  • The plaintiff hired the defendant to install silencers on two of his rifles. He claims the defendant took too long get the parts assembled, so he’s suing for the balance on his deposit. The defendant argues he let the plaintiff know it could take a year to clear a background check to get the silencers.

    Suppressors ( silencers) are really nice to protect your hearing too! They definitely don't make your gun silent like the movies make it seem. It's still very easy to hear, but if you do a lot of shooting at the range, it can save your hearing for sure!

      @@Jungfrun1 even with ear muffs, if you are shooting in a private range of yours it's nice to neighbors. Also, ear muffs only stop so much. The air shock effect still does damage due to vibration.

      @@adamplummer2190 get better ear muffs. If you own your own range you have should invest in some decent protection. And how do you solve the problem of the bullets noise? The sound of the bullet won't be deceased because of a suppressor so your neighbours will still hear it well enough.

    Everyone is so wrong about silencers.. in Europe it is considered bad etiquette to go to a shooting range without a silencer.

    This seems like a very “bass-ackwards” process IMO. How can a dealer order non-refundable silencers, and begin work after his own background check is done, but PRIOR to the completion of the background check for the client? What if they don’t check out?

      That's how government works. Say you want a short barreled rifle. Similar situation and process as a suppressor. You get all materials together and then submit all details about rifle. Barrel length, entire length assembled. Then 14 months later you'll get your approval. You can't put everything together until the approval but you need the materials for the specifications of final product. It's very bass ackwards. Oh and don't get caught with said materials or you'll be charged with intent to construct an NFA item.

    The reason for a silencer is definitely for practice shooting! Your going to use many rounds and you don't want to hurt your ears!

    Many cattle farmers use guns with silencers to hunt predators like coyotes that prey on their cattle. The silencers help keep from scaring a large group of predators off so you can keep them in gun range.

      It doesn't make it real quiet like in the movies. They are mainly used so it doesn't ruin your hearing.

      I was a professional hunter for 30 years mostly hired by cattle ranchers and sheep herders to control predators. I rarely came across a pack of wolves just hanging out and never came across more than one cougar at a time. The suppressors were used to keep the herd/flock from freaking out.

    You have to have an SOT3 class FFL to buy/sell suppressors. That costs the FFL $500 per year to the ATF. If he's threading barrels, he ALSO has to have a Gunsmith class FFL.
    The FFL does NOT go through a 'background check' every time they order/sell a suppressor.
    The $200 tax stamp the customer pays goes straight to the ATF with the application for the suppressor (which has to include fingerprints of buyer, background check form, $200 non-refundable monies made out to the ATF, and serial # of the suppressor). It can take 6-12 months for the ATF to give an approval/denial back to the FFL.
    Most FFL require the customer to put a deposit on the suppressor. That suppressor can't be sold to anyone else as its serial # has been sent to the ATF for approval for the first customer.
    FFL's can't order the suppressor after the paperwork has been sent to the ATF as they need to serial # first. The suppressor HAS to be in the FFL's inventory at time of transaction.

    Just wondering why, If it takes a 6 months to a year to see if the government will approve the work can be done, than should any pre-work be ok to do? Without knowing if plaintiff can have modifications LEGALLY done, don't touch the weapons?

      If you can buy a handgun, you'll be approved for a silencer. ATF is just very slow to process the paperwork because of how many people are purchasing them and other items requiring the same treatment (short barreled rifles & shotguns, machine guns, destructive devices, and 'any other weapons').
      They've also since gone to a web portal for approval so it's cut the wait times significantly but still 30+ days.

    NUMBER 1 it's a SUPPRESSOR, #2, it does take a very long time to get it approved by the Feds. It's illegal in many states.

    Leave it to people in a bus to assume all silencers are used by murderers. I live in the country and always appreciate hunters who use some sort of silencer, even if not a full one.

    Shame on Harvey for corroborating with the audience “plants.” Silencers are put on guns for many legitimate reasons. If it were done for only malice then they would be illegal.

      Please provide a few of these legitimate reasons. Apparently the government doesnt think there is a lot of legitimate reasons or it wouldnt take up to a year to approve you. Apparently they want to know why an upstanding citizen feels the need to silence his weapon.

      @@thecollectorslife Just off the top of my head... (a). They greatly reduce hearing damage to competition shooters, hunters, hobbyists, and spectators of each. (b) For the hunter, they increase the chances for a follow-up shot which can mean the difference between a humane/quick death and the animal suffering far more than it needs to. (c). The same holds true for predator and game control applications. (d). They reduce noise problems/complaints at and near gun ranges. (e). Again, the same holds true for rural settings where firearms are often used. (f). They make a firearm much more pleasant to shoot. Side note... they ONLY effect the blast at the muzzle as the round exits and DO NOT silence a firearm enough so as to make it attractive to assassins. The suppressor CAN NOT make a rifle sound like a match strike like "Folly-Wood" portrays. Bullets that break the sound barrier, (1088FPS + and includes ALL rifle calibers), can not be made anything near "silent"... their bullets break the sound barrier and produce a sonic "crack" or boom. It's a dumb and restrictive law, doing more harm than good... like saying we shouldn't have mufflers on cars. In fact, a "muffler" and "suppressor" are almost exactly alike in design, function, and purpose. Thanks.

(a)They make ear muffs and plugs that are highly effective in helping competition shooters, hunters, hobbyists, and spectators, no silencer needed. (b)work on your shooting skills before you decide to hunt and kill an animal and you want have to worry about needing a "follow up shot", I guess the animal want run off as fast from a quiet bullet striking it as it would the sound from a gun that makes a loud boom. From what I know if the shot is accurate the animal would be dead before it even hears the boom. The animal with the bad shooter runs not because of the sound of the gun but because it was just struck by something. So unless the silencer has the ability to freeze frame the deer while the hunter take this "follow up shot", I need more clarification on how this follow up shot theory justifies the need for a silencer while killing your target animal.. (c) same holds true for predator and game control. Your shooting accuracy has NOTHING to do with a silencer. If the animal is shot and it isnt a kill shot it is going to RUN, boom or no boom.. (d).. city and county ordinances govern where gun ranges can be as well as noise level. Ive never seen an outdoor gun range in a residential area, have you?..(e).. rural areas.. who cares!! ITS RURAL!!..(f). Makes the shooting so much more pleasant.. how dainty of you. I dont like intellectually dishonest people. You and I both know the chance of a neighbor hearing you being shot with a silencer vs no silencer is extremely low and you and I both know who in society would make the best use of them if their was easy access to them. While they dont completely eliminate the sound a high powered rifle makes, the difference in sound decibles is GREATLY REDUCED. Its the difference between hearing a small firecracker being set off 200 yards away vs one being set off right beside you.. The feds know who would flock to these devices if they were readily available, that is why they have the hoops and hurdles... Thanks

      @@thecollectorslife OK pal... I was polite with my responce and you come back with this? I cut & pasted NOTHING. Some people actually have experience with things. Others just pop off and get insulted & insulting. Besides 10 months in Vietnam & 58 days in Cambodia, (being wounded twice there), I spent about 12 years shooting competition, (rifle). I've bow, muzzle loader rifle , center fire rifle, and pistol hunted most of my adult life. As for your need for clarification about suppressors helping with follow-up shots... The unconscious dread of recoil + noise = less accuracy, and POORER RECOVERY for follow-up shots. The animal gets a raw deal. A suppressor takes a lot of that muzzle blast away. (I said nothing about "quiet bullets" and "freeze framed" deer). Muzzle blast is the only thing reduced by a suppressor. The extra mass on the end of the barrel can also help some with muzzle whip. No experienced shooter would argue these points. I've threaded barrels for AND shot others suppressed guns, (legally), have you? I'm speaking first hand when it comes to the before & after of using a "can" on a high powered rifle. I'm betting you're not. Also, your crack about shooting accuracy not being helped by noise suppression tells me you're out of your element here, having done little or no shooting. By the way... they're "suppressors", not silencers", again, just like a car muffler. If you want to continue this, OK. I prefer being civil... But I'm not dealing with any more of your misquotes, snarky come backs or movie educated theorems. Ps. No, the animal "want" run off.

    Oh cmon, a silencer doesn't muzzle a shot like the mob movies.... it only lowers it about 10 decibels at most and is mostly used for hunting, especially when you have dogs so that you don't spook them. I hate everyone's stupid misconceptions about this product.

    The audience and host are ignorant about gun ownership and gun/rifle uses. Jeez. Rifles have silencers for a variety of reasons, nothing to do with killing people. I bet not one of them own a gun or have ever held a gun, or live anywhere near people who use guns for hunting/target practice.

      Yeah, unbelievable. I know next to nothing about guns & suppressors but I would assume you could shoot a predator without terrifying the herd of animals you're protecting. Or even just to make it easier on your ears when target shooting. That's two uses I can think of and I'm about the farthest thing from a gun expert there is. That outside group with Harvey only knows what they see in movies. 🙄

      Because it helps save your hearing if you're shooting in a range and it helps with hunting so you don't scare everything away everytime you take a shot. Also helps when you hunt with dogs and want to protect their hearing some. Suppressors don't completely silence a gun, just soften it a bit.

    Asking why anyone needs suppresses and saying only so they can shoot someone is so irresponsible. This is why we struggle with gun control issues. Gun banners go off feelings and not facts. Alot of them don't even understand semiautomatic vs automatic.
    They also can't wrap their heads around that legal gun owners commit extremely low gun crimes.

    Yeah why would someone want to make something ridiculously loud, slightly less loud? Gosh next you will be telling me that people using grinders and other loud tools want to stuff things inside their ears to block out the loud noise to make it quieter pft.     So, you can walk into a gun store and buy a gun that day, but it will take 6-8 months to get a back ground check to get a silencer on a gun. Really?

      Some newer Gun Shops recommend silencers. It is a way to keep the noise levels down.
      If I had a silencer......I would not be a good person. Too much temptation, to road rage, Karen's, and my ex.

      Because the Government that say's they want to protect you from guns, also wants to make $$ off of those willing to pay for it. I would like to have one but I'm not willing to invest that kind of $$ for one. So I will keep on wearing my $20.00 ear protection, while I shoot targets recreationally.

    Uhhhhhhh, i'm a gun owner and former Marine and know for a fact that silencers are illegal in the US. However, suppressors are legal so I'm guessing that's what the plaintiff wanted. Believe it or not, there is a difference between a silencer and a suppressor !

    Suppressors are not just for illegal activities, it helps protect your hearing if you have to shoot an intruder inside your home. Guns are very loud especially if you shoot them indoors without hearing protection

      I love her too, but she DEFINITELY can b very judgmental in alot of cases I've seen.
      I like binge watching her show, n whether it's a person not having a job, loaning a deadbeat money, an older Man with a younger woman of age....I've seen her give very very judgmental remarks to them. Sumtimes it's actually very irritating. Especially wen she doesn't always know wat she's talking about.
      I think she just learned within the past year that a TV can have an inner screen that cracks without it being visible on the outside. Yet it didn't stop her from trying to discredit or tear into the person or suggesting tht THEY don't know wat they're tlkn about.

      And no, she's not really COMPLETELY objective. I've also seen her apply certain things to certain ppl, depending how she felt about the case. A judge thts objective would try to measure by the same standard.
      I've seen her tell ppl who forgot documents tht it's too late to present them. Then other times allow a recess to let ppl obtain things.

    It can defs take a year to get cleared by the FBI and ATF to get a special registration (tax stamp) to own a suppressor. Here I think $100 or $200 for each tax stamp application and each one’s serial number has to be registered with the ATF and FBI. It’s more of a process than just getting a rifle, it’s a pain in the A.

      It's not a silencer it is a suppressor it lowers the gun shot to a lower decibel so you don't need to wear hearing protection.
      The US military is currently putting them on most of the firearms in our service to prevent hearing loss to our soldiers they can also hear orders and communicate better during fire fights so it is a win win.

    Suppressors don’t even eliminate all of the sound like n the movies and ppl literally hardly never use them to do illegal stuff. They are used to protect hearing, prevent scaring off animals when hunting, making your neighbors upset and sometimes just because it looks good on the gun.

    It's completely unjustifiable that a so called judge doesn't know anything about this process. She was 100% wrong on this. This epsiode just proves how unbelievably stupid ppl are when it comes to guns and our 2A. The ppl outside are extremely stupid! YES, it DID take 6 months to a year to get approved for a suppressor! It's less time now that gov have moved to an online portal.

    if you're hunting deer, you don't want to clear the woods of all the other deer if you miss the first time. A loud bang will do that. Silencers mean that you may have other deer to hunt.

It's just that everyone was going "why silencers?" and it sounded as if they were making him out to be the next mass murderer. There are lots of reasons for silencers. Ps i don't like Halal or Kosher food either.....the animals have their throats slit without being knocked unconscious first. If someone's going to slit my throat and kill me, i want to be unconscious when they do it. And on that cheery note.....all the best to you and yours!!

    Well this is the second case I believe she got wrong. Before turning in the paperwork you have to have the serial number of the suppressor. So you have to purchase it first then the seller holds it until your paperwork and $200 transfer tax goes through which normally takes around 6 months. The process sucks because you put your money down first then you are at the mercy of the FFL dealer as to if you get your money back if you get rejected by the ATF. The FFL dealer normally wants to keep some of it as they have their money tied up in something they now have to sell to someone else.

    5:40 Are they serious? Like the guy said, add a silencer so the gun is quieter when you fire it. If it's too loud at a range or hunting, people on neighboring properties will complain about the noise.

    I'm so not a gun person, but I disagree with Harvey and the crowd about the all reasons for a silencer being illegal or suspicious. I could see if it's going on a hunting rifle (which wasn't specified here) how it would help the hunter not scare away animals if he/she misses, or whatever. But, like I said, not even a gun person, so I really have no idea.

      What? It useful hearing protection if you're shooting inside a range and it helps with noise if you're hunting outside and don't want to scare away prey and be a good neighbor. Suppressors don't silence gun shots, they quiet them and people have many valid reasons to not want to hear extremely loud gun retorts when they shoot a lot.

    So much disinformation spoken here. Suppressors have many uses and actually in some countries they are required so as to not disturb people in close proximity. They are an excellent tool to have for training new shooters as the sharp report of a firearm can make one flinch due to the loudness. During training the instructor can more readily speak to the people being trained as earmuffs and plugs don’t have to be worn at all times. A suppressor causes the sound to be projected downrange rather than to the sides and back. When one wants a suppressor, the suppressor is paid for and the dealer keeps it locked away in their safe until the approval is issued. One gets a form with a Tax Stamp that costs 200.00 for each NFA item purchased. After ATF approves the transfer of the item, the dealer is informed that the approval has been issued and the dealer informs the purchaser that they can come and take possession of the item after completing one more background check bye the completion of the 4473 form and approval of that.
    Quite complicated and lengthy. It seems as if the Plaintiff wanted his firearms fitted with adapters that allowed him to attach the suppressor. That in itself is perfectly legal as it was physically not part of the registered and numbered suppressor. The Plaintiff absolutely would make the purchase of the suppressor before hand as explained above.
    In the case of a disapproval of the transferring of the suppressor from the dealer to the purchaser, the dealer is obligated to refund the monies paid for purchasing the suppressor.
