    If the name is trademarked in a different state, can you still use it in the state you are in? There is a small company in Wisconsin that has the name I want to use. But i’ve seen multiple business with the same registered name outside of the one I’m trying to use.

      No, you cannot use a trademarked name if it is out of state. Trademarked names are registered with the U.S. Patent and Trademark Office (USPTO) and are protected nationwide. When you register a trademark with the USPTO, you are granted the right to exclusively use your trademark across the United States. This means that you are prohibited from using a business name that is already trademarked, even if the company operates in a different state.

      When you register a trademark with the United States Patent and Trademark Office (USPTO), you (as the trademark owner) are granted the right to exclusively use your trademark across the United States. In other words, only you can use your mark, and you can prevent others from illegally using your mark.
      A trademark can protect your brand name nationwide. It can also:
      Allow you to register your mark with U.S. Customs and Border Protection to block imports of infringing goods
      Give you the right to sue for trademark infringement in federal court
      You should register your trademarks regardless of how long you have been using them. If the other business registered the mark prior to your first use of it, there is an issue. You have to sign the registered user agreement with the trademark owner and get yourself registered as a “registered user”.
      Trademark infringement is prosecuted under civil laws, and is not a criminal act. Instead, lawsuits over trademark infringement will usually require you to stop using the trademark, and you may have to return any profits made off of the infringing use, or pay money damages for the use of the trademark.
