- நான் எனது கடைகளைத் தானே பயன்படுத்த வேண்டும் என்று விரும்பிய போது, இரண்டு கடை வாடகையாளர்கள் வாடகை இடத்தை காலி செய்துவிட்டனர். ஆனால், ஒரு கடை வாடகையாளர் தாமதமிட்டு, போலீசில் புகார் கொடுத்து, பின்னர் ஏப்ரல் 29 ஆம் தேதி என்னை எதிர்த்து ஒரு வழக்கை பதிவு செய்தார், மே மாதமெல்லாம் கோர்ட் விடுமுறை என்பதால்.
நான் என் வாடகை ஒப்பந்தத்தை வாடகை இணையதளத்தில் பதிவு செய்தேன், பின்னர் ஆர்.டி.ஓ. (Revenue Divisional Officer)க்கு புகார் செய்தேன். அதிகாரிகளுடன் முறையாக தொடர்பு கொண்டு, விசாரணைக்கு அழைக்கப்பட்டது. முதலில் எனக்கு பின்னர் எதிர்மறை தரப்பினருக்கு விசாரணை நடைபெற்றது. ஆர்.டி.ஓ. கடையை 30 நாட்களில் காலி செய்ய ஆணை பிறப்பித்தார். ஆனால் அவர் கடையை காலி செய்யவில்லை. பின்னர் நான் ஆர்.டி.ஓ.
ஆணையை மீறியதாக புகார் செய்தேன். அதன் பிறகு எவ்வாறு அவரை வெளியேற்றினேன் என்பதற்கான முழு கதையை இந்த வீடியோவில் பார்க்கலாம். மேலதிக தகவல்களுக்கு வீடியோவை பார்க்கவும்.

One tenant creates trouble since last 7 years and not vacating the house , we filed a case and it is running since last five years. we attended all hearing but tenant never come to court at all. As suggested by lawyer we deposited 5 lakhs advance in the court bank account five years before itself. Now tenant is happily enjoying in our house. My parents were always worrying about this, my mother died and my father always talking about their leaving at the age of 70. Finally we won but the judgement looks unfair. As suggested by Lawyer, filed an another case to vacate them through court. As mentioned in the judgement tenant should vacate the house by December 2023. Now June 2024. Case is still going. Tenant is not paying property tax since last three years, not giving money for maintenance, we are not getting any interest from the advance money. Spent almost 70000 rs so far for case fee. What kind of system are we living in ? 😢
Thanks for sharing your experience sir, I see that your lawyer should have asked you to file an eviction suit parallelly when you were a defendant in a previous case, so you could have saved time. Be positive, truth wins at the end. 👍

புதிய சட்டம் அல்லது புதுபிக்கப்பட்ட சட்டம் நடைமுறையில் உள்ளதா?
11மாத ஒப்பந்தம் நடைமுறையில் இருக்கும்பொழுது( ரினுவல்)
புதுபிப்பிப்பதற்கு ஒப்பந்தம் முடியுமுன் செய்யவேண்டுமா அல்லது முடிவடைந்த பின் செய்யலாமா
திருத்தம் 2018 மற்றும் அதைத் தொடர்ந்து 2020 திருத்தமும் செய்யப்பட்டது.
2-3 மாதங்களுக்குப் பிறகு அல்லது அதற்கு முன் நீங்கள் ஒப்பந்தத்தைப் புதுப்பிக்கலாம், ஆனால் நீங்கள் ஒப்பந்தத்தை மேலும் புதுப்பிக்கிறீர்கள் என்பதைக் குறிப்பிட வேண்டும்.

Leave this now, save your peace.. Next time be alert, prepare a rent agreement and upload it regularly, so anytime you can protect yourself and vacate the tenant without rushing to Police or SP office.

Do we have such act in Karnataka
Only Tamilnadu has implemented this Tenacy act recommended by the central government. However in other states they are bringing tenancy 2021 act, sooner Karnataka will also have tenancy act.
Hello sir, I never registered with RDO. My tenant is not paying rent for several years. Court case is going on. What should I do? Can I register with RDO now?
Who can register rental agreement? the agreement should be in the current period and must not be greater than 3 months from the date of signature. In some cases upto 6 months. If your agreement was expired then you cannot register it.
You make a new agreement and send a letter to the tenant to come and sign the new agreement.
If the tenant refuses to sign the new agreement, then you can report his refusal to RDO.
Refusal to sign the rental agreenent is itself a reason for vacating the tenant as per new tenancy law..
Go through the new renancy law thoroughly in the website.

இரண்டு காப்பிகள் ஆக இருந்தால் நங்கு இல்லையெனில் யார் தயாரித்தார்கள் லோ அவர்கள் ஒரிஜினலை வைத்திருப்பார்கள். வீட்டின் உரிமையாளர் ஒப்பந்தத்தை செய்திருந்தால் அவர் ஒரிஜினலை வைத்திருப்பார் ஒருவேளை குடியிருப்பவர் ஒப்பந்தத்தை தயாரித்து இருந்தால் அவர் ஒரிஜினல் வைத்திருப்பார்.

not every where sir, but in my case also RDO accepted the online reference number itself without any further investigation of verifying the originals.

நீ வாழ நீயே வாதாடு என்ற கோட்பாட்டு பின்பற்றும் வாரண்ட் பாலாவின் சட்ட புத்தகங்கள் உதவும். எந்த வழக்காக இருந்தாலும் சட்டம் தெரிந்திருந்தால் ஆறு மாதத்தில் முடித்து விடலாம். ஏனென்றால் ஒரு வழக்கில் மூன்று முறைக்கு மேல் வாய்தா கொடுக்க நீதிபதிக்கு உரிமை இல்லை.
