      “shot 4 times in the back” certainly doesn’t sound good but the thing is going to be what is documented of the abuse?! them both being military adds another level and the cops went out to the same house several times in one be day and didn’t order them to split up for the night? they’ll even usually get a female a room for the night!

      After listening to the police questioning again, she sent her twelve year old up to the master bedroom with the younger children, and then went into the garage to confront him. After the shots she took the kids to the neighbors house. Those poor children most likely heard those shots that killed their father.

      Almost. They saved her by over charging her. That's the same reason Casey Anthony is not on death row. All they have to do is charge them with 2nd degree murder and get the maximum penalty of life in prison. They can't prove premeditation. The jury can't modify the charges. • @joedirt3970
      @joedirt3970 3 місяці тому +7

      Amber Heard SHOULD have called the police in real time as the events occurred. Yes I personally understand the apprehension of police involvement however you need to document everything through law enforcement. Coming later, even with pictures, won't show the precise timeline. Her trial against him was civil. For money. That doesn't look good and raises questions of the victim. They were both wrong and toxic. Sometimes you just have to cut your losses. I lost everything and I was almost beaten to death. My ex tried to unalive himself many times but I wouldn't let that happen on my watch. I am first and foremost a mom. I lost my home, all of my money, but it made the divorce very cut and dry. My children have PTSD but we are doing good today. We are alive and grateful. Years later I had another child 20 years after my first. I won't tolerate voices being raised in her presence. If there is a bad vibe I remove myself. I do not engage in arguments because they lead nowhere. You never take a parent away from a child UNLESS their safety (in all ways) is in question. Document everything.😢🫂

      It honestly depends on the situation, events, and scenario. There have been some cases where someone is battered so badly , over and over again, that their brain kind of flips and the defending themselves either goes overboard, or they see no other way out. They still get charged for killing, but it's a mitigating factor. But in the end, it depends on the situation. I do agree with your end statement, that this scenario in this story doesnt support it.

    She has to serve her time, and then she has to face the military justice if she is still on active duty. The military will be a lot harder than civilian law. Leavenworth is a hard prison. She should have thought long and hard about her actions. Dishonorable discharge follows you more than a prison sentence. She's got both.

    • @DocP91B
      @DocP91B 3 місяці тому +8

      It doesn't really work like that. I spent 21 years in the military. In order for the Navy to charger her also they would have to file for dual sovereignty otherwise the double jeopardy clause comes into play. In order to be granted dual sovereignty to charge her the Navy needs to prove they have a separate vested interest in justice. They don't. The crime was committed off base and the victim was her civilian husband. He's a retired Marine but his current status is civilian.
      She's automatically going to be classified as RE-3B because she's spent any time at all in confinement. So that knocks out any chance for reenlistment.
      Any time spent in civilian confinement is considered lost time. That's time that no longer counts for pay, allowances, retirement, or benefits. The Navy can choose to expedite her discharge but in general after 6 month consecutive loss time days it automatically begins the other than honorable discharge process. This results in the offender being discharged from the military administratively, not punitively - though they will no longer be eligible for any service benefits.
      The max penalty for this case is life without parole. If she's given that sentence there's really way for the Navy to make a case for dual sovereignty in the interest of justice. They can't put her in jail after she's dead. She's automatically losing all pay and benefits. There's no point to holding a court martial in absentia just to strip her of rank and pay she's going to forfeit in 6 months anyway.
      This case was deferred to civilian authorities because they held jurisdiction where the crime was committed. The chances of the Navy doing anything besides the administrative discharge paperwork is slim to none.

I know this because I work for one of those organizations and have driven across the state in the middle of the night to help women escaping a bad situation.
