How to Know if You Have a Winning Disability Claim

  • I get emails and calls every day from concerned disability applicants who want to know if they have a winning case. Often these potential clients explain in detail about their medical problems what a recent diagnostic test (like an MRI or CT scan) has shown and how they are suffering.
    As I discuss in this video, I think that these folks are asking the wrong question. Social Security disability is not about medical issues. Instead the Social Security judge wants to know how your medical problem impacts your ability to perform the duties of a simple, entry-level job. This is the core issue in a disability case.
    So, no matter how serious the diagnosis, you are not going to win disability if we don’t have evidence that your symptoms or medication side effects prevent you from performing a simple job reliably.

    I don't know if you read these comments but I personally would like to say thank you. I just won my disability after a year and a hafe and on my own because of your videos and how you explain everything. I tried to get 3 well known attorneys in my area to take my case and they all refused me. I watched your videos on every step went to my hearing and won.

      All your videos are so informative! Thank you. I have a question. If someone is disabled for say a few years and over 60, qualified for SS disability benefits and they return to work and retire at 67 are full retirement benefits affected in any way?

    I'm 44 male with chronic lower back pain,Si joint pain and meralgia parastetica with 2 fail si joint fusion and I am going to pain doctors every month. had My court day this morning and was approved on the spot!! thank you for taking time out of your busy day for posting these videos, they really helped me alot to win my case! .to all of you dont give up!

    I've worked with cancer for 6 years, had numerous surgeries, I'm scheduled for knee replacement and 2 other smaller surgeries. I was denied at my application waiting reconsideration. Thank you for all the information, im sure it will be helpful.

      Heather as long as you are able to work, despite multiple medical issues, you are not "disabled" per SSA's definition of disability.

    Very good advice, i was able to get my the 1st time with the help of a lawyer.
    Your point that i was able to get it was exactly what you spoke about here. How dose my pain effect my ability to work. I also made sure my treating dr was willing to back me up for disability. I have enjoy watching your video cause i know several friends who is trying to get it, like most is unlike me and have not got it the 1st time. All your videos i have watch has been exactly what i have been told by my lawyer, it was able to help me get it 1st thur. Of course that is never promise. Thanks for your helpful video.

    "Reschedule the hearing so you can go to the ER..." said the judge. Why should a truly disabled person have to sit there and get chastised and insulted simply because they didn't give the "right" answer to some condescending judge. This is dishonest and should be explained as to what answer they really want. In fact why should everyone even be subjected to court hearings to get something they are entitled to? Court proceedings are very expensive but I'm sure the judges and other staff are getting paid quite well for denying CPP disability and meanwhile the disabled person has to live like a total degraded loser with no capability of earning a living. I had one judge sitting with a panel of 3 or 4 judges call me "a malingerer". I felt so insulted, degraded and like a criminal. The bone head lawyer that I had just sat there like an idiot and said nothing in my defense. There is no cure for what I have (cervical dystonia) so I'll never be able to work to support myself which makes my life even more unbearable in addition to the tormenting limitations I have to endure on a daily basis. (sorry this in regards to Canadian disability, not American but the denial for these benefits seem the same as in America. )

      Many countries also participated together with Americas SSI and covered their citizens retirement plan.
      Continue fighting you will get that somehow.

    Hello Jonathan. I had my hearing in Nov. I'v been watching your videos repeatedly for about eight months now. Thanks for the great information. Even peace of mind. I wondered in your experience as a lawyer do most ssdi cases look pretty similar? Besides the different illnesses is each case pretty typical.

      The process is similar but every case is unique. Every judge also has his or her own way of managing a hearing. But, big picture, there are more commonalities than differences.

    I went in front of the judge 6 months ago and I still haven't received anything yet if I get denied I could have been half way through my appeal and every time I call my lawyer all they say is we haven't heard anything yet I know you have not heard anything yet I just want to know if there is anything that can be done is there a cap on how long it can take the judge to make a decision and if not it should be it's sad that it already takes almost two years just to go in front of the judge and then you have to turn around and wait wait wait and it's sad because the judge knows you've been waiting forever already something needs to be done about the judges making people wait just to get a decision and the lawyer don't make it no better I shouldn't have to keep calling her she should at least call me and say something and I just found out through the reception that the longest decision was 11 months that is just wrong and I still don't know if that person was denied or approved if they were denied that's the time it could have took for the appeal thank you very fustrated

    I have Lyme disease . I'm so sick. I'm in the bed all of the time. It has ruined my life . I want to work. I feel so useless. Im just so sick all the time . 😢😢😢

    My case must have been different. I have watched almost all of your videos. My judge did not ask me how my symptoms affect my capacity to work. He did NOT ask about my activities of daily living. He did NOT ask me about my med side affects. He did NOT ask questions to the vocational expert. He did however keep asking about my chronic vestibular disorder. Maybe I met a listing. He also told me he would have a decision made by the end of the day.

The other questions are just for him to learn more about something for his own knowledge. :-) I'm sure it was approved, based on my thoughts on the post. :-D

A supervisor called yesterday and asked me questions about something I had written on my application, is this a good sign?     I am 53 years old and in June 2015 was the last time I worked. I currently see a pshychiatrist, pulmonolgist, uroligist, endocrinologist and family doctor. I have seen a orthopedist, a neurologist, neurosurgeon and nephrologist this year also. My diagnosis are PTSD, anxiety, Bipolar 1, coronary artery disease, acute kidney failure ( that has been resolved for now) type 2 diabetes with peripheral neuropathy and bladder neuropathy, SI joint that needs titanium implant, strokes, TIA's, COPD, bilateral pedal edema and others I can't remember. I applied in August 2015 and filed my appeal in December 2015. I have at least 3 appointments a week that include weekly counseling sessions, group therapy and a caseworker. I have a high school diploma and have done warehouse work for over 25 years. I use a cane and I can't sit or stand for long. I take approximately 13 meds a day. When should I expect a hearing and what do you think my chances of winning are?

      Based on what you are writing you have a very strong case. As far as a hearing, that depends on when you applied - currently the delays are about 2 to 3 years. If you have not yet applied, and you have records to back up all that you are saying you have a decent shot at an early approval.

    I don't think it'd fair, I have osteoporosis, osteoarthritis, spondylosis, myalgia, costochondritis, progressive arthritis, high liver enzymes, high blood pressure, migraines, bronchial asthma, hearing problems, sinus problems, , much much more, memory problems along with anxiety and depression, and with all that my pain is at A 10, 24/7, because if it's not one thing it's another on top of the other!

      I believe you , I have diskitis, spondyculitis, the pain was excruciating it felt like the worst cramps in my legs I've ever felt, and on my butt it felt like I had 10 brown recluse bites under each cheek it lasted for 4 months until I had surgery, they fixed that , but I still have back shoulder, and it feels like my hip is out of socket , it's really painful my pain is now about a 5 during the day and a 7 at night, but for those 4 months before surgery it stayed at a 10 constantly NO STOPPING ,I contemplated suicide every day, my doctors believed me and did surgery as soon as possible,

    I had a phone hearing two weeks ago after initial denial then 2-3 years wait. I moved to Germany last year, the reason for phone hearing. I am married to a German man. I have acquired new physical issues since the time of my lawyer started my case , requiring surgery. My German orthopedic Dr. prepared a letter for the JobCenter that I am unable to work. I told the judge this.
    I recieve a monthly benefit from the JobCenter because I cannot work.
    The judge was made aware of this and asked how much I receive.
    With these facts of Germany supporting me as an American Citizen will this have any bearing on my case? Thank you for these videos, very helpful.

    I went to my hearing on Monday and the VE compared my situation to a person who could work then he gave thousands of jobs but once my attorney ask is there jobs that will be available that I would be able to miss a lot of days at a time have supervised vision while working and not be around other people and trouble following simple task will there be any jobs the VE then said no sir there wouldn’t and after that they said that’s all and the judge then said wait for her letter 3-6 weeks from now my attorney said everything went good so I’m only left to believe the judge 👩🏽‍⚖️ will approve my case being that it isn’t about your conditions it’s about weather or not they will affect your ability to work

      Social Security Disability videos I checked myssa.gov and it said a decision has been made everything went good in court my attorney stated and the VE stated there was no jobs for me and my condition but I’m nervous because a decision was made so quickly . The judge did tell me I’ll hear something from her within in 3-6 weeks now I’m just wondering if it’s approval letter or denial

    how about a cervical cancer diagnosis .. but I now have pain from Neuropathy that limits my ability to stand or walk for long periods of time

      It is not so much about the diagnosis - although a cancer diagnosis does suggest some significant impairment. Your chances of winning go way up if one or more treating doctors will fill out a functional capacity evaluation or write a narrative report that identifies specific work activity limitations arising from your condition and the treatment. You might also look at listing 13.23 - www.ssa.gov/disability/professionals/bluebook/13.00-NeoplasticDiseases-Malignant-Adult.htm#13_23 or other sections at listing 13 to see if any of those apply.

    I suffer from knee pain from osteo arthritis, depression & anxiety, & sometimes subconscious voices that i cannot always quiet down, they influence how i think sometimes. I applied for SSI in May of 2015 , was denied twice. I appealed but I gave up & didnt appeal for the last time because i was so depressed about being denied. Do you think i have a good case ? Should i reapply?

      Jamii Nelson don't give up get an attorney my husband got an attorney after he was denied twice i thank God for doing that because she took the load off of us. Trust me once you get a good attorney they will gather all the info SS needs. you have got this far don't give up

      Hopefully you’ve been approved by now. Honestly I just had my first hearing today after being denied by mail and I can absolutely understand where ur coming from. It’s SO much damn paperwork! But honestly I would want someone to tell me “you’ve come this far, you’ve fought too long to give up now”. U just have to keep banging on the walls around u keeping u imprisoned till u finally smash em down. I have alota the same issues u have. It’s both mental AND physical. Ppl need to start understanding that often times mental leads to physical. However I think w the jobs I’ve done throwing luggage for an airline, & wrestling adolescent kids in group homes during restraints did some serious damage to both my knees AND my back. However my lawyer said it’s too hard to prove orthopedic situations when I’m only 40 years old. So I mean I tried to go w the mental issues but I don’t think I pushed those hard enough. But I didn’t wanna speak till spoken to either.

    My HMO does not provide opinions on employment fitness. How do I get a physician that will provide that to Social Security?

      Often times, physical therapists can refer you to a functional capacity evaluation center. Or you may want to talk to your lawyer about finding a private physician who will perform a consultative evaluation and issue a functional capacity evaluation.

      mr ginsberg i worked and i have the time in reguired ,i get ssi ssdi,sir i money that a person gets when they never piad in or have worked in thier life ,your video stated a person with the time in recieves between 1500.00-2500.00. i get what they pay some-one who has done nothing in thier life 738.00$. i worked hard that little money cannot or is not right.at the least i probly should get what u stated between 1500-2500.$ my case was 3 years back money was small.if possible could you tell me how or what to do to fix this under payment problem

    I recently filed an appeal for disability I had mri stating I have a flatten nerve ,spinal stenosis, arthritis in my back. I also have diabetes,nerve nerosous in my legs, have had my prescription for my eye changed twice in 4 months so why do they deny my case? high school quit in 9th grade so no computer knowledge? ave only GED

    Vasculitis panniculitis, venous stasis disease and Lipodermatosclerosis ...progressing over a 7 year period with doctors stating this is what I have and in the files. I am 62 and can't sit,stand or ride in a car for anything more than an hour without swelling and pain, I wear compression stockings and have had venous ablasia done on both legs upper and lower..I need more per the doctor. ...Now I have leg ulcers that won't heal for months. Does this sound like a type of disability that will win? I was going to file for SS early at 62 but wonder if I should file for SSDI instead.

      Your disability check is based on your social security. If you have no social security earnings then you will get ss supplemental. You might talk to someone at your local SS office.

    i got denied by the judge but since then my health has went down and have had a neck fusion done in feb of this year, i can not do the entry jobs they said i would be able to do can hardly do reg stuff like walk and use my hands, they still have horrible pain and numb to dead in fingers, let alone another surgery to fix the now five bulging disks in lower back, saw three specialists and had them all turn around and say i needed surgery right away for my neck, it was squishing my spine that much, and it is hard when the meds they normaly use for depression does not play well with my head or body, so just work on the anxiety and i try to find things to do, now can hardly do even that because of my hands and neck, should i wait to aply again? husband is trying so hard but it is hard to find work and unemployment ran out, i want to work so bad i miss it but body will not let me anymore, it is sad

    So someone who lives in constant pain should not say they live in constant pain? I'm allergic to pain meds. I have lived in pain since high school. I have never been able to hold a 9 to 5. I tried to get on disability when I was young but they said I do not qualify. Now I am 53 and I can't continue down this route. I need help.

    hey there sir, i was disabled by my psychiatric doctor in 2010, due to mental illness, but as a veteran i have that built in fight in me and i thought id get better, but over the years i only got worse, I applied for disability finally in June of 2018,,, i have 27 years payed into SS. I met the listing i believe through the reports of being sent when an Arbito sent me to there doctors for approval, that ill be accepted to receive SSD. How will they determine the amount ill receive, or how will determine when my pay date will begin, from the time my first psychiatric doctor declared me disable after i got out of the mental health ward, or will i just get the one year back pay of back pay
    ? or could they go back 8 years ago when i was declared disable by my doctors, or can i ask for a hearing for a judges decisions on when the start date begins ?

    I have lupus, sjogrens disease and rheumatoid arthritis. my eyes are so inflamed, not to mention all the medication I take. I have worked 2o years and im due to retire in 2 years. Am I eligible for ssdi and my pension? I don't think I can live on my pension alone, id need 10 more years.also I havent paid into social security because of my pension does not require it. thank you for your info

    Hi Sir! I have a hearing scheduled for Jan 15th.. I have 2 herniated disks, DDD, Stenosis and severe Radiolopathy and other spinal disorders. Ive had MRIs, (MRI states High grade narrowing of the spinal canal) , Xrays ( Xrays States high levels of degeneration) EMG and bunch of other tests that came back positive. I've had steroid shots, pain management, physical therapy, laminectomy/Dicskectomy surgery Sep. 20th and I've gotten nothing but worse. It's also killing me mentally and am on anti depressants and such and have been seeing a physiciatrist witch is not easy because I'm in so much pain and and sitting for long periods is not easy. My neurosurgeon says I need plates and rods and has been saying that since day one but we tried these other things in the mean time to see if we can hold off on the plates and rods for as long as possible. The neurosurgeon never asked me if I was in a disability case but he did my last visit and didn't seem happy that I didn't tell him. He said I need plates and rods but will not perform another surgery on me until my disability case has resolved itself. Have you ever heard of anything like this? My lawyer didn't seem happy the Dr. Said that to me either and said he's going to let the judge know..

      I have had lots of back and neck problems. Your surgeon does not want you stressed out for your surgery and he also needs you to be able to recover properly. There is no reason why you should cancel your hearing. You will be better prepared to have your surgery once it gets resolved. I have continued to live my life with just pain meds , no other kind of interventions anymore. I got my disability 10 years ago after filing for help first through the Dept. of Health & social services. My doctor told them I could not work..I had a work evaluation done through them and I was declared unable to work. After that I did all my tests, filled out the forms, went to the physiologist, and handed in my papers. I never appeared before a judge and I was accepted immediately. I really believe DHSS got me evaluated before hand and their comments got me my acceptance. I know it is difficult when you are in pain and really worried. If you have a friend or even the social worker through your hospital..try and get help in filing out forms. The most important point is that you are not able to work. You can not sit for very long and neck pain keeps you non functional. Your doctor sounds like he is trying to advocate for you and maybe speed up your process. I wish you the best. You will be happy,

    Question for you? The ALJ hearing went well my attorney was very happy! The way it turned out!
    My case is (Pending Post. Hearing!) And Looks like the judge ALJ is reviewing my case?) Im miffed what he is stuck on??     I have Major Depression, Agriphobia, Memory issues and a degenerative disk issue. I have been through 7 jobs in 5 years. 4 I have been fired for job performance do to withdrawing at work.
    I have not worked for a year. I cannot stand longer than a an 1 or hour and a half..My focus and concentration is short term do to my ADHD.

      Debra I can't guess what that means. It could be that the panel psychologist had a conflict and needs to reschedule or it could mean that the medical records in your case were compelling enough to support an approval. Or it could mean something else entirely.

      Yes, many times. I generally get approvals if my client is a combat veteran and can describe in detail the events that resulted in the PTSD, and if I have strong support from a treating mental health provider about the activity limitations arising from the PTSD and anxiety.     Hello. I applied for DAC under my dads record, I was originally approved as a child in 2006. My question is if the judge and my attorney gave the VE hypotheticals and she said no jobs. one of the hypotheticlas she said no to was missing 3-4 days a month and my medical condistons matches that hypothetical. is it possible for me to be approved on that hypothetical?

    I just had my hearing yesterday and I have schizoaffective disorder, ptsd, and panic disorder. I was there for about 15 mins, I have been unable to work for 4 years due to this. But the vocational expert said that I couldn’t do the work I used to do but was able to do other work. I’m not sure if I’m going to get denied or approved.

      If the judge accepts the VE testimony that you could do other work then, unfortunately, you will not win.

    I worked same job for 25years doing drywall now my body is paying for it shoulder surgery triple bypass 3 throat surgery after the heart bypass because the Dr paralyzed my vocal folds by ripping the breathing tube OUT wrong now I lose my voice after 2 sentences lower back pain along with diabetic neuropathy kills my legs insomnia it's was easier just going to work been denied 3 times each time I go back I end up with another problem what next.they didn't have a problem taking my hard earned money EVERY WEEK

      Tony, it sounds like you have multiple problems that would make it difficult to perform even a simple, entry-level job. Understand that for SSD purposes you have to prove that you cannot perform any job, not just that you can't do drywall work anymore.

    I need to know if I'm disabled or not for these conditions, I have ptsd, I have work in loved in the auto motive field and food service and law enforcement, witnessed some traumatic stuff so why I'm having issues with ptsd. So I'm 27 and I was born with ODDD oculodentodigitadysplasia , I was diagnosed with it later in life. (Worth a Google, 500 known cases around the world) main affects the eyes, heart digits , teeth, an others, I need to Google it again.. I want work but I don't want my health to continue having more problems. Please help.

      At 27 you would face a hugh uphill battle, especially with an "invisible illness" like PTSD. Absent multiple psych hospitalizations and/or suicide attempts, the odds of winning are low, in my opinion.

    My SSD application is back at the field office, after DDS, to make sure I still meet the non med requirements for benefits. During the the application process early on, my former boss, out of pity, paid me $500 per week for 8 weeks so could pay my rent and not get behind in bills. But I did not work at all. I filed in March, had received that pity pay from March-May, so is SSA likely to deny my application for receiving that
    much money during the "5 month" waiting period?

      If you can show that the funds do not represent payment for work performed, SSA should treat this like they would short term disability or accrued vacation pay. I would ask your former boss to write a letter explaining that you were not working - on form SSA 795.

    I am faced with having chronic pain on a daily basis. I have not been able to find a doctor that will treat my pain effectively other than the epidural injections which I have done for years, in fact almost 10 years of injections from the Pain Center. Those injections have caused either other side effects or have been ineffective in alleviating my pain . What do u recommend in this matter? I had back surgery almost a year ago and started to feel better at first but now there is pain again and additional pain in back, neck. I have Disk Degenerative Disease, Spondylosis, Radiculapathy, bulging disks and herniated disks, sciatica, and since surgery other symptoms.
    I'm really struggling as I am unable to commit to work. I am unreliable due to my pain and not dependable as I used to be. I have 25 years of work history. Single mother with a 2 year old to care and raise. Help!
    Have been treated for depression for almost 20 years.

      Rebecca, I can't offer medical advice - for obvious reasons. You point out something that many people do not understand - chronic pain can be very difficult to manage. Perhaps a medical doctor who approaches pain management more holistically might help.

    I have an intellectual disability which affects my ability to focus. They said something about if a person has to be reminded Multiple times or having trouble focusing it would be unexaptable in a work place. Is that a good sign?

      Inability to focus is certainly a vocational issue. Ideally this type of limitation should be part of an overall psych assessment from a treating psychologist or psychiatrist.

    My daughter was born with only 2 digits fused together on her right hand. She had mutiple surgeries to separate the fingers and open the web space. Her first surgery was at 4 months old. She is 13 now. Soon after the first surgery we applied for the benefits but was denied. We never appealed or try to. We just accepted the decision. I was just wondering if this is a case that we should be looked into..

    Can u do a video or tell me what does it mean when ALJ asks vocational expert 3 hypothetical questions with my limitations in jobs, and the VE states she has no data on such hypotheticals? And She says NO to all 3 hypotheticals?

      If the VE says "no" to all hypotheticals that usually mean that you have won since there would be no evidence that the judge can use to say that jobs exist given your limitations

    My Cardiologist stated in my medical record that my Ejection Fraction has been 30% since 2011 and the damage to my heart is irreversible. Is this the doctor support that I need?

      Listing 4.02 (www.ssa.gov/disability/professionals/bluebook/4.00-Cardiovascular-Adult.htm#4_02) applies if your EF is at 30% or less so it would appear to me that you are at listing level. Note that this listing has a "B" criteria as well that addresses functional limitations. If your cardiologist would address these B criteria issues that would make your claim that much stronger.

      The next step is actually the Appeals Council. After that you would appeal to federal court . I am so busy with ALJ hearings that when I take an AC case I usually associate a colleague to co-write the brief.

    Hello, I have a question maybe you can help me with. Im in the process of appealing a decision that was made to discontinue to my benefits. I have strong medical evidence that was submitted to Social Security that proves my disabilities and I still was denied. My question to you is I have MRI Reports, XRAYS, surgery reports as well other medical records that according to Social Security Impairment Musculoskeletal system proves me to be disable. How could they still deny me? What else can I do to prove my case?

      As I mentioned in the video, the MRI, x-ray, surgery reports etc. don't speak to your functional limitations. If you can get a treating doctor to issue a narrative report or complete a functional capacity evaluation that identifies specific work activity and reliability limitations your chances of winning your CDR will increase dramatically.

    i applied for my 5-year daughter back in 2015 for autism they denied me twice im on my 3rd try now they diagnosed her with ADHD she goes to OT and speech now her case is with a decision writer what the chances of her getting approve if she dont will a lawyer help win this case

      Chris, I think you would be wise to consult with a lawyer for any child SSI claim because you are going to need to meet a listing (i.e., www.ssa.gov/disability/professionals/bluebook/112.00-MentalDisorders-Childhood.htm#112_10) and you will need very specific evidence to win.

      That would say to me that you are only eligible for SSI and not SSDI. You may not qualify for SSI because of household income or excessive assets.

    Thank you for your videos! My hearing is in 7 days. I got my SSA file and it hasn't been updated in over a year. Is this normal or going to hurt my case?? 2 of my doctors wrote letters supporting my disability claim. Will this help? My issues are mainly Neurological & Vestibular with constant 24/7 vertigo & dizziness.

      It would be better if you had more current records - I try to update my clients' files to within a month or two prior to the hearing. Support from your doctors is very helpful but the judge will have to be convinced that nothing has changed since the dates of those letters.

Shouldn't they be updating SSA with new records?? I feel like they have not done their job.       My experience has been that if you are able to function in college, SSA will conclude that you are engaged in "substantial" activity and therefore not disabled.

    With your experience, do you find it is hard to get SSI for children? Say under 10 year olds? I have heard it is difficult to do so. It would be helpful to get supplemental income for my 9 year old to take to counseling, SPL therapy, ETC. Suffering diagnosed developemental delays, ADD/ADHD, anxiety, OCD, and selective mutism. He is on an IEP plan. I am about to do the appeal as his initial application was turned down tho 2 areas were marked as "severve" but says he can still function same as other children his age which makes no sense.

      Your child basically has to meet a listing - see www.ssa.gov/disability/professionals/bluebook/ChildhoodListings.htm. ADD/ADHD are difficult because so many people pursue child SSI on that basis so you need really strong psych support.

I think you have gave me some ideas and one thing I'm going to pursue in the appeal is how greatly his MDI listing of 112.11 combined with 112.08 is increasing his anxiety (112.06 not diagnosed but can get doctor to agree & do a mental RFC form you speak about) all this leading to his diagnosis of selective mutism which definitely interferes with his daily functions especially in unusual settings as compared to other children the same age with no impairments. WHEW. That was a mouthful. Let's see if this works.

      It means that you are stuck in the system - you could be waiting months for a decision.
