How to deal with police

  • A lot of people gasp "What happens when you get caught by the police?"
    Simple answer: If you haven't commited a criminal offence, and you're polite, nothing happens. There are a few things they need to hear before they can let you go. We get these said as early as possible, and our encounter lasts around 1 minute:
    We correct them when they say we've "potentially committed a burglary"
    We confirm that we came in through a non-destructive methods
    We confirmed that our photos are for non commercial purposes.
    Always be polite, not cocky, but do correct them if they're wrong!

      UtterlyAwesomeVideos Yes. There's a basic expectation that will never be covered by law. Be nice, don't screw about. Don't hurt people. Even better, help people. When you are "arrested", then you are just that. It's troubling to have your hands locked behind your back and to be locked in cells with really disturbed individuals, spend thousands on representation, having no access to medical care... Yet. Basic human rights (WHO) state that if you are not braking any laws, and are acting in the human interest, you should be allowed on your way. That's not the US constitution, but the agreed constitution of a human's basic rights derived by the World Health Organization. Stand up for human rights. Stand up for your transportation rights. Help bust the criminals, and share their experience as best you can..

      Same here, I'm trying to find what they're like regards filming/photographing in public (found the answer 'public land yes, private land no) and it's nice to see a constable with some common sense. to be fair to the Police they are trying to do a job and the way people treat them while on camera is really asking for trouble, be fair and nice and chances are you'll be told to be on your way or given the correct answer as to why you can't film/photo in that location, be an asshole and give the Police some cheek and expect to treated like a dickhead.

    This is how a police stop should go! Sure, they committed a crime, but the police were decent. And yes, the police are subject to certain regulations in making their work, but that doesn't mean you need to treat them like robots you can input commands to. Between assholes thinking that they can just tell a cop off and he has to leave them alone, and cops arresting innocent people without a valid reason, I feel that you guys have reached a kind of perfection in police stops. I applaud both you, and the officers. This is a great example of people treating each other with respect and dignity.

      DrewPeacock69 I know its nice to say most cops are like that, but in my personal experience mostof them are power hungry, but subtle not like ,monsters who beat you, but a total lack of compassion and kindness and a rudeness and a unconscious separation with the citizens they protect. Those are how most of my interaction with cops have been. I have though met very kind professional cops, but I have to say they are in the minority. The problem is we need the training to be totally reformed. You are to serve and protect. The serve part is to be apart of the community not seperate from it. I understand they do a difficult job, but as many cops will tell you they view the fellow cops as "us" and the people not in uniform as "them" That is a fundamental thing that needs to change.

    Trespass isn't a criminal offence, it's a common law offence. You only become a trespasser once you have been told to leave and refuse to leave. If you are in the process of leaving or you don't refuse to leave when asked to then the police really can't do anything.
    Also, what he said at the start doesn't apply unless you have tools which could be used for criminal damage. Obvious tools such as an hammer, wire cutters, etc. Anything you wouldn't usually carry with you let alone when entering someone's land.
    I learnt about trespass as a security guard at WH Smiths. Whenever we caught someone stealing we would ask them for their details and then tell them they are banned from the store. If that same person came back into the store in the future he was a trespasser and we could use force to eject that person from the store if they refuse to leave.
    Either security guards learn more about the law than the police or the police know what they are saying is bulls**t

    • @urbanxphotography1
      @urbanxphotography1  9 років тому +3

      Tzimnewman3 Top stuff. MOST security on these types of sites are up with the law, unfortunately theres still the occasional goon. This particular guard is spot on, and is pretty well respected by our community. If he ever needed us we'd be there for him.

      You and your 'crew' must be morons then. Why do you have to go around causing damage,even if the buildings are disused !?? You deserve to get nicked every time out ! (and no,I'm not a police lover....quite the opposite.).

    • @4TheRecord
      @4TheRecord 8 років тому

      "You and your 'crew' must be morons then"
      I don't have a "crew" and the only times I've been in empty buildings is when I was employed as a security guard to look after them.
      "Why do you have to go around causing damage,even if the buildings are disused !??"
      My job was to protect the buildings from damage. If I came across anyone just walking around taking a look I would inform them to leave. If they refused then the police would get involved since it would at that point become tresspass. But if people just left when asked too only a report needs to be filled out and an entry in the Daily Log book.
      "You deserve to get nicked every time out ! (and no,I'm not a police lover....quite the opposite.)."
      The law doesn't work that way. I've been arrested three times and I got compensation for false arrest because police officers don't seem to understand the law they are employed to uphold.

    • @Jayen4
      @Jayen4 8 років тому

      Depends. If it was my back garden during the day, I'd say "What the hell are you doing in here!" because virtually all of the time they would have had to climb over a 6 foot fence to get in; I keep all three gates locked unless I am in the garden. In my back garden at night, I think I would just clock them with something, since they can't possibly have innocent intentions, and I feel I would be perfectly justified in defence of my property and my personal safety. This is a good example of how interactions with the UK police often go. No posturing or bravado, just two humans interacting. My only objection is that the PO is using arrest an release as a threat, when it really shouldn't be if justice is to work perfectly, but no one wants the inconvenience of that. I feel the PO knows this and is using it as a tool.

    and fair play to the security guard too... you usually see them try to beef up and get all in your face....
    but, i will tell fellow urbexers.... that i was at a hostel in Berlin with some guys... they decided to explore the abandoned spreepark.... got stuck on the fair wheel.... it just moved on its own.
    MERCIFULLY..... a security guard saw them, called the police. The police and security guard had to MANUALLY wheel it round so the guys could get off.
    The German cop was shouting and screaming at them, he didnt speak any English... at the same time.... he was tapping his pistol. The people didnt speak German, they knew they were on private land... and were worried they were going to get a bullet in the head. But the German police arent all bad. Eventually a young German officer turned up, she spoke English fluently.... she had a massive go at them, the urbexers for a 300 euro fine and a stiff lesson....
    again, fair play to the cop and guard.

    Sometimes, in all matters not just this, it's possible to get an absolute ****-end of a police officer.
    On the other hand, on other times its the other party that can act very uppity and obnoxious and get backs up.
    This is how a situation being dealt with - and all sides walking away with dignity and treating the other with respect.

      They were actually trespassing, and had climbed over the fence into a place they were not supposed to be.
      Auditors, on the other hand, usually only go where they are permitted to be to take photographs, and often get all sorts of horrendous shit from cops who like to throw their weight about. Then they tend to get shit back in return, rather than politeness. "Can I help you, mate?", and "Can I ask what you are doing, my friend?" and "Do you have any ID on you?" are challenging and uncivil questions.

    Fair play to all! That's Michael, the security guard yes? Top bloke actually, he busted us a few years back, absolutely sound he is! Just doing his job, but we went back & saw sevs about a year later, lovely old buildings, absolutely massive! This is how urban explorer's should be dealt with, little talking too, nothing else. Hope you guys managed to get back in & get some pics though? Cheers

    For ANYONE not from England that has just watched this.....
    Don't kid yourself that this cop's behaviour is typical of all the cops over here.
    He is a decent guy and knew that everything was of minor importance and treated it as so.
    The camera guy was respectful too and that helped everything chug along nicely and they parted the best of friends.

    Perfect example if what happens if you're polite to cops. Over in 3 mins even though a small breach of law was committed. But the officer measured the facts, saw it wasn't in public interest and let them go. Moral of the story - cops are human. If you give them abuse, they will not want to help you much. Treat them nice, they will try to make things easy as possible.

  • @Jah-Know

    It's a civil offence and that is it. No arrest possible unless evidence of a criminal offence.

    • @joshdunne
      @joshdunne 9 років тому

      Incorrect. You can be arrested on suspicion of anything. Likely case being burglary whilst the officer establishes intent through investigation. If indeed no intent proven then you will be released without charge.

    • @epatterson1170
      @epatterson1170 9 років тому +1

      +josh uaa - you can not have suspicion without grounds such as behaviour, words or actions, to justify those suspicions. Otherwise I could arrest your mother on mere suspicion I may have, of her being a terrorist.. which may be just because I saw talking to a Muslim person..

    • @joshdunne
      @joshdunne 9 років тому

      E Patterson the key word is reasonable suspicion. Your example you give would not be reasonable. It's just racist lol.
      However it would be reasonable for a police officer to presume that a person found within private premises that is not open to the public by payment or otherwise was there to commit either theft or criminal damage, thus burglary. The officer, providing they could show necessity to arrest; for which one could argue a necessity of needing to prompt an effective investigation by means of interview would suffice, would be well within their rights to arrest in these circumstances. There is no difference between being found here vs being found in your own private dwelling. It all boils down to intent. One could argue if I walk into your house and the police arrive so long as I tell them I'm only there taking photos, they should just let me go. In principal this is true. In reality you'd want me arrested and you'd want them to interview me and investigate to establish my true intent. Hope this makes sense.

    • @joshdunne
      @joshdunne 9 років тому

      I should add here though, I don't actually know where they are as that would impact on things also if it is not a building :) In addition to this, my comment relates only to UK law.

    • @Jah-Know
      @Jah-Know 9 років тому

      Josh you are factually incorrect on a number of points, and I hope that you're not a police officer otherwise there would be good reason to review any arrests you have made.
      Firstly, - People do occupy land or buildings without the owners permission and this is commonly called squatting or trespassing, which is a civil offence not criminal offence.
      Second, - You would have to have provable grounds or reasons to show that the person had the mindset, actions or articles to commit a criminal offence. You can't go on a fishing exercise afterwards to try and justify an arrest. (pretty basic stuff really)
      Thirdly, - If I left my door open and a person walked in and did NOT steal anything or did NOT cause any criminal damage, then they would be just trespassing which is a civil offence, Unlike burglary which requires both the mindset,actions or articles when entering into private property. So unless you can see evidence of a criminal offence.
      I would not want police arresting people just because they suspected that they had committed an offence without any evidence to justify the arrest.
      Police officer can question and search a person for evidence of an offence, but you can't just assume and then hope to prove afterwards. Otherwise all the bankers in the city would have been arrested after the last banking crisis ( maybe you weren't on duty that day).

    This is why i respect UK cops. Ok not all are this chilled but that was a good interaction on all parties. They knew they were trespassing. They admitted it. Cop let it go. NO need to escalate the issue to a point of getting shot like they do in the US.
