I have never been to a shop, boat or car, that won't give used parts back if asked....UNLESS they are running a scam and never replaced the parts to begin with.
I thought the plaintiff was dead in the water (pun intended) when he had no receipt from the second mechanic, Marco. But then surprise, surprise he had a very detailed letter from Marco to buttress the well narrated video he had provided. Great job!
This is another great case! It’s interesting to see the judge wrestle with her thoughts on a verdict, and to see plaintiffs somewhat prepared with useable evidence.
Plaintiff drove 2 hours to get the boat worked on because all the local mechanics didn't want to mess with it, not just because they're too busy. The defendant should've refused the job regarding the transom issue alone! I think the mechanic was sloppy because he didn't pop off the fuel line 1st to see if the fuel tank was contaminated, which most likely was. That would explain the dirt, thus wiping out any benefit of rebuilding the carb. The spark plug spit out because it was cross-threaded when it was installed. The cylinder threads are aluminum and very delicate. What the defendant should've done was pull the engine off the boat, done all the mechanical work, and run the engine in front of the plaintiff from a repair stand. If all went well, reinstall the engine on the transom, collect the money and send the plaintiff on his way. As I said, the defendant's mechanic was very sloppy!
That shop guy is strange to me. Who is he to hold that guy hostage. Keeping his parts and trying to tell him what he has to do with his boat. Jus sayn. I know some guys that would've bashed his friggin head in and walked out with their parts he's nuts
Yeah I never understood the attraction of having a boat. Constant money pit, hanging out with hundreds of other boaters on a sandbar swimming in urine pass
Glad the plaintiff won, that repair guy, like many, didn't do the work he claimed was done (obviously) and like many just blows you off when you call them on it. ALWAYS get your used parts back, every nut and bolt, even if you're going to toss them in the trash. I had an auto mechanic replace value cover gasket bolts with sheet metal screws when I took a car in for a valve job that I was charge $2800 for and then tell me to my face that those were the "bolts" that were in it when I brought it in - a flat out lie, but there was nothing I could do and it cost another $285 to have another mechanic put in the correct automotive bolts If I weren't the type to lift my hood and give a look over of everything that was supposed to be done before leaving a shop, as well as get used parts back, I would have never noticed it until a valve cover blew off and blew my engine. I hate to say it, but mechanics, generally speaking, are the LEAST trustworthy "professionals" we have to deal with.
And how many of those homeless people will know the names of all the parts that were faulty, and be able to present a video and clearly written description? Probably none.
@@nevermindlaughs The chances of finding an experienced mechanic who can present a video and clearly written description who happens to be homeless is extremely slim.

So why did the defendant use the term "Repair" and not "Rebuilt" in his exit interview? That contradicts his testimony, if that's the case, what else did he get wrong? Having said that, I think there was more wrong with that boat than he asked the defendant to fix.

The boat repair shops nearby did the right thing by refusing to work on that old boat, because they know there would be problems.
