The house was in his name only. I did not want to go through probate. So I was going to do a spousal petition. I bought house with parents ,they are dead and my dad left me his portion in his will. When I die it goes to my brother and sale goes into special needs account. I'm on the original loan, the refinanced loan and on deed. Do I need to do any else. Other than show death certificates for my parents if I sell before I die. Can I avoid probate?
What if the parent dies there’s no spouse no written will is completed but the parent clearly indicated in a video who would be the beneficiary & who will not.& gave the sole beneficiary power of attorney but dies in a nursing home facility during a pandemic & couldn’t get visits before the sole beneficiary/power of attorney was able to prepare a written will to be signed. Would the court view the video as evidence for a supplemental will or at least guidance as to which kid gets total possession of the property & would the fact that the sole intended beneficiary was granted power of attorney over the rest of the kids hold weight together with the video expressed will?

I know of someone that is not changing the deed of the original owner is now deceased 12/2022, but he is not changing the deed to gain his benefits exemptions in property tax. I was going to report this fraud, but they cannot guaranteed me anonymous. I am afraid of him and don't want him to come after me.

This is a misleading title to the video. I thought this would tell me how to actually transfer the property title after death but it didn't. If a trust is already set up, the person dies, the beneficiary is entitled to the property but how does the property then actually get transferred to them to make them the owner of record.

I disagree it doesn’t avoid Probate it just delays it until the survivors family goes through it and disgruntled trustees are forging the Living Trust. If it's just one house, and one heir, then do a BENEFICIARY DEED. File it with the county recorders office. Done.
How do we change title after probate?

This is a misleading title to the video. I thought this would tell me how to actually transfer the property title after death but it didn't. If a trust is already set up, the person dies, the beneficiary is entitled to the property but how does the property then actually get transferred to them to make them the owner of record.

I disagree it doesn’t avoid Probate it just delays it until the survivors family goes through it and disgruntled trustees are forging the Living Trust.
