as regular bicycles. I do know she was not wearing a helmet. I had not heard that she cross the centerline. But I do agree because they did not want to speak about the helmet issue at all during their meetings. My major issue with this is that out of all of their city. There was only one voice that stood up for ebikes. This does coincide with what I have been saying about the general public’s view on Ebikes. That view that the public has is what I would like to see changed. How we go about doing this I am not sure yet. Again thanks for watching. I am staying on top of this.
I haven't seen anywhere that she crossed the median line, but there's a telling report and photo in the Key Biscayne Independent dated April 22 2024.
She wasn't wearing a helmet, was riding a black bicycle at night with no lights, and there is no street lighting at that intersection.
The boy was wearing a helmet, and riding a bright orange bike with lights. He was on a moped-style eBike.
From that I'd say the fault lies at least 70% with the old woman who couldn't be bothered to even try to protect herself or other road users.
However the moped-style bikes are a problem almost everywhere, and clearly in Key Biscayne lots of kids were riding them. Why their parents are buying these for their kids is beyond me, they must all be rich.
The could have chosen to ban those style of eMotorbikes, or raise the age limit for eBike riders (16 in my city) , but they opted for a knee-jerk total ban.
@ziploc2000 The details on this accident are new to me. So thank you for that. I put in a request for the report, but because it was involving a minor it was denied. I believe honestly they could have done something with the style of bike that they have a problem with.
Because, according to florida, I do not believe they fall under the legal definition of a e bike. The vast majority are more than twenty mile per hour, and they do have a throttle. Of course, their argument would be enforcement in that case. Thanks for watching
@@southernebiking You can look up the exact location on Google Maps, seeing where it happened is quite revealing. It's an unsafe crossroads at the best of times.
The State of Florida removed the age restriction on eBikes in July 2023. They created this problem for themselves. In Oregon we still have the age restriction of 16, and people area abiding by it.
And I agree, these eMotorbikes that go 30+ mph don't fit into the class 1,2,3 system, and need their own regulations. To me they should be treated just like a motorbike and require a license to ride, number plate and insurance.
bikers wearing helmets are prone to take more risk so they are more dangerous for other road users
It just goes to show you that some government officials haven’t a bloody clue. They allow their position to go to their head. I’m 78 years old, and because of my knees riding an e-bike is the ONLY option I have if I want to ride. I’ll be damned if I’m going to allow some prick of an official take that away from me.

The bike the kid was riding was a Super73 Z1, which is their low end model that barely has enough power to climb hills. The boy had just stopped at a stop sign and was less than twenty feet away from his stop when the collision occurred, so he was not going fast at all. It was an accident and the boy did nothing wrong at all, and the outcome would have been the same if she hit a squirrel. But, this is a witch hunt, and they will blame what they want, ignoring the fact that the woman was on a black bike with no lights and no helmet and not paying attention.

@@Altema22 thank you so much for bringing this to my attention. I did find it and I’m looking at it now. This is a newspaper report. I have been trying to attain the actual police report. Of course I will get some thoughts out there and some emails to those in power if I can find something good on this. Thank you so so much.
Anything about the woman being under the influence? The Keys are kind of known for their partying culture. Biking while tipsy won’t get you in trouble like driving would.
@stanhry I have not heard anything along those lines. I do believe it was an accident and that is all. But their response is way off the mark
So they want to punish the 95% for the 5% of kids screwing around . I’m handicap and my best friends in attorney. I would love to sue them for not letting me ride my bike.

Address the real issue. The woman died from head trauma because she was not wearing a helmet, simple. So where are the rules?
@@rufusirvin5279 thank you for watching. Ironically enough, I did show part of their council meeting on one of my videos on this. When someone tried to bring that fact up, they were pushed out of the meeting. I do respect the one gentleman that spoke with me although I do not necessarily completely agree with him. The rest of this council, including the mayor has zero of my respect.

I am a strong believer in RIGHTS as an American citizen and the right to travel IS such a right just like the 2nd amendment is a right. Here is an example of how I feel about my rights ua-cam.com/video/iIvhntodJO4/v-deo.html
In Florida it IS LEGAL to open carry when hunting, fishing, camping OR going to or coming back from these activities! It is also legal to ride your bike (ebikes or not) in any bike lane, sometimes the sidewalk, and bike trails marked for bikes to travel down. It is a very dangerous stance to say to one type of bike owner that they are allowed to use a path, and to another bike owner that they are NOT allowed to use the same path!
Now, I DO however agree that the general Rules of the Road should apply to ANYONE using a right of way, or trail in general. I also believe a SPEED LIMIT may be a good idea on such trails which would eliminate 80% or more of the reason some people have issues with seeing Ebikes on certain trails or bike paths.
I wish we could ensure ALL of our elected and even non elected officials had common sense and used logic BEFORE setting new rules and policies but that may be too much to wish for in America today. ALL that is really needed is for THOSE who would be making such decisions to TALK with those who have issues about Ebikes (or any other issue for that matter) and find out from THEM what THEIR major concerns are about riding ebikes on their precious bike paths - and THEN work on solutions to THOSE issues as a team.
That is how America used to work generations ago and should be doing so today...
@@johnehogan thank you for watching John. You are making some great points and that is what I am doing with this one councilmember. I’ve emailed him some ideas and I have also CCed a copy to representative Lopez’s office. I think they could’ve solved a lot of this issue. Had they looked at what is legally defined as an E bike in the state of Florida. The majority of issues that they were having are with E bikes that do not fit that description. Am I saying we should get rid of bikes that do not fit the description? no not at all. But at least that would leave a percentage of the ebikes alone in this particular case. Florida state law does give local municipalities the power to determine if they will allow ebikes on sidewalks and bicycle paths. I do not believe they were given that power over public roads. As far as the common sense, it’s pretty uncommon anymore I’m afraid. Again thanks for watching.
I see the main issue is bikes that have a throttle and those that don't.
@@marcusrawls2125 i’m not gonna say it is so much just the throttle. I think a lot of issues that are creeping up in a lot of areas about ebikes being ridden, unsafe, have more to do with the bikes that look like what we used to call a minibike. I think most people are unaware of what an E bike is if it looks like a traditional bike. But when they see the type spoken about above. They know immediately that it is an E bike, and from as far as they are concerned, it is being ridden like a motorcycle on the throttle. they then start to feel like all those ebikes should be banned. I am seeing this more and more as the general public only sees little motorcycles as E bikes. Now how do we change that? I’m still working on that. Thanks for watching friend.
Just the other day on the freeway there were like 10 kids on 10k+ electric motorcycles (surron type) just blocking the end of the on ramp doing donuts. I think this is just going to end with us having to register the bikes and get plates. Most of the stories of towns I hear banning bikes it's because these rich parents just buy their kid a motorcycle and let them run wild.
@RagingDork I don't believe it needs to end that way. All of these surrons are not considered ebikes, according to the law in every state I am aware of. Therefore, They need to address what the industry calls. Ebikes, but the law does not and leave what the law has already determined to be a low speed electrical assisted bike Alone.
