I learned that the Appeal court ruled only on jurisdiction, not on the substantive issue of defection in relation to section 109 of the Constitution? Does it mean that section 109 is no longer a valid part of the Constitution?

The substance of the case is still with Justice Omotosho of the Federal High Court in Abuja. But there the Rivers state PDP says the 27 Lawmakers are still there member and not defected to APC. So, it’s bad news for Gov. Fubara.

The affidavit they sworn said that they have defected to APC and gave their reasons for their departure from PDP.
Denying that affidavit alone amounts to perjury, and they can be charged for that , if any person decides to take them on that angle.

If the high court doesn't have jurisdiction, on which power did the high court give the judgment? If you didn't sit for SSCE or its equivalent, which result did you use to gain admission? And if a court said because you did not have the qualifications to get admission into the university, your degree will be withdraw by the school. Can you still call yourself a graduate?

Martins Amaewhule is the current speaker of the Rivers State House of Assembly as it stands, because of a judgment of the Abuja Federal High Court headed by the honorable Justice Omotosho. The judgment recognizes Amaewhule as the speaker, and it has not been set aside by a higher court.

Justice for Rivers people. Remember, that Victor Oko jumbo was suspended by Amaehule before the defection and thereby his declaration of sit being vacant is not valid.
The judgement is self-explanatory. The appeal has held that the HC has no power to adjudicate on the issues of defection. If the appeal court has said the state high court lacks the jurisdiction, it does mean that there was nothing to adjudicate upon. People are just being stupid.
Shame on fubara and those river state so call elders of the state including the charge and bail Lawyers who has been coming on TV to make noise

@@MartinOkoh-fj2zj that's not entirely correct in this instance. Swearing to an affidavit has an implication, they communicated in writing, went to court, openly declared. These were actions taken. Having their names in the books of their party is another matter.
