I have become a HUGE fan of yours! I use your videos to educate myself so I don't feel so powerless in my situation. I have been in a battle with SS since the beginning of 2013 and the US district Court just ruled in my favor for the 2nd time to remand my case back to the AJL level. I am actually curious how often that happens. I hope that 3rd time's a charm. I would love your opinion on the District court issue. Have a fabulous day and I look forward to more videos.
It is rare to get one remand, much less two. Obviously the District Court is trying to send a message to the ALJs in your area that is not necessarily getting thru. Hopefully they'll see the light this time around.
When getting a MRI.. Don't let them prop up your knees.. That changes the alinement of the back in the lumbar area. It may reduce the pain while having the MRI. But it also reduces the pinching of the nerves that you are trying to see. You don't walk with your hips bent and knees bent. So don't do it when getting imaged.
I lost my back issue case to a ALJ in May 2019 , my lawyer appealed it to the appeal council and was remanded for Oct 2020 with a different ALJ. I prey for better results this time . Thank you for your videos , it’s a big help

B-money Cisco the measurement of your curve is called a cob angle and I would think they want to see at least 20 to 30 to be considered serious sometimes the dr will say this will continue 1 degree a year also you want a noise restriction from your dr like a weight restriction and some elevated leg breaks they will also look at your age and work credits and income good luck

Thanks for sharing. I live in Kentucky. I’m in the initial phase due to pain related to spondolythesis lower back , Degeneration And bone spurs in the Neck. I’m postponing surgery till hopefully the virus clears up more. I get hand numbness after about 10 minutes and have to lay down after being up for about 2 hours. I quit working in February As a nurse after tying physical therapy and 3 epidural Injections since July of last year. These helped some but Did not get me back to a level of working a full day. I had to take a break after 2-3 hours and lay down and then leave for the day by 12. The doctor I worked for was very accommodating but After 7 months and not being back to full time he told me I needed to apply for disability. I’d been with him for 9 almost 10 years. I’m 56 and been working since 1984 when I got out of nursing school. I have had 2 falls since this past Sunday and today is Thursday. I’m scheduled to go for a medical evaluation next week that was scheduled by disability. Any advice to offer. Thanks for all the time you spend to share advice in your videos. I just recently found you and have been watching some of your older videos as well.
It sounds to me like you have a very solid case. At 56, a long work history and symptomatic complications from your diagnosis would suggest to me that you are likely to be approved. Hopefully at initial but also at a hearing.
Well I feel for the people who are DISABLED trying to get approved. I have 2 ruptured discs in my lower back, trouble walking, morbidly obese because I am sedentary since I can't walk for more than 5 to 10 minutes max. Diagnosed with rheumatoid arthritis, gouty arthritis, osteoarthritis with my entire left hip ate up with arthritis and my lower back has severe arthritis. I am also going deaf and have been since I was in the first grade. My lawyer said that they fight against any physical Disability and so my hearing almost meet the listing so I went and had another hearing test since it had been 10 months since the last hearing test and I meet the listing. When the lawyer told the judge that I would need accommodation in the hearing, he said that I didn't have to be there and he had some time doing nothing so he told her to come on down and he approved me from the date of the hearing test. I still have trouble standing and walking around, but I am on Disability because of my hearing problem. I can feel some sounds so it helps me to hear more than I normally could. Sometimes you have multiple reasons and you have to go with the one that meets the listing.
Patricia, you make a good point - if you have multiple medical issues, focus on the strongest or top two strongest and make that the focus of your presentation to Social Security. Congrats on the approval.
Hi, I’m just starting this process and heard you say in one of your other videos that it would be basically beneficial to let the judge know that I want to continue to get better and work and not just go on SSD and retire; however, I know I can’t go back to work due to the problems I am experiencing from my back issues so I will have to retire early in order to have enough money to live on. I was denied at initial and reconsideration here in Florida last year. I met the listing and a functional capacity form filled out from my doctor along with MRI's and nerve conduction tests showing severe muscle wasted and neuro damage. After following up upon denial i discovered they had conveniently lost my nerve conduction results and were never taken into consideration, which i had sent several times. I wish i had retained a lawyer at the time. I was in a auto accident a year ago which aggravated my condition again and had more MRI's which showed 2 more herniated disks along with the 3 in lumbar and another serious one in my cervical. I am working part time 20 hours a week delivering food because it allows me to sit and stand alternately for around 4 hours a night. My legs go numb after about half hour to 45 minutes of standing. I called a lawyer here and he denied my case because he said i was working more than 16 hours a week. Does this sound right? I have decided to reapply instead of wait for a hearing, so will reapply and if denied, pick up a lawyer before reconsideration. Your videos have been a huge help. I did everything right except retaining a lawyer the first time.
Thomas I also would be concerned if you are working part time on a regular basis. Many judges will conclude that you could add a few more hours and reach SGA level employment.

Hi Mr. Ginsburg! I just learned, last week when I called my SSDI attorney that I finally have a hearing date! Because the judges are so backed up with case loads here in California, they've farmed out cases to judges in other states. Because of Covid-19, my hearing will be a tele-conference with my attorney, myself and a judge out of Missouri in December. Previously, (two months ago) I was told that my hearing wouldn't be happening for another 12 to 18 months. So now I'm awaiting a call from my attorney to begin going over my case with me. Then, closer to the date of the hearing, I'll be going over it with the attorney again, to get me ready. Wondering if cases for back problems are still going to be considered, as you outlined here in this video, now that hearings are going to be handled via phone. And I'm seriously concerned about the prospect of new legislation derailing the payroll taxes that could spell the demise of SS as we've known it for over 85 years. One recent article I've read stated that SSDI would be the first thing to disappear. Praying this won't be true! Thanks again for your helpful and informative videos!
I think that it is very, very unlikely that Social Security will lose funding. Back cases are very common ailments considered by Social Security judges so you need to make sure that all records are obtained and submitted and if you can ask your orthopedist to complete a functional capacity evaluation that identifies specific work limitations. I filed back in 1996 got my disability in 1999 I was 36 when I filed. My disability is mostly based on back injury and I was approved on something I didn't hear mentioned. That is are you hireable in my case I had lumbar and cervical spine surgery with metal implants. In the process of seeking work you are required to report this to any potential employer. Thus with this type of injury and medical implant you become a risk for any perspective employer thus unhireable. I am considered unemployable due to risk caused my injury. As I have gotten older I have become more invalid due to the deterioration of my spine. But back when I 1st became legally disabled I was still able to get around pretty good thanks to the surgery. Many times I wanted to try and work even just part time but no one would hire me. Every time I applied and got called for interview my back injury always came up and that would end that. So my question is more a request and that is to elaborate on those like me that may be able to work but not employable due to the risks involved.

I am literally 2 weeks away from my SS hearing. My hearing is September 15th, 2020. I was diagnosed with Degenerative Disc Desease, Osteoarthritis in my right knee, Anxiety and Major Depression. I only was given an XRay of my back. No CT scans, no MRI was performed. Without even asking, my Orthopedic wrote me a letter stating I couldn't work sitting for long periods and cannot stand for long periods either. He also filled out all of the lawyers paperwork about what I can do and cannot do, lifting, stretching etc. Also my Therapist counselor wrote a letter on my behalf and also filled out the lawyers paperwork about my emotional stability etc. I've also suffered two strokes, one in 2017, and the other in 2018. My Dad passed away September of 2018 and have gone down since, I do not drive, and have never driven due to my terrible Anxiety. Do I have a chance to win at all without MRI or CT scan? There is very little I can do in two weeks is there? And I forgot to add, I've also dealt with panic attacks since having my first stroke and I have been involved in 3 car accidents. One in 1990, the 2nd one was on mid 2000's, and the third was March of 2019. I suffer from vertigo and was prescribed meds to help but it takes at least 1, 2 hours to kick in.. I suffered eardrum rupture when I was a child and have had recurring middle ear trouble off and on for my entire life.I was also diagnosed with carpal tunnel if both hands and prescribed hand splints to wear at night. I also was injured on the job at two separate jobs( work man's comp) had to go into physical therapy to return to work.Both were back injuries. And also on my last job I had two have two foot surgeries, one on each foot to remove heel spurs. Thank you in advance for your reply. I would appreciate the feedback because I am extremely nervous. This is my appeal, but with a lawyer this time. So hopefully this will improve my chances.
Cindy, it sounds like you have a good case. The main thing to remember - talk about how your medical issues impact your capacity for work and be specific (no "not very much" or "not very far"). Good luck.
Hi Mr. Ginsburg. I live in Macon Ga. not far from your practice and I was wondering if you think I may have a chance at winning my appeal. So far I have been denied at the reconsideration level. I have alot of back issues going on and in constant pain and unable to work. I was in a car wreck last year thats when all my back issues really intensified. I have had 3 failed spinal injections and physical therapy that did nothing to help. I recently had a visit with a spinal surgeon who said I have 2 herniated disks C5-6 , C6-7, spinal stenosis, spondylolisthesis, severe compression of L5 nerve root and gross spinal instability. I need a instrumented cervical and lumbar fusion. I was denied at the reconsideration level before I had the Dr. visit with the spinal surgeon. I am only 39 years old and I feel my age is why getting approved is so hard. Do you think I have a chance at approval and if so are you taking on new clients at this time? Thank you.
Brandy, while you are young the degree of impairment you describe and the need for surgery would seem to support a conclusion that being reliable at work would be very difficult. I am a 46 year old social worker, and worry that I’m no longer able to keep myself safe in the field due to my pain and functional issues. I left my job of 11 years in 2019 in order to take a job with less field work, hoping it would help me keep working longer. I’ve had a job since I was 15, and hate that I’m to the point of feeling like working is no longer doable.
Lynn, just remember that at 46 you have to prove that you cannot perform any job. Let's assume that you could not serve as a social worker, either in the field or in an office. Could you do anything else reliably - work as a ticket taker at a movie theater, work as a hand packer or surveillance system monitor. That is what the evidence in your case must show.
I have multiple Sclerosis,ptsd, anxiety, major depression,and psychosis and just got approved on my first try ... I'm wondering if rules have changed regarding MS because I had little detail and no lawyer???!
I don't think that the rules have changed but MS is inherently a serious condition and the mental health ailments you describe all would seem to negatively effect your capacity for work. I'm glad you didn't have to wait 2 years for a hearing.
These are our golden years.... in my younger years, if your a senior and want to just retire without being disabled, you should be able to!!!! Your golden years shouldn't be miserable just to draw what you paid in already for retirement!!! You shouldn't have to feel like a used wore out tire and have to be legally addressed and these days in your life shouldn't be a burden on you!!!!!

Hello! My husband is going to start the process of applying for disability and your videos are a gold mine! I’ve looked through all of your videos and I haven’t seen one on families and/or children. We have 2 children and were wanting to know if they will qualify as well? For how long? How will that effect things in the long run I.e. tax returns. Is my income going to be considered for his case? Also, he has 13.11 on the list Skeletal Osteosarcoma and he has been in remission for 14 years and his leg is really starting to effect his ability to work. I am going to pass it on to my daughter's father that has been fighting for SSD and is on his 3rd appeal for his case...even though they have provide at lot of evidence on his situation...several MRI's, x-rays, out come of surgeries not helping. Surgeon has made it clear that his situation will continue to get worse and that he can not work or he will be paralyazed. His injury started in his Lumbar now it is going further up his spine and according to surgeons it will continue to go up the spine there is no fixing it they have done all they can for him.
I have spinal stenosis and cervical stenosis. I have worked 39 years. I am almost 60. My downfall is my education which isn't fair. I got turned down and have reapplied now. I had a terrible lawyer the first time. I had a mean judge. Now they are sending me to their Dr after 5 months. I was a nurse. I can't work anymore.. I don't know what to say to the Dr. My hands will not work anymore due to cervical issues. My Dr wrote a letter on my behalf. I also have tumors on bottom of both feet.
I turned 51 high school ed., Grunt work. Have bad ankle, knee, shoulder, and L4-L5 herniated disk, ddd and disks pressing on the nerve and got denied in 2020!
Does anyone know who got these new laws passed in 2020? "They don't care about pain only function"? I have other problems and I don't mind getting another MRI. Actually I just got one last Thanksgiving but if they want another one they can have it. It's not having to get another MRI, it's just that these new guidelines are so cold & heartless! Pain is it disability every bit as important as not being able to function. Is to make people work having excruciating physical pain it would cause so much mental damage and make the areas where you have pain worse. Pain is present for a reason. For me, all of the places I was having pain was where I was having bone density loss. Eventually I started breaking bones left and right. Finally I'm getting treated with respect but now I have to move to Georgia. I want to be in Georgia, but it seems like the government (Dem/Rep. It makes ZERO difference) wants to be sure that most people aren't happy. I've been locked in my apartment since March of last year due to LA's covid rules. Then something happened to my leg so I can't get out without a caregiver and my friends live near the beach. They come over here to hang out with me but the point is I want to get out of here. Finally they're letting people out but I already made plans to move to Georgia. It has issues helping the disabled. I can live in a cabin in the woods by myself if I could get around without someone having to help me. Oh. & I finally got enough IHSS caregiving hours. It seems like I should stay here, but I'd much rather jump into an active volcano. May I ask again, who made these new rules? Was it Trump? Don't worry, I just want to know who to complain about to whomever is in charge of disability and all 50 states. Sorry to vent on you all. Just upset.
Most judges do not have medical experience - they are trained to look for evidence that a claimant's medical record supports a finding of disability. I think that most judges want to give people a fair hearing - but I also think that some judges have a much more restrictive view of how much evidence is "enough" which is why you see such variation in approval rates within individual hearing offices.
No one, not a single person on the planet can know how much pain someone is experiencing in any part of their body. I get the whole "function" argument but pain also has a significant factor in how someone conducts their daily life. Pain can actually cause one to favor other extremities thus putting more strain on other parts of the body. I won my case, but all of my ailments have been well documented for many years along with MRI's, X-rays, CT scans, blood tests, nerve function test and other types of scans from experts in these fields.
I was just denied at hearing level..ALJ basically “disregarded” all of my Drs notes and opinions ,citing they were Workers Comp Doctors. They actually were chosen by my WC Atty.So...in spite of extensive restrictions..it was all simply disregarded. Is appealing a waste of time??

My spine has advanced osteoarthritis at 49yrs. Was approved for a decade and despite following the rules they denied me and cut my medical and ssi. (Within the window for appeal). Im not a reliable employee. I have evidence on my MRI. Not only have I received one since approved I had a comparison done (3-5yr average between FULL SPINE MRI). I also lose complete function on left. I've been paralysed. Every activity is limited. My family help with everyday chores. Grocery pick up. Etc. Huge problem with mobility and lost my ability to type properly as my hands aren't working like they used to
. In 20 months I'll be 62 and able to draw my social security but right now I'm not able to work due to a work accident in 2011 and a car accident in 2018.my MRI says almost every disc in my back is herniated plus on top of that I have scoliosis. I was given 15% impairment rating on my left shoulder and my neck during the accident in 2011 from both my doctor and the insurance company's doctors. I was able to make it a few more years but now I can't pass a physical or do the work. Being this close to my social security do you think it a stretch to file for disability?
I have been watching your videos for over a year, and I wanted to thank you for your insight and wisdom. But I give up. I suffered immensely waiting for disability. I almost died of hunger. My attorney dropped my case and I have no hope of winning.
It always helps to have a more current MRI so if that is an option I would say to get one. I am seeing several independent MRI facilities near where I live that offer MRIs for $300 to $400 so if these exist near you that would be a wise investment.
How about if i have serious nerve damage from my back to my feet can i get disability i take care of my girlfriend but it's real hard for me i can't handle it anymore so please let me know
I have some questions, but I'd like if you would be willing to answer and give me some kind of law (CFR) or even an SSR. Is it true or false that "All correspondence must be sent to you and your lawyer" I really can't see how that's not true, not a law. I mean isn't that kind of the point of hiring a lawyer too? We know nothing about the rules and Laws, but you do. 2nd - 2 part question on the RFC (a) Does the doctor that does the MDI the one that does the RFC? (b) is it mandatory that one be done? I get there may be some....well not if this or that, but if someone has physical problems, would it be mandatory and in what case would make it not mandatory?
I'm a 80 %disable veteran (Infantry paratrooper) I'm 40 years old. I have 2 ruptured disc, stenosis, spondylosis, narrowing of the spine, arthritis in the lumber spine and right knee. I got both sciatic nerve pain. Meds have no more effect on me and injections don't either. My left leg is a 1/2" shorter .Do u think I got a shot?
I had a herniated disk at c5-c6 for accident at work I'm on l&i right now I had a acdf c5-c6 on 11-19-19 and a ext laminectomy on the same c5-c6 on 5-12-20 and my pain is constant at a pain level 4-5 if in not doing anything and goes up from there i can't look up without pain shooting down my left arm like a lighting bolt and now i lost the ability to look down for more then a few mins at a time ill get a deep burning in my neck and my left arm goes numb and sometime call dead arm where I loose all strength in my left arm i have tried to go back to work a few times but could not do it so i called a attorney and they told me to apply for ssi so i did waited 4 1/2 months and got denied on 10-26-21

I recently filed. I have severe spinal stenosis and bad disk in l5. I have mri, ct, and xray showing it. Did physical therapy but made it worse. My neurosurgeon noted only surgery will help. Im 46, didn't finish high school and only have worked warehouse work. I can only walk 10min before legs go numb and can't function properly. Hope I get it 😊
Wish I had hired you instead of the lawyer that I have now. The lawyer I have right now just don't communicate with me at all. I have my call with the ssdi judge tomorrow 9/10/20. Very nerves and haven't even talked to my lawyer. Not knowing how he going to approach my case or anything is about to drive me nuts
@@ssdattorney I think we'll. When the judge asked the vocational person to apply the hypotheticals on a 3 tears (I believe you understand what I mean) the vocational person said no jobs. Plus I also have a spinal cord Stimulator. I believe I answered the judges questions pretty well. So I also hope that helps. Thank you for your time asking how it went. That means alot to me.

Being 64 helps but it is impossible to estimate your chances without knowing what your medical records say about limitations on your capacity for work.
Very slim at your age.social security disability will probably keep denying you becuz it saves them money....they are looking for you to apply for early retirement
If your lucky; it takes a year and a half and two denial letters before you have a hearing in front of a judge and secretary in small room. Still can get denied but I was lucky one they say. Your get so many months of back pay. I had no lawyer. Just my wife, research, a powerful letter from a Dr., fought, cried. Don’t give up. Process needs reform.

How about being 54 years old, having had a 2-level lamonectomy in 2003, muti-level lumbar herniations, having never-ending pain that requires taking a handful of narcotic pain medication a day just so I can move, then having to take another handful of medication to counteract the pain medication?!?!?
Regarding needing something that’s “OBJECTIVE.” Isn’t it all “SUBJECTIVE.” “Because it’s Pain and it seems like it’s based on how much someone can take, even with images, scans that have evidence etc.” Having a normal life without pain would be easier. And working would be great. But, having to go to so many different Dr’s appointments and it feels like I’m getting the runaround. And then this damn SSI thing which is a big Maze. This doesn’t make sense. I don’t make any sense right now. Makes me feel as though I’m being untruthful with what’s happening each day. Without having a Rapport with a Dr at the Orthopedic Clinic and then not having a Rapport with a General Physician, in which I’ve only seen mine once in like two years. I don’t go very much because of “The lack of Doctors or the ARNP’s” Because of Covid there’s “a shortage.” “Unless it’s something serious.” So, it’s like they don’t believe me. Or being “misconstrued” as someone I’m not. “Drug seeking behavior.” 99% of the appointments are about pain, pain management etc. Feels like I’ve done something wrong. I haven’t. It’s a goofy assumption they might have. It’s just all subjective or just relative. Whatever
When and how is it decided for an applicant to go before a judge?? If the judge doesn’t approve a disability application, are you just notified by mail and that’s the end of it?? If you’re asked to go before a judge does that mean that they are considering your application for disability?
Wanda I hope you are approved but understand that SSA makes it difficult to meet a listing. But the listings are only one of the three possible "theories of disability" available to you so if you are denied you should appeal.

Dr. Ginsberg, I was diagnosed with a moderate klippel-fiel-syndrome 6 years ago in the C5-C6-C7 also a moderate spondylosis in C3-C4 my back never bothered me then, but soon after I started experiencing lack of mobility in my lumbar region.... at times if I do repetitive physical work, my sacroiliac joint can’t bare weight and I’m on crutches for days or weeks . This all happened in 2016 in 2017 I had a 90% blockage in my heart and had to have a stent put in . Do you think I may be a good candidate for disability, right now I’m not working and have no medical insurance . Thanks, Aaron
I am retired, I was healthy as a horse until 2018 I had a slipped and fall accident while shopping at Costco I tripped on a hole floor covering at the entrance of Costco. Despite the first responders was THE FIRE DEPARTMENT , REMSA ambulance and ER of Reno Renown Hospital. I was treated there for dislocated elbow fractured bones (left arm and injured right knee. I have massive nerve damaged. I had 4 surgeries paid by me for COSTCO DENIED MY ACCIDENT. My hired lawyer after 1 & 1/2 years holding my case he dropped it reason “ I don’t work on this kind of litigation “ My case was never presented to the court. My lawyer never got Costco a penny to pay my bills. He dropped my case leaving only 6 months to look for another lawyer. Covid-19 was on and no lawyer will accept my case. The statue of limitations is over, this banned me for pursuing my case. I got a stroke cuz of not having a good sleep & now I’m disabled , diabetic and pain all over my body. I can’t sit down for more than 20 minutes and back hurts or sometimes I feel dizzy and feel down. I’m wheelchair bound. My health insurance won’t pay my medical bills for there was a third party involved. Until now I’m still suffering from pain. My left arm is almost paralyzed. I applied Social Security in Oct 2020, they are sending me to their Doctor on mon 01/11/2021, I can barely walk my knees hurts so bad the space between my knees are awful and my lower back pain is bad i walk wth a cane and walker

My feeling is that if I have evidence, get it in sooner rather than later. I would ask your lawyer why he/she is reluctant to send in evidence that you have on hand.

What about if you have been diagnosed with total skeletal destruction and the last 5 vertebrae of your lower back has been Bone on Bone to the extent that the x rays show that the 5 vertebrae have became wedged shaped plus a diagnosis a stiff person syndrome because i have all of the above and ive been suffering in a lot of pain every day for the past 32+years i got my injuries during Army Basic training in 1988 i also have according to the doctor who read my x rays between 4000 and 8000 hairline fractures to my sacrum and pelvis and over 30 fractures to my left hip and left leg this physical diagnosis an examination occurred in 2014
Based on what you write it sounds like you have a very solid case for disability. You will also need documentation from your doctors or therapists that addresses the specifics of how your medical issues prevent you from performing various work activities. Remember that work capacity is the key to winning disability benefits.
Good morning I just got another denial letter. So now we are filling for a hearing. My Orthopaedics doctor sent me to have another mri since I have been complaining about pain in my leg and butt. Well we found out that my disc above and below the one I had surgery on is bad now. I refuse to have any more surgeries so I opt for injections. What form can I print for my doctor to fill out. Hello and Good Morning Jonathan I have 3 stents 2 in my brachial cephalic and one in my superior vena cava that are completely occluded and so every time I bend over I have syncope episodes due to my brain getting deprived of oxygen due to the occluded Heart veins I also have degenerative disc disease on my back and I had a brain biopsy done as well so for that my short term memory is almost completely gone but I had recently got denied in my case is there anything that I can do to help me get my disability claim on my side Thank you so much
I have become a HUGE fan of yours! I use your videos to educate myself so I don't feel so powerless in my situation. I have been in a battle with SS since the beginning of 2013 and the US district Court just ruled in my favor for the 2nd time to remand my case back to the AJL level. It is rare to get one remand, much less two. Obviously the District Court is trying to send a message to the ALJs in your area that is not necessarily getting thru. Hopefully they'll see the light this time around.

When getting a MRI.. Don't let them prop up your knees.. That changes the alinement of the back in the lumbar area. It may reduce the pain while having the MRI. But it also reduces the pinching of the nerves that you are trying to see. You don't walk with your hips bent and knees bent. So don't do it when getting imaged.

B-money Cisco the measurement of your curve is called a cob angle and I would think they want to see at least 20 to 30 to be considered serious sometimes the dr will say this will continue 1 degree a year also you want a noise restriction from your dr like a weight restriction and some elevated leg breaks they will also look at your age and work credits and income good luck

Thanks for sharing. I live in Kentucky. I’m in the initial phase due to pain related to spondolythesis lower back , Degeneration And bone spurs in the Neck. I’m postponing surgery till hopefully the virus clears up more. I get hand numbness after about 10 minutes and have to lay down after being up for about 2 hours. I quit working in February As a nurse after tying physical therapy and 3 epidural Injections since July of last year. These helped some but Did not get me back to a level of working a full day. I had to take a break after 2-3 hours and lay down and then leave for the day by 12. The doctor I worked for was very accommodating but After 7 months and not being back to full time he told me I needed to apply for disability. I’d been with him for 9 almost 10 years. I’m 56 and been working since 1984 when I got out of nursing school. I have had 2 falls since this past Sunday and today is Thursday. I’m scheduled to go for a medical evaluation next week that was scheduled by disability. Any advice to offer. Thanks for all the time you spend to share advice in your videos. I just recently found you and have been watching some of your older videos as well.
It sounds to me like you have a very solid case. At 56, a long work history and symptomatic complications from your diagnosis would suggest to me that you are likely to be approved. Hopefully at initial but also at a hearing.

Well I feel for the people who are DISABLED trying to get approved. I have 2 ruptured discs in my lower back, trouble walking, morbidly obese because I am sedentary since I can't walk for more than 5 to 10 minutes max. Diagnosed with rheumatoid arthritis, gouty arthritis, osteoarthritis with my entire left hip ate up with arthritis and my lower back has severe arthritis. I am also going deaf and have been since I was in the first grade. My lawyer said that they fight against any physical Disability and so my hearing almost meet the listing so I went and had another hearing test since it had been 10 months since the last hearing test and I meet the listing. When the lawyer told the judge that I would need accommodation in the hearing, he said that I didn't have to be there and he had some time doing nothing so he told her to come on down and he approved me from the date of the hearing test. I still have trouble standing and walking around, but I am on Disability because of my hearing problem. I can feel some sounds so it helps me to hear more than I normally could. Sometimes you have multiple reasons and you have to go with the one that meets the listing.
Patricia, you make a good point - if you have multiple medical issues, focus on the strongest or top two strongest and make that the focus of your presentation to Social Security. Congrats on the approval.

I was denied at initial and reconsideration here in Florida last year. I met the listing and a functional capacity form filled out from my doctor along with MRI's and nerve conduction tests showing severe muscle wasted and neuro damage. After following up upon denial i discovered they had conveniently lost my nerve conduction results and were never taken into consideration, which i had sent several times. I wish i had retained a lawyer at the time. I was in a auto accident a year ago which aggravated my condition again and had more MRI's which showed 2 more herniated disks along with the 3 in lumbar and another serious one in my cervical. I am working part time 20 hours a week delivering food because it allows me to sit and stand alternately for around 4 hours a night. My legs go numb after about half hour to 45 minutes of standing. I called a lawyer here and he denied my case because he said i was working more than 16 hours a week. Does this sound right? I have decided to reapply instead of wait for a hearing, so will reapply and if denied, pick up a lawyer before reconsideration. Your videos have been a huge help. I did everything right except retaining a lawyer the first time.

I just learned, last week when I called my SSDI attorney that I finally have a hearing date! Because the judges are so backed up with case loads here in California, they've farmed out cases to judges in other states. Because of Covid-19, my hearing will be a tele-conference with my attorney, myself and a judge out of Missouri in December. Previously, (two months ago) I was told that my hearing wouldn't be happening for another 12 to 18 months. So now I'm awaiting a call from my attorney to begin going over my case with me. Then, closer to the date of the hearing, I'll be going over it with the attorney again, to get me ready. Wondering if cases for back problems are still going to be considered, as you outlined here in this video, now that hearings are going to be handled via phone. And I'm seriously concerned about the prospect of new legislation derailing the payroll taxes that could spell the demise of SS as we've known it for over 85 years. One recent article I've read stated that SSDI would be the first thing to disappear. Praying this won't be true! Thanks again for your helpful and informative videos!
I think that it is very, very unlikely that Social Security will lose funding. Back cases are very common ailments considered by Social Security judges so you need to make sure that all records are obtained and submitted and if you can ask your orthopedist to complete a functional capacity evaluation that identifies specific work limitations. I filed back in 1996 got my disability in 1999 I was 36 when I filed. My disability is mostly based on back injury and I was approved on something I didn't hear mentioned. That is are you hireable in my case I had lumbar and cervical spine surgery with metal implants. In the process of seeking work you are required to report this to any potential employer. Thus with this type of injury and medical implant you become a risk for any perspective employer thus unhireable. I am considered unemployable due to risk caused my injury. As I have gotten older I have become more invalid due to the deterioration of my spine. But back when I 1st became legally disabled I was still able to get around pretty good thanks to the surgery. Many times I wanted to try and work even just part time but no one would hire me. Every time I applied and got called for interview my back injury always came up and that would end that. So my question is more a request and that is to elaborate on those like me that may be able to work but not employable due to the risks involved.

I am literally 2 weeks away from my SS hearing. My hearing is September 15th, 2020. I was diagnosed with Degenerative Disc Desease, Osteoarthritis in my right knee, Anxiety and Major Depression. I only was given an XRay of my back. No CT scans, no MRI was performed. Without even asking, my Orthopedic wrote me a letter stating I couldn't work sitting for long periods and cannot stand for long periods either. He also filled out all of the lawyers paperwork about what I can do and cannot do, lifting, stretching etc. Also my Therapist counselor wrote a letter on my behalf and also filled out the lawyers paperwork about my emotional stability etc. I've also suffered two strokes, one in 2017, and the other in 2018. My Dad passed away September of 2018 and have gone down since, I do not drive, and have never driven due to my terrible Anxiety. Do I have a chance to win at all without MRI or CT scan? There is very little I can do in two weeks is there? And I forgot to add, I've also dealt with panic attacks since having my first stroke and I have been involved in 3 car accidents. One in 1990, the 2nd one was on mid 2000's, and the third was March of 2019. I suffer from vertigo and was prescribed meds to help but it takes at least 1, 2 hours to kick in.. I suffered eardrum rupture when I was a child and have had recurring middle ear trouble off and on for my entire life.I was also diagnosed with carpal tunnel if both hands and prescribed hand splints to wear at night. I also was injured on the job at two separate jobs( work man's comp) had to go into physical therapy to return to work.Both were back injuries. And also on my last job I had two have two foot surgeries, one on each foot to remove heel spurs. Thank you in advance for your reply. I would appreciate the feedback because I am extremely nervous. This is my appeal, but with a lawyer this time. So hopefully this will improve my chances.
Cindy, it sounds like you have a good case. The main thing to remember - talk about how your medical issues impact your capacity for work and be specific (no "not very much" or "not very far"). Good luck.

Hi Mr. Ginsburg. I live in Macon Ga. not far from your practice and I was wondering if you think I may have a chance at winning my appeal. So far I have been denied at the reconsideration level. I have alot of back issues going on and in constant pain and unable to work. I was in a car wreck last year thats when all my back issues really intensified. I have had 3 failed spinal injections and physical therapy that did nothing to help. I recently had a visit with a spinal surgeon who said I have 2 herniated disks C5-6 , C6-7, spinal stenosis, spondylolisthesis, severe compression of L5 nerve root and gross spinal instability. I need a instrumented cervical and lumbar fusion. I was denied at the reconsideration level before I had the Dr. visit with the spinal surgeon. I am only 39 years old and I feel my age is why getting approved is so hard. Do you think I have a chance at approval and if so are you taking on new clients at this time? Thank you.
Brandy, while you are young the degree of impairment you describe and the need for surgery would seem to support a conclusion that being reliable at work would be very difficult. I am a 46 year old social worker, and worry that I’m no longer able to keep myself safe in the field due to my pain and functional issues. I left my job of 11 years in 2019 in order to take a job with less field work, hoping it would help me keep working longer. I’ve had a job since I was 15, and hate that I’m to the point of feeling like working is no longer doable.
Lynn, just remember that at 46 you have to prove that you cannot perform any job. Let's assume that you could not serve as a social worker, either in the field or in an office. Could you do anything else reliably - work as a ticket taker at a movie theater, work as a hand packer or surveillance system monitor. That is what the evidence in your case must show.
I have multiple Sclerosis,ptsd, anxiety, major depression,and psychosis and just got approved on my first try ... I'm wondering if rules have changed regarding MS because I had little detail and no lawyer???!
I don't think that the rules have changed but MS is inherently a serious condition and the mental health ailments you describe all would seem to negatively effect your capacity for work. I'm glad you didn't have to wait 2 years for a hearing.

These are our golden years.... in my younger years, if your a senior and want to just retire without being disabled, you should be able to!!!! Your golden years shouldn't be miserable just to draw what you paid in already for retirement!!! You shouldn't have to feel like a used wore out tire and have to be legally addressed and these days in your life shouldn't be a burden on you!!!!!

Hello! My husband is going to start the process of applying for disability and your videos are a gold mine! I’ve looked through all of your videos and I haven’t seen one on families and/or children. We have 2 children and were wanting to know if they will qualify as well? For how long? How will that effect things in the long run I.e. tax returns. Is my income going to be considered for his case? Also, he has 13.11 on the list Skeletal Osteosarcoma and he has been in remission for 14 years and his leg is really starting to effect his ability to work. I am going to pass it on to my daughter's father that has been fighting for SSD and is on his 3rd appeal for his case...even though they have provide at lot of evidence on his situation...several MRI's, x-rays, out come of surgeries not helping. Surgeon has made it clear that his situation will continue to get worse and that he can not work or he will be paralyazed. His injury started in his Lumbar now it is going further up his spine and according to surgeons it will continue to go up the spine there is no fixing it they have done all they can for him.
I have spinal stenosis and cervical stenosis. I have worked 39 years. I am almost 60. My downfall is my education which isn't fair. I got turned down and have reapplied now. I had a terrible lawyer the first time. I had a mean judge. Now they are sending me to their Dr after 5 months. I was a nurse. I can't work anymore.. I don't know what to say to the Dr. My hands will not work anymore due to cervical issues.
My Dr wrote a letter on my behalf. I also have tumors on bottom of both feet.

Does anyone know who got these new laws passed in 2020? "They don't care about pain only function"? I have other problems and I don't mind getting another MRI. Actually I just got one last Thanksgiving but if they want another one they can have it. It's not having to get another MRI, it's just that these new guidelines are so cold & heartless! Pain is it disability every bit as important as not being able to function. Is to make people work having excruciating physical pain it would cause so much mental damage and make the areas where you have pain worse. Pain is present for a reason. For me, all of the places I was having pain was where I was having bone density loss. Eventually I started breaking bones left and right. Finally I'm getting treated with respect but now I have to move to Georgia. I want to be in Georgia, but it seems like the government (Dem/Rep. It makes ZERO difference) wants to be sure that most people aren't happy. I've been locked in my apartment since March of last year due to LA's covid rules. Then something happened to my leg so I can't get out without a caregiver and my friends live near the beach. They come over here to hang out with me but the point is I want to get out of here. Finally they're letting people out but I already made plans to move to Georgia. It has issues helping the disabled. I can live in a cabin in the woods by myself if I could get around without someone having to help me. Oh. & I finally got enough IHSS caregiving hours. It seems like I should stay here, but I'd much rather jump into an active volcano. May I ask again, who made these new rules? Was it Trump? Don't worry, I just want to know who to complain about to whomever is in charge of disability and all 50 states. Sorry to vent on you all. Just upset.
Do these judges have medical experience or get a thrill out of denying people?
Most judges do not have medical experience - they are trained to look for evidence that a claimant's medical record supports a finding of disability. I think that most judges want to give people a fair hearing - but I also think that some judges have a much more restrictive view of how much evidence is "enough" which is why you see such variation in approval rates within individual hearing offices.

No one, not a single person on the planet can know how much pain someone is experiencing in any part of their body. I get the whole "function" argument but pain also has a significant factor in how someone conducts their daily life. Pain can actually cause one to favor other extremities thus putting more strain on other parts of the body.
I won my case, but all of my ailments have been well documented for many years along with MRI's, X-rays, CT scans, blood tests, nerve function test and other types of scans from experts in these fields.
I was just denied at hearing level..ALJ basically “disregarded” all of my Drs notes and opinions ,citing they were Workers Comp Doctors. They actually were chosen by my WC Atty.So...in spite of extensive restrictions..it was all simply disregarded. Is appealing a waste of time??

My spine has advanced osteoarthritis at 49yrs.
Was approved for a decade and despite following the rules they denied me and cut my medical and ssi. (Within the window for appeal).
Im not a reliable employee. I have evidence on my MRI. Not only have I received one since approved I had a comparison done (3-5yr average between FULL SPINE MRI).
I also lose complete function on left. I've been paralysed.
Every activity is limited.
My family help with everyday chores.
Grocery pick up. Etc.

In 20 months I'll be 62 and able to draw my social security but right now I'm not able to work due to a work accident in 2011 and a car accident in 2018.my MRI says almost every disc in my back is herniated plus on top of that I have scoliosis. I was given 15% impairment rating on my left shoulder and my neck during the accident in 2011 from both my doctor and the insurance company's doctors. I was able to make it a few more years but now I can't pass a physical or do the work. Being this close to my social security do you think it a stretch to file for disability?

I have been watching your videos for over a year, and I wanted to thank you for your insight and wisdom. But I give up. I suffered immensely waiting for disability. I almost died of hunger. My attorney dropped my case and I have no hope of winning.
If you get an MRI then have surgery that only partially worked, do you need another MRI before trial if it has been two years?
It always helps to have a more current MRI so if that is an option I would say to get one. I am seeing several independent MRI facilities near where I live that offer MRIs for $300 to $400 so if these exist near you that would be a wise investment.

Is it true or false that "All correspondence must be sent to you and your lawyer" I really can't see how that's not true, not a law. I mean isn't that kind of the point of hiring a lawyer too? We know nothing about the rules and Laws, but you do.
2nd - 2 part question on the RFC (a) Does the doctor that does the MDI the one that does the RFC? (b) is it mandatory that one be done? I get there may be some....well not if this or that, but if someone has physical problems, would it be mandatory and in what case would make it not mandatory?
I'm a 80 %disable veteran (Infantry paratrooper) I'm 40 years old. I have 2 ruptured disc, stenosis, spondylosis, narrowing of the spine, arthritis in the lumber spine and right knee. I got both sciatic nerve pain. Meds have no more effect on me and injections don't either. My left leg is a 1/2" shorter .Do u think I got a shot?
I think you do. It will be stronger if you can get treatment and records from outside the VA, however.
I had a herniated disk at c5-c6 for accident at work I'm on l&i right now I had a acdf c5-c6 on 11-19-19 and a ext laminectomy on the same c5-c6 on 5-12-20 and my pain is constant at a pain level 4-5 if in not doing anything and goes up from there i can't look up without pain shooting down my left arm like a lighting bolt and now i lost the ability to look down for more then a few mins at a time ill get a deep burning in my neck and my left arm goes numb and sometime call dead arm where I loose all strength in my left arm i have tried to go back to work a few times but could not do it so i called a attorney and they told me to apply for ssi
so i did waited 4 1/2 months and got denied on 10-26-21

My husband just received a letter from SS stating his disability was changing to regular s.s. Due to him reaching age 66. Does this mean he s no longer recognized as disabled?
WHat has changed is the account that his benefits are paid from. The question is whether it makes more sense to stay on SSD until age 70.

I recently filed. I have severe spinal stenosis and bad disk in l5. I have mri, ct, and xray showing it. Did physical therapy but made it worse. My neurosurgeon noted only surgery will help. Im 46, didn't finish high school and only have worked warehouse work. I can only walk 10min before legs go numb and can't function properly. Hope I get it 😊
Wish I had hired you instead of the lawyer that I have now. The lawyer I have right now just don't communicate with me at all. I have my call with the ssdi judge tomorrow 9/10/20. @@ssdattorney I think we'll. When the judge asked the vocational person to apply the hypotheticals on a 3 tears (I believe you understand what I mean) the vocational person said no jobs. Plus I also have a spinal cord Stimulator. I believe I answered the judges questions pretty well. So I also hope that helps. Thank you for your time asking how it went. That means alot to me.

Being 64 helps but it is impossible to estimate your chances without knowing what your medical records say about limitations on your capacity for work.

If your lucky; it takes a year and a half and two denial letters before you have a hearing in front of a judge and secretary in small room. Still can get denied but I was lucky one they say. Your get so many months of back pay. I had no lawyer. Just my wife, research, a powerful letter from a Dr., fought, cried. Don’t give up. Process needs reform.

How about being 54 years old, having had a 2-level lamonectomy in 2003, muti-level lumbar herniations, having never-ending pain that requires taking a handful of narcotic pain medication a day just so I can move, then having to take another handful of medication to counteract the pain medication?!?!?

Isn’t it all “SUBJECTIVE.” “Because it’s Pain and it seems like it’s based on how much someone can take, even with images, scans that have evidence etc.”
Having a normal life without pain would be easier. And working would be great.
But, having to go to so many different Dr’s appointments and it feels like I’m getting the runaround. And then this damn SSI thing which is a big Maze.
This doesn’t make sense. I don’t make any sense right now. Makes me feel as though I’m being untruthful with what’s happening each day. Without having a Rapport with a Dr at the Orthopedic Clinic and then not having a Rapport with a General Physician, in which I’ve only seen mine once in like two years. I don’t go very much because of “The lack of Doctors or the ARNP’s” Because of Covid there’s “a shortage.” “Unless it’s something serious.” So, it’s like they don’t believe me. Or being “misconstrued” as someone I’m not. “Drug seeking behavior.” 99% of the appointments are about pain, pain management etc.
Feels like I’ve done something wrong. I haven’t. It’s a goofy assumption they might have.

How is SSI handling CRPS?
When and how is it decided for an applicant to go before a judge?? If the judge doesn’t approve a disability application, are you just notified by mail and that’s the end of it??
If you’re asked to go before a judge does that mean that they are considering your application for disability?
I met not 1 but 2 listings. I'm 43 years old but I have Spinal Stenosis,DDD,need a fusion,etc,etc. I'm just waiting on the decision write up.
Wanda I hope you are approved but understand that SSA makes it difficult to meet a listing. But the listings are only one of the three possible "theories of disability" available to you so if you are denied you should appeal.

klippel-fiel-syndrome 6 years ago in the C5-C6-C7 also a moderate spondylosis in C3-C4 my back never bothered me then, but soon after I started experiencing lack of mobility in my lumbar region.... at times if I do repetitive physical work, my sacroiliac joint can’t bare weight and I’m on crutches for days or weeks . This all happened in 2016 in 2017 I had a 90% blockage in my heart and had to have a stent put in .
Do you think I may be a good candidate for disability, right now I’m not working and have no medical insurance .

I am retired, I was healthy as a horse until 2018 I had a slipped and fall accident while shopping at Costco I tripped on a hole floor covering at the entrance of Costco. Despite the first responders was THE FIRE DEPARTMENT , REMSA ambulance and ER of Reno Renown Hospital. I was treated there for dislocated elbow fractured bones (left arm and injured right knee. I have massive nerve damaged. I had 4 surgeries paid by me for COSTCO DENIED MY ACCIDENT. My hired lawyer after 1 & 1/2 years holding my case he dropped it reason “ I don’t work on this kind of litigation “ My case was never presented to the court. My lawyer never got Costco a penny to pay my bills. He dropped my case leaving only 6 months to look for another lawyer. Covid-19 was on and no lawyer will accept my case. The statue of limitations is over, this banned me for pursuing my case. I got a stroke cuz of not having a good sleep & now I’m disabled , diabetic and pain all over my body. I can’t sit down for more than 20 minutes and back hurts or sometimes I feel dizzy and feel down. I’m wheelchair bound. My health insurance won’t pay my medical bills for there was a third party involved. Until now I’m still suffering from pain. My left arm is almost paralyzed. I applied Social Security in Oct 2020, they are sending me to their Doctor on mon 01/11/2021, I can barely walk my knees hurts so bad the space between my knees are awful and my lower back pain is bad i walk wth a cane and walker

Clients with a medical history of back pain for a number of years well the administrative law judge look at the state denying HealthCare coverage for back pain

Hi I been waiting for a hearing, the social security sent me and my lawyer a letter asking if we have new medical records so we may avoid going to the hearing, i have alot new evidence but my lawyer say to wait until they schedule an hearing by phone, I'm thinking too send the paper and not listen to the lawyer. Can you give me an advice. I live in temple city ca. I'm going to be 50 this month September 2020.
My feeling is that if I have evidence, get it in sooner rather than later. I would ask your lawyer why he/she is reluctant to send in evidence that you have on hand.

What about if you have been diagnosed with total skeletal destruction and the last 5 vertebrae of your lower back has been Bone on Bone to the extent that the x rays show that the 5 vertebrae have became wedged shaped plus a diagnosis a stiff person syndrome because i have all of the above and ive been suffering in a lot of pain every day for the past 32+years i got my injuries during Army Basic training in 1988 i also have according to the doctor who read my x rays between 4000 and 8000 hairline fractures to my sacrum and pelvis and over 30 fractures to my left hip and left leg this physical diagnosis an examination occurred in 2014
Based on what you write it sounds like you have a very solid case for disability. You will also need documentation from your doctors or therapists that addresses the specifics of how your medical issues prevent you from performing various work activities. Remember that work capacity is the key to winning disability benefits.

they cut my clavícula and shave my palet on my left and doctors tell me i need surgeri in my rigth shouder to because my artritis en my clavícula and i almost past to better life in 2010 for my contipation do to pain killers and I stay in hospital for two weeks almost cut my intestins
i working with alot pain and I only working whit morfina every day for the last tree years
and before I used Norco and percaset
the reazon i work is because all my bills and kids im 57 years old and working in contruction for 33 years

and I hate people used pain killers with out pain in those days

When I file for disability bad me see doctors and they put me on SSI and all the pain I was staring over the years and find that more stuff about my The spine center told me I have seriation of the spine and I've been doing therapy over the years

Hello and Good Morning Jonathan I have 3 stents 2 in my brachial cephalic and one in my superior vena cava that are completely occluded and so every time I bend over I have syncope episodes due to my brain getting deprived of oxygen due to the occluded Heart veins I also have degenerative disc disease on my back and I had a brain biopsy done as well so for that my short term memory is almost completely gone but I had recently got denied in my case is there anything that I can do to help me get my disability claim on my side Thank you so much
