On the tattoo thing: the guy who painted my house is an artist. But he has no claim to it. A tattoo is a commission and belongs to the person it is attached to.
The jury got this one wrong.
Tattoos and painting your house are 2 entirely different things.

Powerful yes but also very complicated. Imagine having 3 kids and all three get along, that's what the PS1 is and then imagine having three kids where all three doesn't get along, that's what an Atari Jaguar is. Yes you still had 3 good kids but what's the use when all three can't get along, you'll have trouble managing all three. The Atari Jaguar had three processors that when combined is very powerful but what's the use when all 3 can't be harness at the same time unlike the PS1 and N64 which had powerful processors that harness simultaneously every time.

Yeah, it definitely seems weird to set a precedent where an artist has legal claims against a person's body should their image ever wind up used/publicized anywhere.
I doubt anyone who purchases a tattoo does so with an understanding that in apparent perpetuity they will owe a kickback to the artist should pictures of their body with the tattoo (whether or not it is even central to said pictures) ever make money.
Can tattoo artists, for example, sue social influencers who expose their tattoos in their sponsored posts? I have to assume this gets overturned.
It's soooo messed up, a tattoo artist has no right to something they inked down on a body. They've sold it.
Did they trademark that artwork? If so then maybe they could. I could write a song if I don't copyright it someone steals it. Nothing I can do I'm S.O.L. . And if they trademarked the artwork why are they tattooing it on anyone that wants it on their body?

@@midimusicforever if you copyright trademark something you get a say when, where, and how it can be used. Usually money is involved with them using said IP. So educate yourself before you open your dork holster.

@@midimusicforever if you don't claim ownership over your work legally it's open season public domain. You've screwed yourself Lovecraft never copyrighted any of his works that's why there was many authors while he was alive that contributed to the Chtulhu mythos and he legally could not stop them from doing it if he wanted to. It's copyrighted now but that was after his death. You ask permission usually for a fee you pay for it now.

Well, there is the first sale doctrine.
If someone buys the original print, then they can do (mostly) whatever they want with it, but they are not allowed to make copies.
You can buy a DVD and rent it out, but you can not make copies of that DvD and distribute them.
I can't find a direct copy of the judge's decision, but I'm gonna assume they considered it a copy since it had to be replicated for a texture in full.
On the tattoo topic, Hasbro is putting out a line of NBA action figures, but is completely omitting all tattoos so they don't have to deal with potential lawsuits like this one about the wrestler in the video game.

A.) It’s Google, I’m sure they print their own money, and B.) it’s the Stadia. They wouldn’t be shutting it down if anyone had bought it. Jaguar had bad numbers? Sure, but I’m sure it did better than Stadia.
I’m not sure about feeling bad about the developers though, as who thought Stadia was a good idea at the onset? If you are tempted to take the carrot they were dangling, plan an escape route while making the games so that you can save yourself.
The tattoo thing came up in the past with NBA games or college ball games. I think it's incumbent on public facing performers like this to secure the rights to their tattoos, because you ABSOLUTELY can buy the copyright when you pay to get a tattoo.
Re the tattoos. What about the fact that they had to reproduce the art digitally when they made the models for the games? The artist had an original design and they had to reproduce that art to insert it into the game without the explicit permission of the artist. I'm not sure how far this will extend to other areas but if the fighter didn't pay for the art to be reproduced the artist might need to be compensated.

If Randy Orten or per Pats example, the Rock appears in a movie where his tattoos are visible there is no fair use case because the purpose of the tattoo is being essentially part of his body and is his choice to publicly display it. The tattoo artist is aware and okay with this, however when you make a video game character and use an artist to reproduce that tattoo design then you are infringing on the original artists rights. It does constitute a violation of fair use but of course cannot be linked to the success of the game. This case was decided properly on the facts and legal merit of the claims. Whether the dollar amount the artist received was worth what it cost to pursue the case is something only the artist can answer.

The only other time I can think of that there was a lawsuit over a tattoo was in one of the Hang Over sequels. Mike Tyson sued that the makers of the film recreated his face tattoo

On the Stadia topic. I said this elsewhere but I think the reason they gave total refunds is they were afraid of a class action lawsuit. Not as much for forcing refunds but with all the criticism of gatekeeping stores that take a large cut they don't want anything that could set precedent for future lawsuits against Play Store. It's cheaper in the long run.
also on the stadia refunds, many countries have laws now where if you are shutting down a service (your game will no longer be supported online for example) you have to either release a build do people can still play/use what they purchased, OR refund the purchase in its entirely. So this is probably to follow laws.

That's not true about the tattoos and art, it would only count if it was original artwork created by the artist which 85/90% of tattoos are not original art therefore cannot receive compensation as the art they steal does not compensure the creator. So this would count for a small group of creators and a few thousand is worth the trouble as artist make very little for their work.

Was Randy Orton featured in a game or was his likeness used? I would assume the moment they digitize it they are transforming the original art, where fair use comes in to play.

I still use Gamefaqs for retro game save files. PS1/2 mostly. Unlocking all the characters in Tekken 3 isn't hard or anything but too much of a time suck.
Tattooer chiming in here- the Orton fiasco is really dumb. The tattooer sold their design when Randy got the tattoo. The art is his now, period.
Just a heads up to Pat and anyone thinking of going to the last Blockbuster. It’s in Bend and is NOT just 20 min. away from the convention center. It’s at least a 3 hour trip. There is another really great video store not too far from the convention in NE Portland called Movie Madness. It’s worth the trip to check out if you are in the area.

For what? You are getting a full refund. Even in the eyes of our litigious society, you already got way more than any class action payout would have provided. Chalk it up as a bad deal and move on.
Seems to me that, as the one receiving the tattoo, maybe one should arrange to have the tattoo created as "work for hire".

We are at the point where they have run out of video game ideas. There is the rare indie title that is still original but there are so many remakes now. Shadow of Colossus was on PS2, PS3, and PS4. GTA5 was on PS3, PS4, and PS5. Last of Us remade, Horizon Zero Dawn remade, Witcher 3 remade, Dead Space remade. Where are the new original games?
You said it, most of the 'original' ideas are now on the Indies side. The AAA side has become focus-tested and homogenized. Companies are unwilling to invest in experimental ideas, resulting in mostly derivative cookie cutter products from established franchises. The Sony that would take a risk on something like Gravity Rush 10 years ago is no longer around.
It's sad when Ratchet and Clank: Rift Apart is the only PS5 exclusive.

Thank god im not the only one who says Super Switch. I hate the term Pro now. Cause everything that comes out has to have a Pro version. And I don’t want Nintendo to fall into the Pro market. And as long as Nintendo stays away from NEW too ill be good. Super Nintendo Switch sounds absolutely perfect

This generation is exposing Sony in ways that many outside of the Sony bubble saw years ago. Their vaunted exclusives have proven to have an anemic attach rate relative to their console sales, to the point that they're re-releasing these hat-on-a-hat remasters not even 10 years after the original release.

But seriously, speedruns are a great help. But Gamefaqs is and will always be the GO-TO place for any , if not , detailed and "verified" Codes & Faqs.
I think by willingly putting a tattoo on someone, you are understanding that your art walks out the door and can be photographed or used however that customer wishes. It is their body and their life. You should not control it. If you dont want your art distributed, put it on yourself. Dont put it on someone else's body that you dont control. This seems obvious if you truly wish to maintain control of your art. This is an obvious cash grab.

@@darthkai8242 The original was a average game at best. Typical Sony ~hyper big out door graphic showcase~ game. It was a forgettable story. The sequel was the problem and is a problem for any good will the game had.
I'm fine with some remakes but yeah this is too soon given that Zero Dawn was just last generation! Not even 2-3 gens ago like many remakes.
The PC port is already an improved version of the PS4 version anyways, and can actually run a smooth 60FPS.
@@darthkai8242 Just replayed it before Forbidden West came out on my Ps5 and with the 4k 60fps they added looks fantastic so I don't know exactly what they're gonna improve upon lol

I've thought about doing stuff like that for video game "insiders" and the BS they spout. I remember Emily Rogers (for first got attention for cheating on her boyfriend by sleeping with a game developer to get info) "confirming" that Breath of the Wild would get delayed from launch and not release until at least August instead of March. Oh, and let's not forget all the "insiders" who "confirmed" a Switch Pro would be released last year
