      @@MDbandit10 He's an off duty cop outside of his jurisdiction. (That means he's not able to enforce any laws of that jurisdiction). He is a civilian at that fair, and was treated as such.

      He didn’t have to comply. These poorly trained and uneducated deputies need to familiarize themselves with The Law Enforcement Safety Act of 2010. He and and law enforcement officers can carry their weapon anywhere they want. Hillbilly Cops are useless

      If you haven't noticed lately the world it's not a safe place anymore. Especially in a large group of people there are more likelihood of something happening at a Carnival or Concert for the idiots to possibly harm innocent people. Some law enforcement agency mandate you carry your sidearm at all times. The Law Enforcement Officers Safety Act (LEOSA) also allows qualified active, retired, or separated law enforcement officers to carry a concealed firearm in any jurisdiction in the U.S. or U.S. Territories, regardless of state or local laws. However, LEOSA does have some restrictions. If you were shopping at a Mall per say and a gunman started shooting up the premises and was threatening or harming innocent bystanders and the Mall had a No Gun Policy and several off duty law enforcement were waiting outside for their spouses or children to finish shopping. What would you rather have happen wait until a uniformed officers arrive or allow the off duty police do their job for which they took a oath for proceed to apprehend the guman.

      Unfortunately, based on experience, I think he may have been intoxicated and they were trying to throw him a bone by having him put his gun away. They were probably trying to give him all the chances they could and it didn’t work out. This is of course pure SPECULATION on my part, but that’s kind of what the situation sounds like.
      I think Obstructing and Crim Trespass were done so that they didn’t have to make any record of him being (accused of being) drunk.

    This Ohio County must be three steps behind the rest of modern times. Simply carrying as an off-duty is with in the Ohio Constitution as a law enforcement officer. Every weekend and weekday there are 1000s of off duty officers, agents, retired, etc that carry a gun and badge. There is a federal statute (LEOSA) that protects law enforcement either off duty or retired to carry in all states. If you concentrate on busting an off-duty, you are bound to be lacking educational standards. I tend to wager this police chief will prevail in civil and criminal court. The suit will be costly to this county. Six deputies losing their LE certification soon to be working at the fair selling cotton candy.

      Time and place restrictions can be invoked. No firearms at the fairground means no firearms on the fairgrounds. On top of that at no point can an individual consume intoxicating substances while in the possession of a firearm. Which is another time and place restriction. Bet you are still confused though.

    I've never heard of requiring police officers to go unarmed. Carrying the badge just lets security and other officers know he is a police officer. If he wasn't brandishing or threatening, this seems to be nothing but a power play by the local department. Typical BS between departments.

      The rules and regulations for this fair clearly state that NO weapons are allowed on premises. I refer you to page 26 of the document presented in the following link:

      The St Paris police chief, while off duty, out of his jurisdiction, and not acting in any way on behalf of the fair, is no different than any other citizen. The fact that he believes he does not have to comply with the fair's rules and regulations demonstrates his arrogance and his belief that rules and laws don't apply to him. The fair organizers are completely within their rights to have him removed from the property, and appropriate action was taken. Period.

    Case dismissed. Off duty police officers are allowed federally to carry their firearm at all times in all states unless in a federal building. This is nonsense.

    was this officer there on official duty? if so, why was he listed as off duty?
    if he was “off duty” he should not be armed or displaying his badge.

    Is the county fair inside his departments jurisdiction? That is the important question. If he is the county or state have no authority to demand he put away his badge and gun. If he is not he ought to have done what he was told to do, immediately.

    According to the 2nd amendment, everyone should have the right to carry openly if they are an adult and choose to do so. It’s a crazy world and you never know when you might be forced to defend yourself or your family. My state honors that right, and many take advantage of it.

    The police chief could also arrest the deputy’s for the same thing, in uniform or out he is still a police officer licensed in that state. He will win his case and could sue except for that darn qualified immunity.

    Yes, that’s exactly what it is. It’s an ego thing. If he was a smart man, he would carry concealed and allow the local police to do their job, which was keep the fair safe. I would also imagine that if you would monitor this guy, I would bet that he pushes us as authority on people that he shouldn’t.

    Do cops have 2nd amendment rights while off duty. Were the chief's right violated? Gun laws need to be consistent all across the country. Its almost like you need to be a lawyer in every state to know gun laws with updates every 5 minutes.

      The rules and regulations for this fair clearly state that NO weapons are allowed on premises. I refer you to page 26 of the document presented in the following link:

      The St Paris police chief, while off duty, out of his jurisdiction, and not acting in any way on behalf of the fair, is no different than any other citizen. The fact that he believes he does not have to comply with the fair's rules and regulations demonstrates his arrogance and his belief that rules and laws don't apply to him. The fair organizers are completely within their rights to have him removed from the property, and appropriate action was taken. Period.
